RICHMOND, Va. (AP) - The 4th Circuit Court of Appeals has upheld a decision requiring a Massey Energy subsidiary to hire union miners at a West Virginia mine.
Wednesday's ruling affirmed U.S. District Judge Joseph Goodwin's 2008 decision requiring Mammoth Coal to offer jobs to 85 miners. The union miners lost their jobs when Mammoth purchased the Kanawha County mine out of bankruptcy in 2004.
A National Labor Relations Board administrative law judge ruled in late 2007 that Massey had violated the National Labor Relations Act by refusing to hire the United Mine Workers affiliated miners.
Massey spokesman Jeff Gillenwater said Thursday the company offered all 85 miners employment last year, and only nine accepted.
Gillenwater said seven remain with the company.

I am the wife of one of the miners that lost their jobs. My husband is proud to be a UMWA member. He has never been offered a job. He has the highest Qualifications ranking of all the miners. You anti-union people don't know what you are talking about. How many of you have walked in their boots or been underground for hours at a time wondering if you would see daylight again. These miners were only trying to keep what was and still is rightfully theirs! The Mining Industry is safer because of the "UMWA".
Coalminers were and still are out there making a living, Ray. Obama said before he was elected that he wanted to kill the coal industery. That is why folks are mad. If this cap and Trade bill passes alot of american industery will disappear. hopefully all the left wing socialist idiots will disappear also.
To Guy Smiley--You must be a young man because it was the UNIONS that made the Mining Industry safe and set the wage standards and gave miners and other workers the great benifits that some lucky non-union workers today. The problem is there isn't enough Unions in the U.S. My Grandfather and others like him helped to put the 1st union mines in KY (Pittson Coal or Eastern) You my young friend have no idea what you are talking about.
