KANAWHA COUNTY, W.Va. (WSAZ) -- Nearly a year later, many lessons have been learned from Kanawha County's smoking ban.
Now, the health department is taking a look back at its success and downfalls. Health Department officials said they've received a lot of positive feedback, but they don't ever expect to have a 100 percent compliance rate.
They've taken 12 business owners to court so far, but all of those cases are still pending. Environmental services director Anita Ray said she wishes they would have educated the public more on the dangers of smoking before they passed the ban. Complaints are still coming in, especially from businesses losing big money.
"I believe we've given it more than a chance, and we have not seen our business come back," said Rich Treslar, executive director of casino operations. "Our numbers have been consistently down 20 percent since the inception of the smoking ban."
Tri-State officials would like to have permission to have a smoking and non-smoking floor. They'll take their proposal before the Board of Health at their next meeting.

I think the ONE thing everyone overlooks is the freedom of a person to choose. People can choose to drink, to smoke, to have sex with several partners OR you can choose to NOT do those things. If someone has a problem with second hand smoke then choose to NOT frequent places smokers frequent. YOU have a choice. One of the options you choose should NOT be fighting to deny others THEIR right to choose. I do not smoke, I have never smoked nor will I ever smoke but I refuse to be egotistical enough to believe my opinion on the matter should be the law. The absence of a law is the correct decision.

WOW!-The utter lack of intellect here is astounding. Cigarettes are a legal product. If a person purchases or builds a business, they should be the one that decides if there is smoking or not. Allow the market to decide. Their business will live or die by that decision. This is America people. Those of you calling for "bans" - you should be ashamed of yourselves. You use your freedom to advocate the removal of freedoms for others. This, however is no suprise given the present state of (and style of) government. Big brother is watching - Seatbelts, tobacco, alcohol, tylenol, helmets, trans fat, etc. . . . .

Brenda, those who overeat are not hurting anyone other then themselves. Those who smoke hurt everyone around them when they choose to light up in public. I do wish, like u said, that they would "shut down cigarette companies and quit growing and making them altogether". I would love that. I wish they'd get rid of this fat food also along with alcohol. Alcohol is terrible if used wrong. Some crazy drunk guy kept saying he wanted my baby tonight at Kroger and he cussed out the pharmacy and made a big scene. I just hope he wasn't driving. Someone would probably be killed in a wreck with him
