UPDATE 1/20/11@1:00 p.m.
PIKEVILLE, Ky. (WSAZ) –The victim of an officer involved shooting has been indicted by Pike County Grand Jury.

Kentucky State Police say Charles Hocker, 33, of Louisville faces two counts of attempted murder and one count of fleeing and evading police.

Hocker was shot by two Pikeville Police officers following a pursuit back in August.

UPDATE 8/17/10 @ 7:45 a.m.
PIKEVILLE, Ky. (WSAZ) – Investigators have released more information on the man who was shot multiple times by two Pikeville Police officers late Friday night.

Kentucky State Police which is handling the investigation says the incident began at a home on North Mayo Trail. The say Pikeville City officers, Addison Baisden and Chad Branham were called to the house concerning 33-year-old Charles Hocker of Louisville who was allegedly violating an emergency protection order.

“The information that they had was the suspect was trying to make forcible entry into a residence. As the police officers arrived on scene, their dispatch advised them the suspect was suicidal and also intoxicated,” said Trooper Shaun Little.

KSP says when the two officers arrived, Hocker allegedly drove off with no headlights on.

The two officers started chasing him.

They followed him for several miles onto Hurricane Creek Road.
Investigators say Hocker then pulled into a gravel drive and stopped.

“As the officers initiated a traffic stop, the suspect immediately reversed his vehicle in a manner trying to strike the two officers, actually striking the police cruiser. At that point, the officers responded by firing their weapons multiple times,” said Little.

The two Pikeville officers then performed CPR on Hocker until paramedics arrived.

Investigators have not released yet how many shots were fired, or how many times Hocker was hit.

Hocker is reported to be in stable condition at St. Mary's Medical Center in Huntington.

The two Pikeville city officers who fired shots are on paid administrative leave during the investigation, which is standard procedure.

The police act too hastily in these situations. Why didn't they just shoot the guys tires? He couldn't have went anywhere. then if he got out of the car or shot at them they could feel they were in danger. Thats just an excuse for over authorative policemen.

What WSAZ didn't report about this incident was there was an EPO against this man. The family already had enough problems from him that they felt the need to get a protection order. And once a protection order is issued, the family did the right thing by calling the cops on him. It's a sad situation for the officers involved but when you knowingly violate the law the consequences are harsh.
