UPDATE: Two teenagers who now face murder charges after killing a Sheriff's Deputy in Kentucky were in a Bell County court today.

The teens are charged with murder after crashing into a Sheriff's Deputy's cruiser killing both Deputy Sean Pursifull and his K-9 partner.

Today's arraignment was closed because the teens have been charged as juveniles.

Police say the 17-year-old driver and his 16-year-old passenger took off without paying for gas.

They led police on a high-speed chase before hitting the parked police cruiser.

PIKEVILLE, Ky. (AP) - Two teens charged with murder after a crash that killed an eastern Kentucky deputy are expected in court.

Kentucky State Police Trooper Walt Meachum says the teens are to appear in Bell County District Court on Friday. The proceedings are closed because the suspects are juveniles.

The names of the 17-year-old driver from Delaware and a 16-year-old passenger from Pennsylvania have not been released.

Bell County Sheriff's Deputy Sean Pursifull and his police dog died when the teens' car rammed into his parked cruiser during a high-speed chase early Thursday.

Funeral services for the deputy are scheduled Sunday at the Bell County High School gymnasium, followed by burial in Pineville.

NEWARK, Del. (AP) - Delaware state police say two youths identified as suspects in a crash Thursday that killed a sheriff's deputy in eastern Kentucky had been stopped and questioned early Sunday by a Delaware trooper.

According to state police, a Delaware trooper on routine patrol saw three men acting suspiciously shortly after midnight.

Authorities identified the three as 17-year-old David Poppiti of
New Castle, 16-year-old Eric Gerren of Lincoln University, Pa., and
an 18-year-old.

Officials say when the trooper approached and questioned the
men, Poppiti threw a bag of marijuana on the ground and ran. Gerren
and the other man were taken into custody but not charged, and
Gerren was turned over to his father.

A prosecutor says two teens charged with murder after a crash that killed an eastern Kentucky deputy could be tried as adults.

Bell County prosecutor Neil Ward says the 17-year-old driver and his 16-year-old passenger should be treated as adult defendants because of their age, the nature of the crime and because a gun was allegedly found in their car.

Ward and Kentucky State Police did not identify the teens because they have been charged as juveniles. However, 17-year-old David Poppiti and 16-year-old Eric J. Gerren were named in a statement Friday from Delaware State Police, who said they had made a traffic stop on the teens Sunday.

A public defender in Bell County says she and her staff are representing Poppiti and Gerren. She confirms they pleaded not guilty during their closed arraignment today and declined to comment further.

(Charlene) My seatbelt question was entirely warranted. While most of you are busy pointing fingers some of us look at tragedies in order to prevent them from happening again. If the officer was parked along the road with the intention of pulling out to pursue the suspects he should have had the seatbelt on. No time to put it on while accelerating while in pursuit. As for whether it was a t-bone or sirloin it appears as if the cruiser was hit from behind. In that case seatbelt definitely could have made a difference. You can bet if I knew that a vehicle would be driving past me recklessly and at a high rate of speed that my seatbelt would be on. I HAVE A REPLY TO THAT, OFFICER PURSIFUL ALWAYS, LET ME SAY ALWAYS, WORE HIS SEATBELT.HE WAS ONE OF MY FRIENDS, HE KNEW A HEAD OF TIME WHAT WAS GOING ON, AND HE (AS ALWAYS) WAS READY TO DO HIS DUTY. SO IF YOU ARE NOT 100% SURE OF WHAT YOUR TALKING ABOUT, SHUT UP!

This officer and his partner are definitely heroes. But I stand by my comment. Their lives are worth more than a gallon of gas. May God be with their loved ones.

To a point, yes the parents should be held accountable, when they are a much younger child. All you can do is the best in raising your children. A parent can't always be there to stop something like this from happening. As far as to the commenter about "What is wrong with our kids and teens today". It's very simple, it was suggested in one post to use a 2x4 and there may be ideas from others, but the simple fact is the government has decided what is best. If the child doesn't like the rules all they have to do is yell child abuse and then you as an innocent parent will be in jail. When I was growing up, I wouldn't have ever had even a thought to try something like this. I knew my principle had a paddle and parents had the belt. There is no fear in teens today. Now who do you blame? Everybody!!!! We need to stand up and take our rights back as parents. We are as a society loosing our children.

I think Charlene has a point with the seatbelt comment. The police force isn't going to be focusing on whether to try the teens as adults or not, that's to be left to the justice system. The police will be looking at how the accident happened and what the police force can do in the future to prevent another tragedy like this. My condolences to the family of the officer who was out there doing his job. The suspects will get what they deserve in prison.

So what Kathy and the others that think the police shouldn't chase criminals. What just let them go? A police officer is doing what he is paid to do not just let people go. They are real life heroes that put their life on the line every day for the rest of us. Two good officers died in that crash but they died heroes!

Posted by: Anonymous on Jan 11, 2008 at 06:27 PM
well, all you retired police, maybe death is God's will, his plan......get a donut, and I'll get a clue...do you think Louie Pudunavac should lose his pension for stealing 180,000 from the taxpayers??I do and so do many....put these young guys to death??then should Poudunavac have his hands cut off for stealing??

At The National Law Enforcement Memorial, where Officer Pursifull will be remembered, each of the pathway entrances are adorned with a powerful statuary grouping of an adult lion protecting its cubs with an inscription of PROVERBS 28-1. I am sorry for your ignorance Mr. Anonymous, get a clue!

My heart goes out to the officers, and prayers are with the family and friends. I am sorry for you loss.

Posted by: Anonymous on Jan 11, 2008 at 02:35 PM
anonymous that responded to the retired cop: what is your problem? That quote from the bible was a good quote and- the thou shalt not kill remark well its not killing for no reason if they execute these punks...these punks killed this officer for no reason and they should be put to death for purposely killing this officer, If you are saying that it is wrong to put them to death then you are wrong- if we started punishing people for murders then it would make others think twice before doing it themselves, but NOOOO we have to be a bunch of pantywaist people saying that the death penalty wont bring back the dead, but in my opinion it will stop them from killing someone else!!! WE NEED THE DEATH PENALTY BACK all they get now is taken care of for the rest of their lives and the working people of America have to pay the bill to care for these murderers.

Did they T-bone the car?as the officer blocking the road?any Witnesses?just seems strange to run off the road when they are trying to get away.Maybe he had his lights off.

was the dog riding in the front or back??

Posted by: Anonymous on Jan 11, 2008 at 12:21 PM
retired cop, don't quote from the Bible just passages that fit your need...thou shall not kill....sound familiar??no wonder some are good cops, others refered to as " pigs"

Posted by: Matt on Jan 11, 2008 at 11:32 AM
Charlene, if you read the story again it said that the deputies were SETTING on the side of the road not driving, so a seatbelt would not be warrented. If you ask that question you should ask "Were the teens driving an automobile?" It dose not matter. Also, Police chase people becuase they run so if they sould let a gas drive off go free because the Oil Companies have lots of money they should let the other criminals go because everybody usually have insurance on thier belongings. Fact of the matter is two Officers are gone because of idiots.

Posted by: wba on Jan 11, 2008 at 10:45 AM
Both teens should be charged with two counts of murder, charged as adults, and promptly executed!

Posted by: Lisa on Jan 11, 2008 at 10:35 AM
I say try the derelit juveniles as adults, and let them face the consequences. If ever a juvenile case deserved it, this is the case in which to enforce it. To be so unbelivably selfish and stupid as to take someone's life over stealing a tank of gas is beyond belief. It just goes to show that people have no respect for life or each other anymore. What a wicked world...My heart goes out to the family of the officer, and to his fellow officers who have to endure the loss of their family and friend.

Posted by: Anonymous on Jan 11, 2008 at 09:58 AM
My sympathy and prayers to the officers and their families. The K-9 becomes an officer and is part of the family. God bless the family and I pray you find peace and be relieved of the pain more each day that you will be suffering. As for the two punks, this was a deliberate vicious act. Why do people oppose the death penalty in clear cut cases as these? Ok, no death penalty, per se but slow torture as they have done to the family. They were so "tough" they had to use a vehicle for a weapon, figures. These are not men, but criminal thugs that should be put away forever. With their criminal, evil, sick minds, they will kill again. Too bad the parents weren't responsible enough to take a 2x4 to them before they killed someone. Kids don't just up and one day do this. By this age, parents know what the kid is capable of. I am a Mom of 3 and Grandma of 4 and psych nurse.Stop ignoring the behaviors and allowing punks like these to ruin lives. They call it "tough love" I call it responsibity.

to charlene....did u see the car??? and you ask if the officer had a seatbelt on!! some people use this comment box for all the wrong reasons

Posted by: anonymous on Jan 11, 2008 at 12:26 AM
This is a terrible, violent and tragic incident. My thoughts and prayers are with the family of the deputy this evening. I agree with Kathy S regarding the wisdom of police chasing criminals. However, in this case, the deputy was pulled off on the side of the road waiting when they slammed into his car, not driving 100 mph. Deputy Purcifull did not wreck his own car driving at high speeds while chasing these kids. It was a deliberate act of violence on the part of the teens and they should be tried as adults. Maybe in prison they'll learn to definition of consequence...

Where were the parents? They should be held accountable also, In these times as a parent you should know where your children are and what there doing. I would never let my 17 yr old go on a trip that far away. I pray for the family of this officer. I am the child of a fallen police officer in the line of duty, it is something that stays with you your entire life. He was out there on our highways protecting the citizens from harm, no different than a soldier at war. I am very thankful for the men and women who choose this profession to protect and serve, it takes a very special person do this type of work. May god bless them all.

Each should face TWO counts of murder. God bless that Deputy's family.

Posted by: Bev on Jan 10, 2008 at 06:15 PM
I agree with Kathy. I think they should not be chased unless they have hurt someone or are armed, escapee, etc. The oil companies can afford to lose a few gallons, they just pass all their loses of on us anyway. I'd rather pay more for gas than have innocent people murdered by these thugs. God be with this officer's family and friends.

May God be with the family during these hard times, but just remember God will never put more upon your shoulders than you can handle. This is a very tragic event and these teens and the parents of the teens MUST BE HELD ACCOUNTABLE FOR THERE ACTIONS.

These youth stepped out of a juvenile behavior into an intentional adult criminal act killing two law enforcers. They each need to be charged with two murders and if the state can't now they need to change their laws to include the dogs. My prayers are extended to all families involves in this travesty these ill minded and anti social youth created. They need not be bonded out or have any contact with other youth. They crossed the most noble line in our society and they need tough love even while waiting their justice.

My step-dad is a police officer and stories like this scare me to death! Those kids knew exactly what they were doing. It wasnt necessiary to crash into his patrol car but they did and I think that they should pay the max!

Posted by: police officers wife on Jan 10, 2008 at 03:27 PM
My prayers are with the family of this officer. Those boys (men) knew exactly what they were doing, and they should have to pay accordingly for the pain that this has caused the family, community, and deputies. There are dangerous people in this world, and we need to keep all police officers in our prayers for safety as they protect and serve.

Prayers go out for the family of this brave officer. Those teens, I can't stop thinking about them. I am like what some one else said in here, they be tried as an adult. They had control of a very large weapon that night when they hit and killed that poor deputy who never had a chance. You know the day we give these young folks a chance to go game hunting or that little card we all dreamed of for 16 years, the right to drive, that is when we should treat them as adults. Life is to short, why should these teens be allowed a long life? That deputy they killed will never see 32.

Posted by: Nick on Jan 10, 2008 at 12:46 PM
My heart goes out to this Duputie's family, friends, and co-workers. These teens must be held accountable for their actions. When will people learn not to run from the police?

My heart goes out to the family of the deputy. I hope that the justice system works to put the two juveniles where they belong. It fails us to much to often.

This also makes me once again question the wisdom of police chasing (often at very high speeds) criminals. You see these high speed chases all over the country. They've become a staple of nat'l news channels like they're some kind of movie, they're NOT. Not actors, not stunt people, REAL people who often die or kill others in these chases Is a few gallons of stolen gas worth the lives of this officer & his partner? NO! Not in my opinion! Don't they have cameras that they could get the plate number of people who drive off without paying? Even if one of these huge oil companies lost money in drive-off's I'm sure it wouldn't bankrupt them, but now for the want of a few dollars, two police officers (and yes, the K9 is DEFINITELY an officer & I know his partner thought so too) are DEAD! I hope it's worth it to the oil company These police "chases" threaten the lives of everyone including innocents. Are they really worth it? Don't think so. JMHO

Posted by: Kathy S on Jan 10, 2008 at 07:29 AM
Oh this is so sad. My deepest sympathy goes out to the officer and his PARTNER's family, fellow officers, friends. And yes, his beloved K9 WAS his partner I'm sure and they died together as partners. And all of this over stolen gas! What a horrible thing. To the officer and his buddy/partner's family...our deepest sympathy, thoughts and prayers go out to you as well as their police family.
