PROCTORVILLE, Ohio (WSAZ) -- A dying kitten trapped in a storm drain was the center of a controversy Wednesday in one small town.

A passerby heard the cat meowing and said she couldn't get the Proctorville police to help save it.

Tabitha Berry heard meows coming from under the ground in a sewage drain.

“I just don't like to see them suffer,” Berry said.

Berry went to the city where she said she couldn't get the Mayor or police to help.

Proctorville’s Mayor, Charles Stapleton said he checked out the drain, but didn't see a cat and told Berry not to lift the grate to save the animal.

“The case was they were going to get a crowbar and get it loose, and I said pick it up and out of the ground,” Stapleton said.

“The city didn't help cause there aren’t' any revenues available for rescuing cats out of drains,” Officer Mike Vaden said.

Vaden said they could try to use a net and pole.

“Going inside there would be dangerous. It’s close to traffic and they could get hit by a car coming out, Vaden said.

When that didn't work, Berry and three friends went against the wishes of the police and removed the iron grate to save the kitten, but it was too late.

“It's just pitiful nobody will do anything for animals or even kittens,” Berry said. “There's another cat still alive down there.

No word yet if another cat has been found in the drain, but it's a situation Tabitha Berry hopes city leaders will take more seriously if it happens again

Unfortunately the cat did die late this morning.

There’s no word yet if the other cat believed to be in the drain has been rescued.

I saw a story recently on WSAZ about a duck whose ducklings got stuck in a sewer. Somehow the Parkersburg authorities managed to collect enough resources to rescue those ducklings in a short time!

Good grief, Jr. firefighter, take off the Superman underoos and get a clue. You live in Rome Ohio, not Chicago! I do risk my life in my job every day, probably have taken care of you or someone in your family and you would never know it. I don't go home after a 12-16 hour shift and relay all of my tough guy stories so I can sound cool. Your buddy made a comment that losing houses "happens". Well, try cleaning the burns from a person that came out of the house you say you run into..... but you didn't. She expired. The firemen that got her out of the building were from Proctorville. There were three of them and they carried her to my partner and I. "IT HAPPENS"??????? Please rethink something before you type it. This is the real life.

Well, I did'nt want to lower myself to comments about local fire departments, but after a comment by LT. Kuhn, I must. You stated that 'MONEY' made an uneducated statement. WRONG. I have lived in ROME Ohio longer than you have probably been alive. There are countless instances of lost homes and other structures due to negligence and slow response time in regards to Rome fire department. I am personally disgusted by the suggestion to increase taxes by a young adult that does not pay them to begin with. (clue:go to your local courthouse) Rome township supplies more than enough money for trucks, equipment, facilities, etc. to keep you prepared. Also, I get an envelope every year from them asking for additional support. If you need more money, go to your own home and turn off the lights you have running while you sit in lawn chairs outside. You don't need my money! If you are running into burning buildings, who are all the guys w/ your fire department gear standing around the red trucks??

Lt.Kuhn. I am educated... and employed. I also own my home, property and internet service and couldn't care less if my comments offend you. You see, by yet another "public record" one can see that you are NOT a property tax payer. Interesting, considering you actually expect senior citizens and other contributing members of society to put more money into the ROME fire department to give you a salary? Go work for Huntington. Also, losing houses "happens". You seem awful flip to be a dedicated VOLUNTEER servant. Talk to a victim of a house you have lost? Or worse one who has lost a loved one? Get a clue JR.

Why didn't they call animal control. Im sure Proctorville PD has the required equipment just sitting in the back seat of there car for rescueing cats out of storm drains. To those bashing the fire departments hope your very proud of yourselves for bashing people who put there lives on the line everyday and get nothing in return. Thats right all fire departments in lawrence county are volunteer except for Ironton. Myself being a lieutenant with the rome fire dept i know what kind of danger we are subject to. Im sure that if Proctorville fire dept would have had someone available to help they would have. I know alot of those guys down there and they would give the shirt off there back if they thought it would help. So next time your in an emergency situation i hope you don't get angry if your call for help isn't answered b/c they are rescueing a cat out of a storm drain while your laying there trapped in a car or trapped in a fire. I also back up Lt. Kuhns comment very well put.

Ok people, think OUT OF THE BOX! Take some fabric and use it as a cat and drain cover friendly ladder. Unless the kitten is really really young, it will climb right up.

For Those who voted for Charles Stapleton, don't you wish you could recall that vote? The Police officer Mike doesn't even know how to turn his head lights on at night while cruising the back streets in the police cruiser, how can you expect him to know how to save a drowning kitten.

This is terrible. An animal should be treated just like humans they have feelings just like we do. How would that cop like to be drowning in a drain or something and someone hear him and know that he's there and then not even try to help him out. What are people in proctorville going to think about this..im sure their not going to be too happy. And the fact that the mayor didn't do anything is just down right sick. They tell us not to abuse animals and everything but knowing that they are drowning and not doing a darn thing to help is exactly like abuse. And i don't see how they can sleep at night knowing that they killed a living thing.

Im with Kuhn I mean I dont see him working his but off to save the lives of those who need it the most we put our lives on the line day and night trying to keep people safe when he is in his warm bed at home he has no right to say that. When it comes to being a firefighter its not just go out there and look cool you have to work your but off. If you think you can do a better job Id like to see you try. To Money: First off, if you are going to make a “legitimate comment” use a legitimate name. I am a lieutenant for Rome Fire Department and strongly take offense to your comment. Although I realize any fire department discussion is un-related to this specific incident (since Proctorville Fire Department was never dispatched) I wish to voice my response to your un-educated opinion. People like you, Money, are quick to look down on the "houses that were lost" but look at the other numbers next to your so-called "public record". You will see that we may have lost a few houses, it happens. Any fire department you ask loses houses. But you don’t dare mention how many we have saved, or how many other instances our services have made the difference in someone's life. Want a paid on-call department? Raise your levy to 2 or 3 mill... you wont be cause you complain about high tax rates anyways. YOU make the choice. Educate yourself and then come back and post a valid comment. Lt. Nick Kuhn

Maybe if you can get off ur be hind and go to the academy and become an officer then maybe you can try and save an animal and stop worring about the other side and make a decision like officer and mayor of pville had to like either let the 23yr old go in the drain and possibly get killed hit or hurt or let her not climb in and let the cat find its way out .. till then keep ur mouth shut!

Valerie when it comes down to it, the right thing to do is call 911 don't sit here and bash the fire department about saving a cat when they are out saving human lives from fire, a mangled car, or some other deadly act of nature. Frankly as a citizen of Huntington I would be highly upset if I was in danger and the authorities chose to save the life of an animal rather than preserving human life. Yes i do believe that both human as well as animal life needs to be preserved but get real if you had to chose between saving a human life and an animals you know which you would chose. As an anonymous person posted previously we have bigger problems in the world than worrying about a cat dying.

Ok volunteer and J31 my sister(Tabitha) walked over to your station and told you about the kitten and was told you had another call and couldnt do anything,then just a little while later you told my brothers and their friend that you would help as soon as you got back from that other call.That was on Sunday afternoon and your "tones" didnt go off because this request for help wasnt called in,it was told to you person to person and obviously you now have an excuse for not helping.Next time I need help I'll call instead of walking a block down the road.

The so-called police and so-called mayor of Proctorville OH are a disgrace inasmuch as they refused to help a kitten be rescued. If an individual will mistreat an animal how will they treat a human - not very well I can assure you -- Proctorville needs to recall the so-called mayor -- as for the police -- they are a joke - sitting along side of the streets hiding and issuing citations to mostly out-of-state drivers for infractions that are questionable -- and the city limits signs have been moved from the original city limits -- many times the crusiers are seen in the Chesapeake or even the Huntington area -

To everyone bashing this Police Officer and the Mayor: It is time to step up. If you are willing to contribute to the salary and benefits for a Police Officer to work towards preventing animal cruelty and neglect, please send your contribution to WSAZ and they can contact me at my email address. I will need enough salary to provide shelter/food/health insurance/a vehicle, & the like for my family; a car, fuel, insurance, for the job; equipment to safely rescue animals while keeping myself safe too. I will also need an appropriate shelter for the animals, food, and money for other staff and a vet. Do this without murmuring about the cost. Don't do like you did when Lawrence County tried to get a children services levy passed to obtain funds needed for foster care and vote against it - no don't do that. Cats/dogs are far more important. Yes, please put your money where your mouth is. I will quit my job today and prepare to serve in this capacity, because the money will be rolling in.

I know Mr. Vadan. He may not be the most charming police officer, but he is not a mean cruel man. He doesn't sit at the donut shop, there isn't one in Proctorville. He doesn't get free food, folks don't really give free food to cops (that's all Hollywood). Mike doesn't even make $10 hourly. Village Cops make about $8 hourly all over the county - yeah they make the big bucks to risk their lives each and every day. More cops are killed during traffic stops than any other cause. Cops do stop people with expired tags, if they didn't everyone would have expired tags, and if everyone had expired tags then the roads would fall apart or the roads would not be updated like they recently were and the new storm drains would not have been installed, then the cat would not have had drowned. I think WSAZ should show the entire footage, it may clear things up. Most importantly, cops do help us all of the time. The next time you need one thank him. Hopefully he won't be tied up on a cat call.

Well, while not much can be said in lieu of "Reno 911", I would personally like to comment on the other staff. There are two officers who appear to work very hard at responding to help, aiding other police departments (sheriff included), are polite, intelligible, and educated. Tony has been seen helping kids at the ball fields, in town keeping kids from getting into trouble, etc. Please don't bash the entire department, focus on the problems.

Just to comment. I live in Ohio and have seen many officers come and go. The latest genius we have seen in shades is a danger. Anyone almost hit him or his cruiser during his traffic stops? Get the car off the road Junior, for your protection and our families! Maybe there are resources for you to learn proper 'procedure'. Also, try to EARN respect by actually doing your job at fighting crimes and helping people, instead of getting charlie horses from sitting in your cruiser for your 8 hours shift.

Focus on the problem, a police officer who's never never learned courtesy at the vo-tech training program and a mayor with a wad of tobacco in his mouth and no class.

Let me make this clear I did not compare the killing of Leah to the kitten. What I did state was that neither police department was worth showing pride in. One can not solve a muder case and the other has no heart. Our police departments on both sides of the river are useless is the point I was makeing. I think this is all absurd. Cats die all the time and noone cares. Is it sad? Yes. Is it worth all this? NO WAY! There are major things going on in our country and the world...but what are people in the Huntington, WV area discussing? A cat!!! Let's talk about something important...like LOWERING gas prices, the war in Iraq, Iran, education, etc.

You know...I don't believe that the police WOULDN'T do anything. What I don't understand why, if everyone was so darn concerned, they didn't call the fire department. Aren't they the ones usually saving cats? Or the dog catcher? Why are the police and the mayor getting all flack?

The Fire Department was never called or asked to respond nor did the officials request the Fire Department to respond. The fire department is a VOLUNTEER department which means the members receive NO FUNDING its strictly VOLUNTEER. (Just to clear that up.) I guarantee if a call to the 911 center was received the Proctorville Fire Department would have responded without incident and rescued the poor kitten!!!! Sorry to the great citizens of Proctorville for the mishap.

In response to everyone who had questions of the local VOLUNTEER fire department, we were never notified, of this. Our tones did not go off so therefore we were not notified. Once again Proctorville Fire Department is a VOLUNTEER station. In the future if you have any emergencies contact 911 and they will dispatch the proper division of the E.M.S. for your emergency.

Hope this clears up a few things about the police officer you are putting down M ike is married to my daughter A few months ago we got a call from a family member who works in chesapeak someone had dropped a kitten in the parking lot where she works. she called mike and Amanda to see if someone could come get the kitten mike wasnt on duty and had no ones safty to think about anyway they went and got the cat when they got there this poor kitten was suffering form the heat. anyway they took the kitten home and still own and take very good care of boots she is part of their family..guess when you are working as a police officer you have to think of the safty of the people before the safty of a animal..dont be to quick to judge someone you dont know.He has a kind heart..p.s boots has been fixed so her kittens wont be put down drains if this kitten bothers everyone so much why not say something about the people who put it there..hey mike i liked the shades

I understand that there are more pressing problems to attend to but, would it hurt us as individuals to once in awhile do the the right thing? Have we grown so cold that we have no heart for anything? This truly is just a shame. If the Mayor or police wouldn't help why not a fireman or even someone from the city that may know or is familiar with the drains. I would like to Thank the lady and all who at least tried to do the right thing no matter how small it seemed to be.

Ok, how in the world could you compare a Marshall student that has died to a kitten stuck in a storm drain? Stupid people! The mayor I don't guess really didn't care for the animal, I hope he doesn't have any of his own. To Berry, I am so sorry. If I was there I wouldn't care what the police would have said, I would have been right there trying to help the cat. They can sit there talking to other police but can't take about 10 or 15 minutes out of there time to help it. Shame on them. Oh my gosh!!!

Hey DL if you had listened,the news told you that Tabby and 3 friends went againt police orders and lifted the drain to get the first kitten out,second what eqip would the police needed?Tabby and her friends just lifted the drain up its a shame it took 4 kids to do something 2 men could have if they wanted.Most of the interview was edited out,I was there and the so called mayor was cusing my sister calling her a liar and they should have shown that part so everyone could see exactly how mayor Stapelton really is.As for the second kitten you can hear it meowing but cant see it I guess its in another part of the drain not visible through the grate.Yes the 1st kitten was taken to Pville vet where it was put down to weak and close to death there was nothing that could be done.Maybe if someone would have helped on Sunday when Tabby 1st heard it it and its sibling would be alive and safe today.No one put the kittens in the drain they were small kittens big holes=falling in duh!

DL- wrong. They DO have the resources. Those drains are made in a way to have access to them. If a worker can open the grate to work on the drain then the only resource they needed was the desire and compassion to aid a living thing in distress. They did not. I don't care how many rallys Stapleton has held for what ever charity or need. He FAILED, he absolutely FAILED the human compassion test in this case. There is NO EXCUSE, none, nada, for allowing a creature to suffer like he did when a remedy was so easy to impliment.

for you simple minded front page reading morons,the fact is that the mayor and the policeman did lift up the grading and found no kitten. they told the young lady it was to dangerous to climb in. the kitten was not found in the drain but by a bush. wsaz news is aware of this info but did not report it so you simple minded morons would have something to rant and rave about.wsaz news should also be aware that somebody going by the alias hillbilly wv,threatened a police officer on their website! this is a crime! grow up find something real to take up your time...

I dont understand what makes wsaz think this is worth putting on the air. if the police had of tried to save the cat you people would still be here putting the police down. when something happens who is the first people you call the police right. and they always come right? if they had tried to save the cat you guys would still have something to say about that to. wsaz why dont you go find a real story. like tell something good the police has done there is a lot you could report on.. yes we pay them to serve. us the peopel not the cats. if you wanna save a cat the animal shelter is full of them all you guys go there and be heros. I will keep the police officers for mine. I see dead cats on the road all the time I will call wsaz everytime I see one. P.S I am not heartless I do care but i care more about people what if some person had got killed trying to save the cat?

Hey Debbie, most of the police sit around in their cars trying to look cool in their uniforms, talking to girls, pulling their cars side by side and talking to each other, watching for out of state license plates, strutting around town with their chest puffed out and sucking their stomachs in! It wouldn't have taken 5 minutes to rescue that kitten. If the officers made $10.00 an hour, then that would be around 16.6 cents a minute, which would only cost the tax payers 83 cents for 5 minutes worth of work! Give me a break! The authorities were a bunch of jerks on this one!

I would just like to make one comment and that would be to the people of Wv who are bashing the police in Ohio. I think I remember a Marshall student that was killed a couple months ago and the great cops of Huntington has yet to make an arrest. I do not think there is a city around that can be proud of their police right now.

My point is that you fools are railing about the life of a kitten or kittens when there are clinics in Charleston, Chillicothe and Lexington where an average of 50 babies a day are killed. Tabitha is my sister and I was there when she found the kitten,the fire dept.,police,sheriff,animal control,and the mayor were all contacted and did nothing.My family runs a small rescue and have taken several homeless animals in,took care of and later adopted them to good homes, so yes the kitten would have been taken home with Tabby and kept until found a home.We currently have 7 dogs and 5 cats that are in our rescue needing homes.We spend around $500/month to keep them and when a home is found they will be placed there for free if all qualifications are met.Yet after we take all this money every month to take care of unwanted animals and pay taxes nobody could spare 5 min. to save this poor kitten?What do our taxes get used for in P-ville anyway?The police seem like part time workers and there is never any road/town improvement there.If it had been a child in that drain I wonder would things have moved faster to save it?Doubtful

To all the people saying that the kitten would probably have just been put down at the shelter anyway - adoption rates for kittens are actually fairly high. There's a great chance that this animal could have gone on to live a healthy, happy live with a loving family, if the police hadn't been so irresponsible, cruel, stupid and lazy.

I saw this on the news and was totally shocked at the police officers attitude. you could tell he didn't care. I would have moved heaven and earth to save the little kitten and YES I would have brought it home and taken care of it. I have 4 now, 2 that someone dropped and yep I took them in had them fixed and they are living a life of luxury which all pets should. they all have feelings. Poor little baby left to die in a drain. SHAME ON PROCTORVILLE!!!

My sister works at Proctorville Animal clinic and I am sure if the police or Mayor would have called them the vet there would have come down and rescued it. He was the one who helped with the rescue of the horse wondering along rt 7. I cannot believe that the citizens of Proctorville would allow an insensitive police officer to have a job when sensitivity is a main quality. He looked like the biggest jerk that I have ever seen. What idiot stands on TV and says there was nothing I could do but let it die? Is that what he is going to say when he sees an innocent child being abused or hit by a car? Stand up and demand that they both resign!

Comment on the kitten stuck in storm drain in Proctorville Ohio. That police officer was an insensitive PIG! People need to respect all forms of life. That includes kittens. If he was stuck in a storm drain would he like to hear people say there wasn't enough money in the budget to pull him out and save his life. How difficult would it have been for someone to direct traffic around the drain so someone could open it and save the kitten? I hope God is a Giant Cat.

Some people have no heart or concern for animals. Tabitha it was a noble thing of you to try to get this little kitten some help to keep it from drowning. I'm so sorry that the adults and officers in your town are so callus and uncaring towards life. Bless your heart. Seriously, PPD, how could it have hurt to go and help lift a drain to get the kitten out. How pathetic are those officials. Maybe someone soon those people will have to suffer in some form or another, like the kitten suffered when drowning. We could only hope so.

Not here, in WV.....Nothing here, in WV.......No state, county, and city agencies will cooperate and work together to bring this state into the 21st century. If you like to fish, hunt, grow a garden, and shop at Dollar General, then this is the place for you.......

that is a call that is usually given to the fire department, so if they say they didnt have the resources that is false. they probaly couldnt get any volunteers to respond. if they had a paid department maybe they would have resolved this because i know for a fact that similar incidents have happened in charleston and huntington and the animals have been rescued.

Why couldn't the Mayor pulled some money out of the donut fund? I'm sure the good people of Proctorville would have taken up a collection and reimbursed the $4.00 it would have taken to get that kitten out. Politicians, they have all become a bunch of idiots! Is this what our young people have to look up to? Way to go Mayor! This could have been something positive for the whole community whether you're a cat lover or not, just the fact that you could have showed a little compasssion and didn't!

I am ashamed to say that my address is Proctorville, OH. I find it hard to believe that 2 men who are in positions to "serve the community" are absolutely in the wrong professions. I think you should both reconsider & do all of us a favor by finding other lines of work. Their comments/non-action speaks volumes as to their character-what a pity !! To officer Mike Vaden, do you honestly believe the reason you didn't help is because of lack of resources? No way, it would have taken just a few minutes to save this kitten's life. As residents of P'Ville we see you every day just sitting in your police car-waiting for some poor soul to go 1 mile over the speed limit.When the bank was robbed a few years ago, the police cldn't even catch the criminals. In the time it took the police and mayor to do their interviews they could have helped pull the cat out or made sure the rescuers were safe in the process of doing a good deed. Aren't there laws on animal abuse and neglect? I think so. If not abuse, this was neglect. How much do the people of Proctorville pay you guys to sit on your butts waiting for an emergency that fits into the budget? And just how much would it cost to help the dying kittens anyway? You guys would rather a good citizen try do do it with a piece of dental floss! Pathetic!!!! I knew dogs didn't like cats, but we can now add politicians and pigs to the list too.

HOW PATHETIC IS THAT!!!!MY HATS OFF TO THE PEOPLE WHO DID THEIR BEST TO RESCUE AND TRY TO SAVE THE KITTEN, I WOULD HAVE WENT AHEAD AND DONE THE SAME THING.I CANT BELIEVE THAT OFFICER VADEN SAID "NO REVENUE" FOR THAT-HOW STUPID-- I HOPE I AM NOT LAYING ON THE STREET DYING WHILE HE IS ON DUTY...GO GET THAT 2ND CAT GIRLS!!!!!!!

Thank God I am in the jurisdiction of the Ohio State Highway Patrol. The Proctorville Dept. doesn't even answer their phones. They could have rescued the kitten but that would have meant interrupting their afternoon naps in their cruisers.

the same exact thing happened last weekend in Cross Lanes, WV. This is absolutely uncalled for. It would've taken maybe 15 minutes to lift a drain and go grab the kitten. Of course there is no funding for innocent kitties because we are to busy pointlessly driving around all day at $4 a gallon harrassing people for mineal reasons. Congratulations to all those who went above and beyond to protect and serve. Now there is one less life on Earth.

In a world where we hear about death everyday this could have been a heartwarming piece. Instead, due to the insensitivity of Proctorville's mayor and police force, it became another story about death. Officer Vaden and Mayor Stapleton could have offered assistance to the kids to help rescue the kittens. Citing resources is not an excuse for not offering some kind of help. I think that Mayor Stapleton and the police force should work together to implement a system to help rescue injured or trapped animals. There is no excuse for leaving a kitten in a drain to die. It's a shame on Mayor Stapleton and Officer Vaden. Also, wearing sunglasses during an interview is just as bad as chewing bubblegum during an interview.

What is wrong with these people? Have a heart and help out! I'm sick of hearing bad news all the time...this would have been an easy, simple way to possibly have some good news. If this police department and/or town can't go a bit 'out of the way' for something like this, well I don't think I can go out of the way to be in this town for even a visit. This makes me sick to my stomach. P.S. You may want to start a fund to help out in situations like this.

I think that the officer in the interview is a poor excuse for an officer. So what if there is no money, do it because you are a human being with a heart. Proctorville Police Department already has a poor image and you just made it worse. You are a very sorry human being and I hope you do not have any pets of your own. I would like to say one thing to the young lady in the story. You have a big heart and your parents should be proud of you. SHAME ON THE MAYOR AND THE OFFICER...

the police and mayor should have helped this young lady rescue the kitten,i think it's bad that the police and mayor would'nt rescue this kitten and just let it stay in the drain to die.thank you tabitha berry for your good work,you are a wonderful person for trying your best to save this little kitten.but for the proctorville police and mayor they are no excuse for you not trying to help,vaden said the kids could get hit,well you are a police couldn't you park your police car in front of the drain and turn your lights on long enough for the kids to rescue the kitten?think about it.glad i don't live in p'ville.

I heard about this through an internet community and I just wanted to say -- animals are like family to us, they are living, breathing creatures that deserve a chance, and if somebody is willing to take a chance to rescue them, they should not be disallowed from this. I think the attitude of that police officer was uncalled for, and the overall reaction to the life of a living creature was very callous. Next time something like this happens, consider showing a little compassion -- that looks much better in the news than this.

The way one treats their domesticated animals is a reflection on their humanity. I hope everyone pays close attention to the sympathy and empathy of their public officials, those they elect are also a reflection of the community. Bless the people who worked to save that kitten, even against the police's wishes, there were ways to Easily make this a safe rescue, but I can't blame the police for listening to orders.
