JEFFERSON, W.Va. (WSAZ) -- West Virginia State Police say a man was arrested Thursday evening for a 12th time, accused of drunk driving.

Thomas Lewis was charged with a felony third offense driving under the influence.

State Troopers say they pulled Lewis over on Route 60 in Jefferson because he was driving with a fake inspection sticker on his car. That's when Troopers say Lewis admitted to drinking six alcoholic beverages. They say Lewis refused a breathalyzer test.

Lewis is being held at the South Central Regional Jail.

I am pretty sure this guy was at the Foodland on Spring STreet today. Look just like him. Never did see anybody with him, wondering if they were waiting in the car for him. Doubtful

Ok, it doesn't matter if they "take away his license".....he obviously doesn't have any regard for the law so whether he had that little card in is pocket or not, he is still going to drive drunk! period! as long as he is not in jail.... he will do it again, no question about it. our legal system is what needs to keep him off the streets by keeping him in jail! there is no other solution and no other argument needed.... period!

wow! maybe if they keep slapping him on the hands he will kill someone. The sad thing is it won't make any difference if they revoke his license. He will get behind a wheel anyway. It's not a matter of IF he kills an innocent person or persons ..it's when.

Thank Goodness and lets hope the Justice system works this time The Cat gets away 9 times and this one has had 12. I think we should all count our lucky stars that the law enforcemt officers have taken him off the street.Now lets see if the Prosecutor and Judge do theirs-Or could it be that Thomas was a paid Yes i said Paid Confidential Informant. Jessica, if he kills somebody in Kentucky while driving under the influence, he would still just get a slap on the wrist. We found this out recently in Pike Co. This man wasn't pulled over due to race. He was pulled over because he was driving drunk. He made his own life choices, and he needs to pay the price for his actions. It is a disgrace though that he is allowed to do this over and over and not face a penalty. He has been given way too many chances to make ammends.

OK...I've read most of the comments and I feel that everyone is missing something. Please click on the attached PDF arrest record and read it. This man has constantly had various charges (including the DUIs) dismissed which is indicative of attorneys working the court system. WV needs to addopt Habitual Misdemeanant laws where defendants are imprisoned after the third and subsequent conviction of ANY charge of assault/battery. DUI laws need to be worded in State Code to reflect that any Prima Facia evidence (i.e. was driving, did blow .xxx, or refused) presented SHALL be cause for conviction, DUI charges cannot be reduced and must either be tried or plead to in court. In most states legislators are attorneys, as are judges, and (obviously) prosecutors and defense lawyers. These people are ALL members of ONE association...the State Bar. Pressure from other groups, like MADD, must be placed on the lawmakers to remove loopholes and require offenders to be properly punished. Stay safe.

Thanks for explaining why he is only officially chg'd with "third offense" I know it's not the fault of the police, if they had their way, they would keep these people in jail or in rehab somewhere but once again, like with all crimes, it's the "laws" and "judicial system" that lets them back out on the streets as fast as police can arrest them I appreciate the police doing their jobs with these drunk drivers AND with all the other criminals out there all over. I truly believe the HPD AND all the local police are doing all they can Just wish our legislators would get off their backsides & change the laws I agree with people who say this guy needs HELP BUT someone hasn't given it to him, he's still drinking AND driving Thanks again cop for answering my question about the chgs If you truly are a cop & that's not just a made-up user name...you stay safe and THANK YOU for what you do. the reason that he was charged with 3rd offense was because that is all that the law allows for, you can be charged with DUI 1st, DUI 2nd or DUI "third offense or greater" which is a one to three year felony. It doesnt matter if you have a thousand priors or just two, officers can only charge you with third offense or greater.

This show's the frontline of the officers doing their duty well, they have caught him 12 time's. The failure is in application of proper sentencing. I do understand that some times a judges hand are tied by min/max sentencing. We as citizen should be protesting for a change in the law....if a person is convicted of a D.U.I.more than twice it should be automatic prison sentence for a minium of 3 years and leaving the max open to the judges discretion. Take the blinders off and help take the binders off the law!!

You misunderstand me Jerome, I am saying it has nothing to do with race. You said he wouldn't have even been pulled over if he wasn't black. I say he got pulled over because someone ran his plates and saw 11 DUIs. I was saying that if race were an issue he would have been treated unfairly during one of his priors and would have probably gotten heavier sentences. I'm sorry if I wasn't clear, however, basic reading comprehension is required to understand the printed word.

This is sad. Who cares what color he is? Does it even matter? People wouldn't even be playing the race card had there been no picture with the story. Twelve times he has done this. What will it take to get him off the streets... Killing some child that is playing on the sidewalk? Or perhaps, some family on their way home from church. Sad that they let it go this long =/

I don't know anyone of any race that can get 3 Duis and still drive. Hey it's not just WVA, KY's just as bad. It's an everyday thing, someone is hurt or killed by some sorry SOB and it's never their first offense, there's always a history of previous DUI's. The only way to stop or even slow this down is to hold the judge who released these people the last time responsible; as in, accomplice to homocide, negligant, endangering the welfare of, crimminal and civil charges brought against, etc. These judges need to be held responsible for the crimminals they turn loose on us, if they haven't gotten the message by the third "supposedly three strikes you're out" offense they're just a death waiting to happen and we all take chances on that death being either us or one of our loved ones.

When you get a drivers license, you agree to submit to a breathalyzer test if requested by any law enforcement officer. Having a drivers license is a privilege and not a right. If you know how a breathalyzer works, you would know that it can not be rigged to prove someone guilty of DUI. It is a chemical test. There is a known pure sample and that is compared to the subjects sample. The officers does a standard test, then tests the subject, and then does the standard test again to prove that the machine is accurate.

Okay, 1 person said he is a great family man and let he who is without sin cast the first stone! As long as it's not your family in the other car when the accident happens I guess that is okay isn't it? "Cast the first stone", I get so tired of that phrase. And another thing, if a clerk in a store sales alcohol to someone that's been drinking....and sometimes it's hard to tell who's been drinking, they can be charged if the person who made the purchase goes out and wrecks and injures or kills someone. My question is....if this guy eventually drives while intoxicated and badly injures or kills someone do all the Judges that have put him back behind the wheel also become negligent? I think we know that answer.

no, it's NOT a race thing period to me. i don't care if he (or other offenders) are white, black, brown, yellow, pink, purple or polka-dotted! if they drink & CONTINUE to drive while drinking, they need OFF the road and put somewhere to dry out and get HELP! do any of you want someone (regardless of what race they are) out there driving on the same roads/highways YOU and YOUR family are driving on or walking along? I sure don't! Driving/walking/cycling is dangerous enough anymore without REPEAT offenders out there making it even more so Race didn't enter my mind when I read this & expressed outrage! If they hadn't had a photo of the man I'd STILL be yelling b/c he's continuing to drive while DRUNK people! He could kill you, your family, friends just as well as mine and then would you care what "color" he is? wouldn't make an iota of difference then would it? if so, then YOU have a problem if you try to make this about race it's about a drunk who is dangerous!

You say this guy is an outstanding citizen, yet 12 times he was caught drunk driving. He gets into a car drunk, possibly hit and kill one of these people he's helping. Was he drunk when he drove to the food pantry? Is this why he's gotten away with it 12 times, because he gave a few hams?

Any person who chooses to drink and drive (having been arrested 12 times for DUI)has a complete disregard for human life and lack of self control, while under the influence. If you know and care about this man, please help him help himself, and you may not only save his life but also countless others who could be lost due to his recklessness.

Get a clue people. This isn't about race. If you watched the news, he was pulled over by an African American. Everyone is not out to get you! I don't care if the man was black, yellow, white, or green. It should've never gotten this far. As for an outstanding citizen, is that why he has a rap sheet? Guess you didn't see or hear the news mention that as well. DUI is not the only thing this man has been brought in for. Of course I'm probably wasting my breach. It's ALWAYS about race with some.

I had an aunt and her grandson killed by a third offense DUI offender whom many considered an outstanding citizen..(a white man)....If this was a rigged system against minorities, don't you think he would have been incarcerated many years ago???

I know him and he is a good person, has a good heart. However, he let alcohol cloud his judgement. He is lucky he didn't hurt someone or himself. He needs help and I hope AA or some type of counseling is a requirement for him in jail. Don't let alcoholism ruin your life folks! When someone suggests you get help, please seriously consider it. No one can make a grown person go through with it, but when you break the law, you lose the right to chose.

The outrage has nothing to do with race. Drunk drivers kill thousands of people each year. It is against the law to drive drunk. Guess what... I am white. When I was younger, I was pulled over because I was driving 70 in a 55 on a deserted highway in New York. I got a ticket because it was against the law. Who was I going to hurt? A cow? But, it was still against the law to driver faster than 55, which I was obviously doing. I paid the fine. I also volunteered my time and donated lots of good things to the homeless. Should that have meant that I should not have paid the penalty for my wrongdoing? NO!! Just because a person does good things does not mean they should get away with breaking the law. I bet your feelings would change if he were to kill a member in your family from driving drunk. You do the crime, you should do the time. Now, if our judges would just enforce it, that would be even better.

Do you ever read or watch the news??? Do you know how many WHITE people have been charged with DUI. I can think of two in the last few months who have killed people. This is absolutely NOT about the colour of this man's skin. Drunk drivers come in all colours and various walks of life.

Obviously this has more to do with race and less to do with character. If this were a white man we would not even be talking about this since Tom would not have been pulled over. You folks need to try to imagine what life is like for Tom, the man is as gentle as a teddy bear. The reason Tom refused to take the breathalyzer has everything to do with the fact the judicial system is a sham for most minorities. Why should he prop up a rigged system?

This is really a shame. How can someone get 12 DUI's? It is a wonder he hasnt killed someone yet. Why is he allowed to drive? I know he doesnt have a license, and you can't watch him 24/7 but obviously he didnt get in much trouble all those times, or he wouldnt be out driving, especially 12 times.

Why is everyone so surprised? Isn't it commom knowledge that the authorities & the court system does not see crimes like these as a 'high priority'. The lawmakers are certainly not concerned about strengthening the laws unless it's financially beneficial to them.

Granted this guy should be locked up. He probably doesn't have a license with his record, but that really doesn't stop anyone from driving if they want to. Some family member or friend is allowing him to drive. I am sure many people drive without a license or insurance every day. If they don't commit a moving violation, speed, have an accident, or drive drunk, who would know?

Shame on all of the judges that this guy has been in front of in the past. Can they not clearly see that this guy should be locked up for good??? Don't give this man another chance to kill someone or perhaps a whole family. Don't just stick him in jail forever either. We don't need to pay for him to be in jail. He should have to work a hard laborous job to pay for his stay in jail. All criminals should. You do the crime, you work off your stay. Eventually crime would slow, and the people would have more monies for other things besides paying for a prisioner to live the life of rally in jail with no worries. Make him work.

Ok, enough already. Justice is not being done. They've taken this guys license and he still drives with fictious tags. I've got a better plan than slapping him on the wrist and making him stay a few days in jail. Cut off his hands, then he couldn't drink or drive, or gouge out his eyes, then he couldn't see to drive while drunk. People do not take drunk driving seriously, and they should. Too many innocent children and adults die, because someone decided to drink and drive. This guy has had ample opportunity to stop this irradic behavior and chooses not to stop. Persacute him I say. Don't you all agree! Stop him before he kills you.

We know he won't be sent away, we know he'll be back out on the streets, we know the judge isn't going to do anything or he would have done it after the first or second or third or fourth or fifth or sixth or seventh or eighth or nineth or tenth or eleventh time! So we might as well throw him a party and turn him loose and let him try for thirteen! If found guilty this gentleman should spend the rest of his life in prison. He cannot be trusted out in the community. Obviously he hasn't learned to stay off the roads when drinking so prison for life should be the only option the courts have. If not, its only a matter of time before he kills someone.

The truth is, that people live better in jail than the ones that go out and work for what they have.They don't have bills in jail they don't pay for food in jail they don't have to worry about the dang high gas prices in jail.. He was obviously driving without a license. If he has keys to a car he is going to drive. The only way to keep him from driving is keeping him in jail. As long as he has access to a vehicle he will keep on driving. The police can't be everywhere.

I'm with Ashley, you've GOT to be kidding us! TWELVE times? Sadly though, we know you're NOT kidding because that's the sad, deplorable "justice system" we have! And he probably WILL be back on the streets AGAIN to kill someone or maim them! Once again, I remind you guys about that idiot judge in Charleston who let 2 child molestors go on "parole" recently WHILE at the same time, he sentenced a girl to FORTY YEARS for stealing two purses and SHE didn't hurt ANYONE! So much for "justice"! I'm apalled that this guy was back out driving and endangering lives period, much less TWELVE times! This state (and country) needs laws CHANGED and CHANGED NOW. How can all of us get that process started? Our Gov and so-called "lawmakers" need to get off their backsides & rather than wasting their sessions, DO SOMETHING to change these laws AND get more $$$$$ for jails Personally I don't care if they're overcrowded or not, put 'em in there & KEEP them in there!

I've found out that a new "blow and go" or Interlock law has gone into effect this year. It should stop people from being able to drive if they've been drinking. It should also help prevent people from driving while they're suspended, because the Interlock will be in their car, instead of their license being suspended, at least people who can get the Interlock put in their cars. My fingers are crossed. I've lost family members because of a drunk driver.

It's his 12th DUI and he's charged with 3rd offense DUI? Is there not a 12th offense DUI charge or what? Also how did they see a fake inspection sticker while he was driving down the road? I'm glad they pulled him over, but I doubt a fake inspection sticker was the reason, I'd bet a cop recognized him, after 12 arrest you're bound to start looking familiar. This time they need to keep him locked up, that's ridiculous.
