CHARLESTON, W.Va. (AP) - Two men's hunt for a big buck ended with them facing charges of illegally killing a deer and leaving its decapitated body in a field.

The state Division of Natural Resources says Heath Foster and Terry Pumphery were charged following an investigation prompted by reports of gunfire near a Rock Cave residence.

DNR Conservation Capt. Mike Pizzino says the two 32-year-old men face multiple charges stemming from the animal's slaying.

Pizzino says the investigation shows the large buck had been spotlighted and then shot. Investigators later recovered the animal's head.

The shooting occurred earlier this month. West Virginia's guns hunting season for bucks doesn't start until Nov. 24.

To Posted by:laney,I disagree with you about most people are speeding or not watching when they hit a deer. Deer leap very fast, when frightened anywhere, even on and in front of cars and trucks un-expected! It is their nature when they hear certain sounds!

Posted by: realman on Aug 22, 2008 at 09:26 PM
Don't be cruel: Why so many question marks? By the way, get in the kitchen and get them pots a rattling. Its supper time and I'm hungry. I hate your hair and don't use so much salt this time. Get me a beer before you get started and put that little short dress on you used to wear if it still fits you.

Posted by: teddy boy on Aug 22, 2008 at 05:56 PM
How terrible. I love to watch the deer prance and frollick around from my deck. And to Spank, you said you wouldn't be seeing Hank anymore. I hope he is talking about several months back. Otherwise it's over. May the deer rest in pieces...

Posted by: cin on Aug 22, 2008 at 02:17 PM
wonder if somehow deer meat can be used as a biofuel????

Posted by: Ty on Aug 22, 2008 at 11:12 AM
Yeah! Bush! His fault! The only one allowed to shoot someone illegally and get away with in GW's administration is Cheney!

Posted by: Eli on Aug 22, 2008 at 09:38 AM
This just got moved up to a hate crime. It turns out the deer was gay.

As far as I know Charleston had two off duty Policeman caught spot lighting and nothing happened to them

Posted by: Joe on Aug 22, 2008 at 12:26 AM
Its George Bush and all the greedy Republicans faults. Them boys probably wanted to go hunting while the gas prices are down. We democrats know that George Bush pushes a button and sets the gas prices....

Posted by: Don't be cruel! on Aug 21, 2008 at 10:45 PM
Most of the postings that I've read here today are so cruel! Yes, someone obviously didn't read carefully, or maybe just didn't understand the whole "decapitated" story, but I thought this blog was for comments relating to the story--NOT to critisize people making comments! P.S. Wonder how many of you will pick me apart?????

Posted by: jim on Aug 21, 2008 at 09:45 PM
Very good post. Thats what it is all about. Hope you get a big un!

Posted by: concerned on Aug 21, 2008 at 07:37 PM
Spotlighting is the main issue here, it is not even sportsman to hunt like this, even if u want to kill them out of season to eat or whatever, do it the right way... Lights pretty much make them unable to move or run. What is the fun in that. Just wanted the trophy horns, jokes on them!

Posted by: Anonymous on Aug 21, 2008 at 06:41 PM
When did I say I lived there? Once again you're proving your stupidity!! Learn how to read!!!

Posted by: reader on Aug 21, 2008 at 05:36 PM
Are you serious...did you read the story? Duh

Posted by: Anonymous on Aug 21, 2008 at 05:18 PM
those men didnt kill it for food they killed it for its horns and another thing people that killed the deer are poor sports men cause they cant get a rack like that during hunting season

Posted by: Jay on Aug 21, 2008 at 05:09 PM
The DNR is worthless. They do not do anything. Try getting one to answer a call

Posted by: RoaneCo. on Aug 21, 2008 at 04:51 PM
Well Amy on Aug 20, 2008 at 04:42 PM I guess I am ignorant also because I think the state should be responsible for damages. If they can charge people to hunt, tell them how many they can kill and where and when they can kill them then the state must be the owners of the deer. If they own them, then they should be responsible for any damage they cause. Like I have said before, let one of my old cows get out into the road and someone hit her and see who is held responsible.

Posted by: MELISSA on Aug 21, 2008 at 02:42 PM
To: are you serious on Aug 21, 2008 at 09:54 AM WILL YOU PLEASE GO BACK TO SCHOOL AND READ.. THEY FOUND THE DECAPITATED BODIES...THE PEOPLE ONLY TOOK THE HEADS (PROB FOR TROPHIES)!!!! THEY LEFT ALL THE GOOD MEAT OT ROT AWAY TO NOTHING

Posted by: billibob on Aug 21, 2008 at 01:54 PM
kill all them deer nothing but pests neded to put a bounty on them the state ought to pay for all the damage the deer do eat your shrubs n flowers they eat all my garden if i kill one out of season the state dnr makes ya pay them to replace their deer so the dnr needs to pay me for my garden i have hit several with my truck big dollars to get it fixed

Posted by: Anonymous on Aug 21, 2008 at 01:32 PM
To are you serious if you would read they left the body in the field! It was not used for food. It is so wrong what they done, and yes I have hit 2 deer and totaled my car but I still feel that doesn't give anyone the right to just kill them when they want.

Posted by: Possum Ted on Aug 21, 2008 at 01:15 PM
I hope this deer's family sues the pants of these two. It will serve them right.

Posted by: are YOU serious??? on Aug 21, 2008 at 12:49 PM
to "are you serious" on aug 21,@9:54am, Did you even read the article before posting your oh so wise response? I guess not considering you obviously don't have a clue to what was actually left behind. I suggest reading "hundley"on aug 20,@1:06pm and oh yeah the actual artical too.

Posted by: paul on Aug 21, 2008 at 12:44 PM
TO are you serious! They only took the head and not the meat.. If someone kills a deer because they need food I am fine with that, I am a hunter who loves to eat deer meat and get enough during season to do me, but I know people that kill deer out of season because they need and like the meat and I see no problem with that. To spotlight one just for the head is wrong whats the sport in that NONE. There is a lot more to a hunter than driving around with a light. A true hunter loves the outdoors and respects the game he is after and sometimes just being in the woods is as good as killing something a nice big o buck is a bonus. Most hunt with family and freinds and just have fun being together and I am just as happy for my freind that gets a deer as I would be for myself its not always about killing something. Have fun and enjoy hunting

Posted by: cm on Aug 21, 2008 at 12:03 PM
this is to are you serious, they left it's "decapitated body in a field". did you not read the story? just how much meat is on the head? not much. idiot. read the story before you leave a comment.

Posted by: Kathy S on Aug 21, 2008 at 11:53 AM
You obviously can't read or you didn't read very closely. They didn't LEAVE the head (there was only ONE deer too, there were TWO "men") dummy. They left the DECAPITATED BODY behind! Do you know what DECAPITATED means friend? THAT means the body WITHOUT the head! They found the HEAD later which I suppose didn't have fine enough antlers on it to be worthy of hanging on their blasted walls in their "dens"! They spotlighted the poor thing which REALLY makes them "men"; They cut it's head off obviously for a trophy unless they like you obviously EAT the HEADS! They LEFT it's BODY without it's HEAD in the field! So they were "hungry" huh "serious"???? You better go back to school & learn to READ because YOU got all the facts wrong from this story! Yes, YOU probably "would do the same". Yeah, let them "kell" them year round and feed the "hungry people" as you say. Only dont you think the body would feed more than a head? DUMMY!

Posted by: are you serious on Aug 21, 2008 at 09:54 AM
who cares that they killed 2 deers, they obviously killed them for food or else they would not have left the heads. if i were hungry or my kids i would do the same. and yes they need hunting year round, i say kell them all and give them to the hungry people. god come on

Posted by: Anonymous on Aug 21, 2008 at 09:37 AM
To Anonymous, I am not the reason people so called believe inbreds still exist in West Virginia, everyone knows they still do. You tell me, your'e the one that lives there, not me.

Posted by: billy on Aug 21, 2008 at 09:08 AM
the deer are so bad you cant even raise a garden kill them all

Posted by: laney on Aug 21, 2008 at 08:54 AM
to anonymous, sounds like you should have been in school learning something , I hope you don't look as ignorant as you sound, and for you to be in the woods with a gun is scarrrrrrrry! People that hit deer with a car usually are speeding and are not watching the road and where they are and the fact that deer are traveling certain time of the year and you have to be aware and careful. These scum bags need to be put on display with the antlers stuck on their heads and a sign around their neck telling the world what they done. Wonder what else they have done illegally ??? Put them in jail and make them pay!! To Borehunter I bet you are a bore. and stupid with it..:)

Posted by: Anonymous on Aug 21, 2008 at 12:14 AM
we should be allowed to hunt and kill deer year round. this is the usa. people are tired of hitting them with their car. i hit one once when i was driving naked down rt. 60 back in my younger daies.

Posted by: paul on Aug 20, 2008 at 10:45 PM
To Joseph you are no better than Kay with your remarks Whats being Democrat got to do with anything?? Talk about a radical opinion. The only thing you said right is what these 2 done is illegal and need punished!!!

Posted by: Anonymous on Aug 20, 2008 at 10:24 PM
Kay, you are the reason people believe inbreds still exist in West Virginia

Posted by: jim on Aug 20, 2008 at 09:05 PM
Kay, they cut the antlers off and use them for rattling. This is a way to call in bucks when you are hunting.

Posted by: Joseph on Aug 20, 2008 at 09:05 PM
Kay, people like you with your ignorant radical opinions are the dangerous ones. I bet you are a democrat too. It boils down yo the fact that these men did something illegal, they were caught, and now they will be punished. I enjoy hunting (legally) and NEVER waste any meat. I usually have people contact me before season and request some meat if i have any. I agree with "mad" true hunting for a big buck is a challege.

Posted by: anonymous on Aug 20, 2008 at 08:50 PM
To;Posted by;Kay on Aug.20,2008 at 02:46 PM. Why put Hunters down and say watch some of these folks! I grew up around Hunter's thet NEVER beat their wive's or girlfriend's,some of the Hunter's went to church and some even drank beer! I read all the time about DRUG DEALERS and USERS (men and women) and just EVIL HUMANS in ALL WALKS of LIFE and OCCUPATIONS,that who MURDERS,INNOCENT ADULTS and CHILDREN.(Most ARE NOT HUNTER'S!) WE ALL ARE DESCRIBED in the HUMAN HEART for out of the HEART is ISSUES of LIFE!

Posted by: Spank on Aug 20, 2008 at 08:15 PM
Hank & I sometimes will entice the little deer to come and eat out of our hand. Hank, do you remember that time when you...oh, I shouldn't tell that one; might get us arrested.

Posted by: Tired of them on Aug 20, 2008 at 08:01 PM
Oh well, one more deer that won't ruin a vehicle, tear up a fence, eat a garden or eat the livestock feed. Need to get rid of more of them!

Posted by: BRANDON on Aug 20, 2008 at 07:57 PM
KAY.....You are such an idiot....

Posted by: wildboar on Aug 20, 2008 at 06:13 PM
deer as pretty as some think thay are.. thay can be a pest thay eat your garen flowers trees ...and just think what thay do to your car or truck when thay runout in front of you...the deer is over pop. around here they are inbreeding to the point that its hurting the pop.so these 2 men did us all a favor...thank you, those of you that like looking at deer buy a pic. it safter for all of us and kill and eat the deer!!!!!

Posted by: Amy on Aug 20, 2008 at 04:42 PM
To: Anonymous on Aug 20, 2008 at 09:55 AM why should the STATE be responsible for the $ damages????? Deer are animals! They live in the wild. That's like saying hold the STATE responsible for a raccoon that gets in the garbage--how ignorant.

Posted by: Hank on Aug 20, 2008 at 03:37 PM
I hope these mean men go to jail! Me and my partner love watching deer while having a glass of wine on our porch.

Posted by: Kay on Aug 20, 2008 at 02:46 PM
If you enjoy the meat and eat it, I can see hunting when it is hunting season. I have seen people remove a rack from a Deer that has been hit on the highways. That's nasty just to leave the carcas there because you want the head on your wall, that's the last thing I want on my wall. If these creatures were not meant to be here, god would not have put them here.Yes, these guys should be in trouble. You gotta watch some of these folks, they start with a Deer, then a dog and next wife, girlfriend. Been known to happen alot, you know I'm right.

Posted by: mad on Aug 20, 2008 at 02:37 PM
Anonymous, I don't want to offend you but consider this. As a hunter for over 30 years I understand what true slimballs these guy are. Many a man and a woman wait, plan and hunt for years to get a shot at a big buck the legal way. Any drunk fool can get a big buck with a spotlight. Yes, the population of deer is great however the DNR gives ample opportunity to cut down on the deer herd with antlerless seasons and extra buck stamps and so on. I encourage you to make a change in your life, take a hunters safety course and persue a trophy buck. It is quite a challenge. I have never killed a true trophy buck (150 class or better) but I sure try hard. It all must be right. Weather, place, time, wind, scent, time of year and on and on. Lots of time, energy and money. I love it. If someones family was hungry, me or any other hunter would kill them a deer cut it up and bring it to them anytime of year. Most DNR agents would not say much about this if done discreetly. What these guys did is bad.

Laura, Read the story again. The names were given

Posted by: bill on Aug 20, 2008 at 01:50 PM
I have called our dnr officers in lawrence county ohio and get no response. From what I understand there is only one game warden in the county and there is alot of illegal activity. poaching, hunting on private property without landowner permission is a common occurance. the 800 helpline is useless.

Posted by: hundley on Aug 20, 2008 at 01:06 PM
I'm quite sure that food wasnt the driving force that compelled these two geneses. Since what was left behind was the decapitated body. It was probably nothing more then an illfated attempt to boost an obvious lack in their manhood for bragging purposes. Since the head, the considered trophy of the aniaml was the only thing taken. I mean really what kind of skill does it really take to spotlight and blind an animal that doesnt even see the danger or should I say the idiots coming. Talk about taking all the skill and hunt out of it. Great job DNR here's to punishing and making crminals pay.

Posted by: Laura on Aug 20, 2008 at 12:24 PM
Why hold the names back! Embarrass their behinds and list those in here! C'mon DNR no need to not release names if they are 32 years old!

Posted by: Tim on Aug 20, 2008 at 12:21 PM
WHY SHOOT AND HIDE SUCH A TROPHY. WHY NOT BE LEGAL SO YOU CAN TELL OTHERS OF THE HUNT. AS A HUNTER THIS MAKES ME SICK THAT A BUCK POSSIBLY 4-5 YEARS OLD CAN BE TAKEN THIS WAY. ANOTHER FOR THE WALL OF SHAME !!!! GREAT JOB DNR KEEP UP THE FANTASTIC JOB. THANKS TO THE PERSONS INVOLVED IN REPORTING THIS CRIME.

Posted by: Melissa on Aug 20, 2008 at 12:17 PM
Among all other charges they should also be cherged with animal cruelty...Decapitate a deer..how awful !!! If you are a true hunter you kill for the meat then you have the right to show off the head but kill for the food not pleasure, if you don't like the meat just the sport atleast have the meat cut profesionally (?) and donate the meat to a food bank !!

Posted by: Anonymous on Aug 20, 2008 at 11:51 AM
Charging someone for killing a deer out of season? Sounds really ridiculous considering how HUGE the population has gotten. I say kill them all...they are hazards to drivers.

Posted by: Deer Hunter on Aug 20, 2008 at 11:46 AM
Thats true "hunter"...But i guess they didnt need the food cuz they left the body behind. We need to crack down on this because to many people have "buck fever" and in turn they shoot everything in sight in season or not. I passed twice this past season on 2 bucks because my theory along with true hunters is let them go and get bigger and manage the herd in that area by taking the mature bucks out,and we need to try to take as many doe out as possible this season. Even if you dont want a doe, take it to the many "feed the hungry" stations and donate it! I always get at least 1 extra doe stamp for that purpose.

Posted by: Lisa on Aug 20, 2008 at 10:50 AM
Great Job DNR! I am so happy to hear you stopped an illegal hunt. I see nothing wrong with legal hunting but illegal hunting is another matter. So Great Job DNR.

Posted by: Rebecca on Aug 20, 2008 at 10:37 AM
Great job DNR- keep them legal so we can get better herds.

Posted by: sherry on Aug 20, 2008 at 10:30 AM
I'm hungry now and that deer would have feed some of us hungry Ohio people, why would u just leave it to rot? send them to jail apparently they have too much time on their hands, let them think about it for awhile.

Posted by: Charlie on Aug 20, 2008 at 10:18 AM
If these two were taking the dear for food then that would be a whole different deal but taking just the head for some kind of a trophy then leaving the rest laying in a field -throw the book at them...

Posted by: Anonymous on Aug 20, 2008 at 09:55 AM
It's okay when these stinking things (deer) tear up fences, crops, or vehicles. I think the state should be liable for the damages these deer do. Deer are big buck$ in more ways than one.

Posted by: jon on Aug 20, 2008 at 09:49 AM
How big was the buck?

Posted by: hunter on Aug 20, 2008 at 09:48 AM
this is what is wrong with the tri state area. people want to shoot every buck that they see in or out of season. if people would learn to manage the herd and only shoot mature bucks in season we would see an increase in nice mature bucks overall. if these people need to poach a deer for food shoot doe's. god knows we have plenty of those. besides the buck doe ratio is way out of wack anyway.

Jesus was Jewish, so don't tell me that being a Jew is a sin, & Christmas is THE ONLY HOLIDAY this time of year. Yes, I too love to hear MERRY CHRISTMAS, but I refuse to become upset when someone says happy holidays. How do you know if when you say MERRY CHRISTMAS to someone, your not saying it to a Jewish person? Do you ever hear them make a big fat stink about it? NO!!!, you don't. So I think you should just be happy that God has given you another day on this Earth. So that you have the time to celebrate, with your family, whatever holiday you choose. I've decided to say HAPPY MERRY KWANZ~MA~KA that way I've covered them all.

I have no problem with people saying Happy whatever it is but I am NOT going to watch what i say and not say Marry Christmas becasue it might offend people
  • Posted By: LadyA`The question was, Did you do any Holiday shopping over the weekend? The shopping they were referring was Christmas shopping. What other holiday shopping would we be doing? Thanksgiving was over. It offended me like many others. It is the Christmas season and I want to see the word Christmas used, not holiday or xmas.
  • Posted By: HuntingtonianI agree with Anonymous!! It is the "holiday season" and by definition, it encompasses all of the holidays that are coming, not just Christmas. I also am a christian and see something inherintly wrong with pigeon holing this time of year to simply "Merry Christmas." What I find really offensive is those of you who believe that it is ok to say "Christmas" but would be outraged if "Happy Kwanza" or "Happy Hanukah" appeared anywhere. So, that being said: HAPPY HOLIDAYS and a JOYOUS NEW YEAR to all!!
  • Posted By: Holiday is in referance to ALL holidays this time of year. I have been saying Happy Holidays since I was a kid, growing up during the 80's. Christmas is not the only holiday this time of year. We did just celebrate Thanksgiving, remember. I am a Christian, that is not offended by the phrase HAPPY HOLIDAYS.

  • Posted By: LadyAWSAZ- Could you please change the word Holiday to Christmas on your question? The word Holiday offends me.
