Massey Energy Lawsuit
A judge has dismissed Massey Energy Company's lawsuit seeking e-mails of West Virginia Supreme Court Justice Larry Starcher.

CHARLESTON, W.Va. (AP) -- A judge has dismissed Massey Energy Company's lawsuit seeking e-mails of West Virginia Supreme Court Justice Larry Starcher.
Kanawha Circuit Judge Jennifer Bailey Walker ruled that Massey failed to provide the 30-day notice required by state law before filing a lawsuit against a government agency. It also failed to give a copy of its complaint to the attorney general's office.
Richmond, Virginia based Massey had sued Supreme Court administrator Steve Canterbury under the Freedom of Information Act to obtain the e-mails between January 1, 2004, and July 2008 that refer to the company or its chief executive, Don Blankenship.
Massey's lawyers have said the e-mails might be relevant to the company's planned appeal of a $220 million verdict in favor of Wheeling-Pittsburgh Steel Corporation.

If the e-mails are or could be a deciding factor in the lawsuit, then they should have access to them. If they won't give them to Massey, then they should NOT be allowed by the other party as evidence. What's fair for one is fair for all! Give them the e-mail or throw them out the window!!!
