GALLIPOLIS, Ohio (WSAZ) -- Deputies in Gallia County are investigating a home invasion where one of the suspects was shot.

The sheriff’s office says it happened shortly after midnight on Clay Lick Road. They say that after the suspects broke into the home, they brandished a weapon at the homeowner. Investigators say the homeowner was able to get a shotgun and shoot one of the suspects in the shoulder. Both suspects were able to flee the scene.

Investigators say a short time later; the sheriff’s office got a call form Holzer Medical Center that a man had been dropped off at the emergency room with a gunshot wound to the chest. That man is believed to be one of the home invasion suspects. He was later transferred to St. Mary’s Medical Center in Huntington. He is said to be in critical, but stable condition.

Investigators believe the driver of the car was the other suspect in the home invasion.

The sheriff is not releasing any names at this time due to the ongoing investigation.

I commend this man for protecting himslef and his family. Thank God for the newly passed Castle Docterine Law. As of Sept 9th a person's residence or car is designated as a place where they are protected from illegal trespassing and violent attack. Therefore a person NOW HAS LEGAL RIGHT to use deadly force to defend that place from violent attack or an intrusion that may lead to violent attack. Finally a law to protect the victims.

I would like to thank all of the positive comments posted. This is my family and I can see the toll it has put on them. They really need to hear all the great support thats out there. I back my father 100% for protecting his home and family!!! Thanks to all of you for the engouraging words hopefully they can soon put this behind them and move on with their lives.

Better check ur facts since ohio passed house bill 184 the intruders can not sue and u are presumed to be acting in self defense now instead of having to prove it as before.It is a good law and soon these crooks will get the hint that people are fed up with their madness may take a few more killings but they will catch on

It's great he protected his home, etc. It's too bad we have such a screwed up legal system that he's opened himself up for a law suit. The criminal can sue him for medical, trauma and other compensation. You do have a legal right to protect yourself and your property, but recognize that you may end up in court if you shoot an intruder or whack him over the head with an iron pipe. You would have to argue that you really did act in self-defense or in defense of your property, and it would be up to the jury to decide whether to believe you. Basically, the law says that you can use reasonable force to defend yourself if you're being attacked or if you have a reasonable belief that you will be attacked. That is, you don't have to wait until the intruder is actually coming at you with a knife. The key word here is "reasonable"; the jury would have to decide whether a reasonable person would have thought that a toy gun was real or that a hand going into the pocket was reaching for a weapon.

Maybe if we start shooting people when they break into our homes and we are in fear, the prisons would be less full and criminals could stop getting so much time of their sentence suspended.

I am a republican, but I praise Ted Strickland for his insight on home defense. In west virginia, an 88 year old woman was robbed in her home, but that didnt happen in gallipolis this time. GOOD JOB!!!

This is the second home invasion in a week. A family had a home invasion last monday also. The results of that was the homeowner and his grandson were injured. The homeowner had to go to the hospital and they got away with stuff. They duct taped the man up and hit him in the head with his own gun. It just seems to be getting worse. The men who done it last monday were looking for drugs at the residence. Im just wondering who it was that done this one and who the family was this happened to. The criminals are getting braver anymore.

This needs to happen more often. Break in my house, threaten family etc... expect to be shot. You lose your all rights, including the right to breathe, when you decide to commit these crimes.

Weapons were shown to the homeowner and he had every reason to believe he might get killed. I'm glad the homeowner got the shot in and I don't care what condition the thief is in....he had no business in that person's home and he got just what he deserved!

Way to go homeowner for defending yourself, your family and your home! Don't be suprised if there are comments made on here that YOU should be charged for shooting a person that was brandishing a gun at you first. Seems like people ALWAYS defend the criminal! But don't feel bad, I would have done the SAME thing if I was in your shoes!

Most teachers deal with students who are exposed to/use more drugs and alcohol than any of the teachers. Since children spend more time with them, let's randomly drug test PARENTS, too!!!

I recently had a relative in the cardiac unit at Kings Daughters, in Ashland, and I was told that the nursing staff had been cut back and that no overtime was being given. This seems to be a drastic cut in patient care for a facility that spends thousands advertising that they are in the top 5% of cardiac hospitals in the country. I would be willing to wager that the Cleveland Clinic has not cut hours of those giving patient care.

I am probably one of their biggest critics due to having watch some of the bad side of the department for a long time. I wish that I could tell everything that I have seen officers do,which would put most of them behind bars or they'll lose their sheild, But retalliation is bad in our area. For example, I'm sure any parent would sacrifice their live for thier children. And several may give thier live to save their spouse. A few individuals may even do it for a close friend. But, I only know of 3 types of beings who will sacrifice thier lives for complete strangers; indeed even for people who hate them. The first would be our men and women in our armed forces. The second would be our law enforcement officers. And of course, third would be our Savior, Jesus Christ. Others are killed in the line of their employment, but not in order to save a complete stranger. Everytime a cop puts on his/her uniform, they can be a target for anyone upset about something. Even though it doesn't involve the cop personally, that very cop will give his life to save yours when a problem arises. We need to give our cops not only a wage, but a living wage and a great big THANKS.

I believe that all public safety workers should be drug tested but i also believe that they should be paid for the job that they do. Not many people understand what a public safty worker goes through. Would you put your life on the line for this kind of pay? Remember the saying that you get what you pay for. I see this in several new officers in my area. Don't get me wrong there are still very good officers in law enforcement. Something really needs to be done about the low pay for these jobs.

We are trusting our childrens education and our public safety to the very people that are some of the most underpaid profesions in the U.S.. If I could change this, I would. However, I do believe that these people should be randomly drug tested. I work in the construction industry and I have no problem being drug tested. I have nothing to hide. I also believe that any person who is intrusted with the safety of others should have nothing to hide. This includes plitical officials up to and including the president.
