WAYNE COUNTY, W.Va. (WSAZ) -- A 19-year-old was shot and killed on New Year's Day.
State Police say James Michael Mullins died from a gun shot wound to the face.
West Virginia State Police Senior Trooper R.J. Drake says even though the shooting appears accidental they do have a suspect, Haskel Johnson.
Police say the shot that killed Mullins was not self inflicted, they believe Johnson is the one responsible for pulling the trigger, but would not give any additional information.
Several witnesses were questioned about the shooting and they all said it was accidental.
When police responded to the call on Mill Creek Road, Mullins had already been taken to Three Rivers Medical Center, where he died.

Police found the handgun believed to have been used in the shooting at the home. No details surrounding the events leading up to the shooting have been released.
Senior Trooper Drake says no arrests have been made, but that this is an ongoing investigation.

This is absolutily crazy 1 year has passed a man is dead, and no one is being held accountable, yet there have been crimes like this happen after and the GUILTY have been delt with. What in the sam hell makes this situation so special that haskel is still walking around free. all of these other accidents people have been held accountable for the crime. He needs to be punished for this it is not fair to the people who have been or are in the same situation and are setting behind bars because of an "accident". I agree with angry. 110% If he doesnt serve time for this my faith in the judicial system has been damaged
it has almost been a yr when this so cld accident happened, lots of things have chged from what i hear mr johnson is no longer married and only is looking at a minor charge and is going on with his life and is living it up. what has this world come to. how can he sleep at night, u could kill an animal and get more time than he is looking at. people that know anything should come foward and let justice be done in the name of michael. i hear that if there even will be a trial it will be in feb 2010. don't let this go unpunished michael was someones son, brother, grandson, friend not just a young boy that was labled by some as a foster child, boy that belonged to the state. he was bright and had an amazing future ahead.
