The lawyers for Randy McCloy, the only survivor of the Sago Mine tragedy spent Tuesday morning in court trying to settle a lawsuit seeking blame for the tragedy.
During the hearing International Coal Group asked the judge to consolidate McCloy's lawsuit with two others filed.
But the judge denied that request.
He will only allow them to consolidate the suits for pretrial motions, concerning evidence.
Another big issue, I.C.G.'s request to delay the trial until other miners' families filed suit.
At least 10 other families have hired lawyers, but they have not filed suit.
The judge says at this point he won't limit the time they can file.
Both sides will be back in court in January.
