The case against Eddie Queen of Cross Lanes, is heading to the grand jury.
Queen is charged with the 1986 murder of Cathy Carroll and the rape of her daughter at their Montgomery Heights home.
A Fayette County Magistrate said the state presented enough evidence to send the case to the grand jury.
Queen remains in the Southern Regional Jail without bond.
Carroll's husband Robert has also been charged with murder. His trial is scheduled to start in 3 weeks.
