PAINT CREEK, W.Va. (WSAZ) -- An ATV accident Saturday injured two people and killed a little boy.

It happened in the Holly Grove area of Paint Creek, that's in eastern Kanawha County. It happened around 5 p.m.

West Virginia State Police tell WSAZ.com Charles "Chuck" Buford Slater, III, 38, of Kanawha County was on the ATV with Terry Wayne Slater, 11, of Paint Creek and a 5-year-old girl. Family members tell WSAZ.com Chuck was the children's uncle.

Chuck is still in the intensive care unit at CAMC General.

Terry was taken to Montgomery General where he was pronounced dead. The 5-year-old little girl was taken to Women and Children's Hospital where she was treated and released.

The parents of the two children tell WSAZ.com the ATV took a half turn and then hit a rock. The group was not wearing helmets, but family members don't believe that would have saved their little boy's life.

"Whatever it was, God was ready for him. Chuck has had them up that hill millions of times," Robert Slater said. "He loved riding with Chuck and he died doing it. Many people can't say that."

Terry's parents also tell WSAZ.com Chuck did everything he could to save the boy. The family says the child loved his uncle and he meant everything to him.

"He rode it all the time. I could walk as fast as he went," Sondra Slater said.

The mother tells WSAZ.com she will never let her daughter ride an ATV again.

Sergeant Michael Baylous says police don't anticipate any charges to be filed at this time, but the case has been sent to the Prosecutor's Office for consideration.

The parents don't believe any charges should be filed. They say their brother didn't do anything wrong. In fact, the child's father says he doesn't agree with West Virginia's helmet laws.

In regards to all the people who state this was the act of God, that it was this childs time to go! That is the most Absurd thing I have ever heard and my heart goes out to each and everyone of you that feels this way and I hope you can one day face the truth and stop comforting yourself with using God, the Bible and faith as your explanation as to why this child Died...Havent you ever heard of one shortening there life by hazards such as Alcohol, smoking, and abuse? Think about what your saying: It's OKAY that this child had no safety equipment on, and it's OKAY that this terrible tragedy took his life, it's OKAY that safety rules were not obeyed because no matter what it couldnt have saved this little boys life anyways because it was his time to DIE, And his death was GODS command!! Would you have said that if this child would have been killed by a drunk driver or child killer would you have overlooked there negligience and behavior? Would you have based the death then on GODS WISH?

This was a tragedy an 11 year old child lost his life and yes accidents do happen and more times than not the outcome of these accidents were the results of bad judgment, carelessness, and safety hazards/risks. Many Accidents can be avoided some by victim others by one at fault. In this case I'm very sure that this Uncle had no intention of killing his nephew however because of poor judgment a child died. Murder charge would be outrageous however there should be consequences (legally) yes he is suffering death on his hands of a child but that child suffered loss of life and I agree the Uncle should have made those children wear safety helmets as well as take turns between the children not ride two at one time. Safety is a must no matter the distance because you can not foresee the danger of anothers actions anything could have happened and caused this Uncle to wreck in a short distance, a deer jumping in front of him, the children horse-playing around, a heart-attack of Unlce
