Paula Rizer Sentenced to Life in Murder of Husband
Court officials say Paula Rizer has been sentenced to life with parole in the death of her husband, Kenny.

POMEROY, Ohio (WSAZ) -- Court officials say Paula Rizer has been sentenced to life with parole in the death of her husband, Kenny.
On Tuesday, a jury found Rizer guilty of murder in the shooting death.
Rizer must serve 15 years of that sentence before she would be eligible for parole.
She also received a 3-year sentence on the gun charge.

POMEROY, Ohio (WSAZ) `-- Following is a news release prepared by Meigs County Prosecuting Attorney Colleen S. Williams' office regarding the Paula Rizer case:
Meigs County Prosecuting Attorney Colleen S. Williams reports that Paula S. Rizer, 53, of Portland, was found guilty Tuesday afternoon by a jury of six men and six women, of the murder of her husband, Kenneth Rizer, on April 3, at their home on Lovett Road.
A trial in October 2009 ended with a not guilty verdict as to the original aggravated murder charge; however, the jury deadlocked and (was) unable to reach a verdict as to a charge of murder.
Rizer is due to be sentenced Wednesday morning. She was remanded to the custody of the Sheriff.
Prosecutor Williams and Assistant Prosecutor Matthew J. Donahue represented the State of Ohio at the original trial in October and the re-trial which concluded Tuesday with the guilty verdict.
The Indictment also contains a firearms specification, which is an enhancing circumstance, and alleges that "the offender had a firearm on or about her person or under her control while committing the offense, and displayed the firearm, brandished the firearm, indicated that she possessed the firearm or used it to facilitate the offense."
The firearms specification adds a mandatory three year prison term on top of any other sentence. Rizer faces a sentence of life imprisonment with a possibility of parole after eighteen years.
Rizer is currently held in the Washington County Jail because Meigs County does not have facilities to house female prisoners.

POMEROY, Ohio -- A jury has found Paula Rizer guilty of murder in the shooting death of her husband.
The jury returned the verdict shortly before 3 p.m.
Rizer will be sentenced at 11 a.m. Wednesday in Meigs Common Pleas Court.
She showed no emotion when the verdict was read.

Paula Rizer is charged with the shooting death of her husband, Ken.
The shooting happened at the couple’s home in Portland, Ohio, in April 2009.
Back in November, a jury in Meigs County found Rizer not guilty of aggravated murder, but they could not come to a verdict on the lesser murder charge, so Judge Fred Crow declared a mistrial.
Closing arguments in the retrial wrapped up Friday. Court was not in session on Monday due to the holiday.
The jury got the case around 9:45 Tuesday morning.

POMEROY, Ohio (WSAZ) -- It's a case that boils down to common sense versus science.
Closing arguments wrapped up Friday in the Paula Rizer retrial. She's charged with murder in the shooting death of her husband Ken.
The prosecution argued that by all accounts Ken Rizer was a calm, laid-back man who didn't have a temper and never got angry.
"Paula even told several investigators that they had a good, loving marriage," prosecuting attorney Colleen Williams said. "They gave her ample opportunity and she never told them anything was wrong."
But, the defense argued that changed when Ken retired two years ago. Paula says that's when he became abusive.
“Paula told you that he sometimes hit her with this paddle," defense attorney Herman Carson said. "Why would there be a paddle hanging in the homes of two 50-year-old adults. He hung it there as a means of intimidation and brutality. It was their little secret that no one outside the house knew about."
Then on April 3, 2009, the two got into an argument and Paula grabbed a 9 mm gun in self defense. The defense says scientific evidence shows the two struggled while Ken was standing over her, and Paula fired the gun repeatedly to protect herself.
The prosecution says the evidence proves Ken was sitting down in his recliner when Paula walked up and deliberately fired six shots at him. It's an intricate case that the jury won't start deliberating until Tuesday -- after the long holiday weekend.
In November, during the first trial, the jury acquitted Paula of aggravated murder, but was deadlocked on the lesser charge of murder.

POMEROY, Ohio (WSAZ) -- Firing out of fear -- that's what Paula Rizer said she did the day she shot and killed her late husband Ken Rizer.
On Wednesday, the star witness got her day in court for the second time. The first trial in November ended with a deadlocked jury.
It wasn't until recently that Rizer's memory returned, and she shared new information publicly for the first time Wednesday.
"He used the paddle when I got mouthy," Rizer said about her late husband.
She spent much of the morning detailing years of physical, verbal and sexual abuse suffered at the hands of Ken Rizer.
"He would make me get on the bed, and he'd stand over me and make me perform certain acts on him," Paula Rizer said.
The two married 14 years ago. It was her third marriage, but she said it was the best relationship she'd ever had.
On April 3, 2009, Paula Rizer said she snapped -- out of fear. She said the two got into an argument over Ken Rizer taking her outside to learn how to shoot a 9mm handgun. She said he wanted her to be able to protect herself, but she wanted nothing to do with the gun.
"I got angry and said, 'Fine, get off your fat (expletive) and let's go outside and do this,' " Paula Rizer said. "He rose up out of the chair and came at me. He was very angry."
She continued, "The next thing I knew I was on the floor and said, 'Don't go and get the paddle, don't do this to me, I'm not going to let you do this to me.' "
Out of six shots fired, five hit Ken Rizer, killing him. The prosecution picked Paula Rizer's story apart from her accusations that Ken Rizer physically abused her.
"Did you ever tell anyone that Ken hit you with a paddle or popped you in the mouth?" the prosecutor asked repeatedly.
"No," Paula Rizer repeatedly responded.
The prosecution contends that Paula Rizer never shot out of fear because there wasn't anything to fear from Ken Rizer. Instead, they believe she planned to kill him for financial gain. It's a case that will take more shape in the final days of testimony.

UPDATE: Thursday 1/7 - Evening
POMEROY, Ohio (WSAZ) -- A wife shoots and kills her husband. Was it self-defense or cold-blooded murder? It's a case that's now on trial for the second time in Meigs County, Ohio. The children of the couple are caught in a painful limbo are now forced to re-live the nightmare all over again.
“I’m numb, it's painful to re-live this all over again. I’m depressed,” said James Rizer.
James Rizer can't stand the thought of re-living the gory details of his father's death at the hands of his stepmother. Paula Rizer admittedly shot and killed Kenny Rizer in their Meigs County home on April 3, 2009. James was the first person called to the scene.
"At first she told me that it was an accident and he told her the safety was on the gun," said James.
"Six bullets… five into the victim," said Colleen Williams, the prosecutor, as the opening line in her opening statements.
"Paula was the victim of physical, verbal and sexual abuse," said Herman Carson, Paula’s defense attorney in his opening statements.
"My dad was the most calm, nicest gentleman I ever knew," said James.
"First, we had to go through the pain of losing him, then we had to endure the trial the first time, and now we have to go through this all over again. It’s numbing," said Melissa Rizer, James’ wife.
"It was self defense. The evidence will show she was on the ground firing up and emptied the gun," said Carson.
Now, the stage is set for a whole new trial on a painfully familiar case.
During Paula Rizer's last trial in November, the jury found her not guilty of aggravated murder, but deadlocked on a lesser charge of murder. A lone juror prevented a unanimous verdict on the murder charge.

A jury was not able to reach a verdict last week in the case against Rizer, who is accused of killing her husband, Kenny.
The shooting happened at the couple’s home in Portland, Ohio. Kenny suffered multiple gunshot wounds, according to the prosecutor.
Paula Rizer was found not guilty of aggravated murder, but a mistrial was granted for the lesser murder charge.

The jury is deliberating the fate of Paula Rizer.
Rizer is charged with killing her husband, Kenny last year.
The jury got the case late Monday, after Rizer wrapped up two days of testimony.
Jury deliberations are expected to begin at 8:00 a.m. Tuesday morning.

POMEROY, Ohio (WSAZ) -- The murder trial for a woman charged with killing her husband continues Wednesday in Pomeroy.
Paula Rizer is charged with the aggravated murder in the shooting death of her husband, Kenny, back in April.
The shooting happened at the couple’s home in Portland, Ohio.
The Meigs County Sheriff says Mr. Rizer died from multiple gunshot wounds.
Mrs. Rizer was arrested shortly after the shooting.
On Tuesday, jury was seated and prosecutors began presenting their case.
A published report says the victim’s sons and state forensic experts were some the first to testify.

i saw ms rizer tuesday after noon in the sheriffs dept. it was right before they called over and said a decision had been made. she was emotion there, and just looked worn out from all of this.
For those of you who say the prosecutor is corrupt where do you get off with such disrespect? I have met the prosecutor and I can tell you in all my years in Meigs county, she is definetly trying to make a difference. There is nothing wrong with the justice system in Meigs county. To the Rizer family, my prayers are with you as you heal from this whole mess. The the family of Paula, my prayers are with you also. But come on people, how come when something doesn't go the way some of you want it to you place the blame on our justice system? If it is so bad then why don't some of you run for office and make some changes. As one person put it "four murders, four convictions" sounds to me like the systme is working.
