For 3rd Time, West Virginia Supreme Court Finds for Massey
A multimillion-dollar coal contract dispute that went all the way to the U.S. Supreme Court has again resulted in a ruling in favor of Massey Energy Co.

CHARLESTON, W.Va. (AP) - A multimillion-dollar coal contract dispute that went all the way to the U.S. Supreme Court has again resulted in a ruling in favor of Massey Energy Co.
For the third time in nearly two years, West Virginia's Supreme Court has overturned a $50 million jury verdict against the coal producer.
The 4-1 ruling was again written by Justice Robin Davis and again concludes that Harman Mining and its president should have pursued their claims in Virginia.
The state high court gave the case a second look last year after, photos surfaced showing one of its justices vacationing with Massey Chief Executive Don Blankenship.
The U.S. Supreme Court ordered the latest review, citing the millions that Blankenship spent to help get another of the justices elected.

Wv is known as legal hell for this particular reason. In fact, WV was rated one of the worse states in the union because of frivolous lawsuits. People/ companies know they get better verdicts in this state because of the liberal politics, and therefore file suit in a state where the judiciary has no jurisdiction.
Honestly folks, this is no surprise, but keep in mind that coal will not be lucrative much longer. Environmental protection laws are going to drive the coal industry out of business. It is not speculation, it is a fact, and Massey and everyone else knows it. The thing is, no one is preparing properly for it. The administration's cap and trade and its intent to limit coal use is going to destroy West Virginia if we do not come up with an alternative to the coal industry. With medical marijuana in 14 states, and some states almost complete legalization, why isn't West Virginia getting its share of this lucrative market? We have millions of acres of growing space, we could be an industry leader in medicine! Growing, manicuring, and distribution of marijuana can bring billions in revenue to our state if we get ahead of the rest of them for once.
