CHARLESTON, W.Va. (AP) -- A cardiology fellow at Marshall University's School of Medicine faces federal health care fraud charges.
A federal information filed Wednesday charges Dr. John Theodore Tiano with conspiracy to misuse a registration number and aiding and abetting health care fraud.
Prosecutors have asked the court to scheduled a guilty plea hearing for Tiano.
Tiano is accused of allowing a Mingo County clinic and its employees to use his name and Medicare provider number to bill for services that he didn't personally provide.
The scheme defrauded more than $119,000 from Medicare.
State Police and federal agents went to the plain clinics in Mingo County on March 25, 2009.
Tiano also is accused of allowing others to use his federal drug registration number to issue prescriptions to acquire controlled substances.
According to published reports, Dr. Tiano was publicly reprimanded for allegedly prescribing excessive amounts of painkilling narcotics to patients.
The reports also said Dr. Tiano was ordered to stop working at Justice Medical in Wayne County.
This investigation started back in 2007. The Board of Medicine concluded that Tiano was "prescribing, dispensing or administering prescription drugs other than in good faith and in a therapeutic manner."
At the time, Tiano was also placed on three years probation.

Ryan, how is it that you know so much about this particular incident? This is one doctor who may have been accused of such acts but there are so many more that go without being penalized... so really .. license taken away.. not necessary at all
Another Story of fraud and Marshall University. It is time to clean house at MU and get rid of the administration. MU needs honestly and integrity and right now they have none.
Why wasn't his license taken away, he got caught his hand in the cookie jar. All he got was being publically reprimanded. So basically he got a hand slapping. He is allowed to continued practicing medicine.
