WINFIELD, W.Va. (AP) -- A Putnam County historic group is seeking a judge's approval to exhume and relocate the remains of a Confederate soldier.

A court hearing on the Hoge House Foundation's request will be held next week.

The body of Capt. Philip James Thurmond was buried in an unmarked grave on the property of James W. Hoge, the county's first resident lawyer.

Foundation vice chairman Lee Casto says the grave is near the edge of a creek embankment that's now slipping.

The foundation wants to move the remains to within the Historic Hoge House complex.

Thurmond was fatally wounded during a skirmish in Winfield in October 1863. The soldier's family was to claim the body after the Civil War ended but no one ever came forward.

I Agree! Show the respect this soldier deserves! It would be a crying shame to let this persons final resting place -- or that of any burial site -- slip into a creek! Get with the program, folks!

i hope they get permission. it would be a shame for the grave to be disturbed by the land shifting.
