HUNTINGTON, W.Va. (WSAZ) -- A case that is more than three-years-old has still not headed to trial.

Teresa Baker, who is accused of killing her daughter's boyfriend in February 2008, was back in a Cabell County courtroom Thursday morning.

Prosecutor Chris Chiles and Baker's defense attorney Charlie Hatcher have been working to clarify tape recordings from the night of the alleged incident. Both sides have made several attempts to enhance the tapes, and they believe they now have transcripts that will satisfy the court.

Those documents will be turned in to the court and both sides for review.

Baker is set to be back in court next Wednesday for another status hearing.

Cabell County Circuit Court Judge Alfred Ferguson set June 21 as the new date for Teresa Baker’s murder trial.

Baker is charged in the shooting death of Jeff Sadler. The 29-year-old lived next door and had been dating her daughter. The shooting happened in February 2008 following a domestic dispute between Sadler and her daughter.

This is the third time Baker has been arraigned on the charge of murder.

Prosecutors allege that back in February of 2008 Baker shot and killed 29-year-old Jeff Sadler.

Baker is not currently in jail, her bond was held over from the last indictment.

"She has shown up every time your honor," said Prosecuting Attorney Chris Chiles. "I see no problem carrying that over."

Baker is scheduled to be back in court September 20.

The indictments were unsealed on Thursday at 3 p.m.

This is the third time that Baker has been indicted on this charge. Baker has been in circuit court several times and has even threatened to take her case to the Supreme Court.

The first time, her defense attorney says the prosecutor misspoke and violated the rules. So, Cabell County Circuit Judge Dan O'Hanlon encouraged the prosecutor to represent the case to another grand jury to eliminate any confusion.

Teresa Baker was back in Cabell County Circuit Court Friday morning for another pre-trial hearing.

Baker is accused of shooting Jeffrey Sadler in February 2008 at his Huntington home, after she says police failed to respond to her 911 call about a domestic dispute between Sadler and her daughter.

In the latest courtroom dispute, Baker's attorney, Charlie Hatcher, says Cabell County Prosecutor Chris Chiles gave inappropriate instructions to grand jurors about self defense and how to consider it in this case.

Chiles says he merely read the definition of self-defense and was granted permission by the judge at the time to do so.

Judge Dan O'Hanlon said he will review the transcript to make sure the judge did grant permission. He plans to issue a ruling next week.

Mr. Hatcher says if Judge O'Hanlon rules against him, he will take the matter to the West Virginia Supreme Court in an effort to prohibit the case from going to trial.

That trial is currently scheduled for August 9th.

Baker called police when she heard the two fighting, but after they didn't respond she decided to take matters into her own hands -- walking next door and shooting Sadler.

Baker's attorney claims she is not guilty of murder, and this case should be dismissed.

Police say 51-year old Teresa Lynn Baker shot and killed Jeffery Sadler at his home on Cedar Street in Huntington last week.

Sadler who was 29 lived next door. Baker’s daughter, Alison Grieco was the victim's girlfriend and lived at the house. Grieco told investigators that Baker entered her house and was confronted by Sadler.

Grieco then heard Baker say “what are you doing.” Grieco then said she heard three gunshots and observed the victim collapse on the floor.

The criminal complaint then says that Baker left the house and walked back to her house and called 911 saying she had shot her neighbor.

Before the shooting, police say Baker called 911 to report a disturbance between her and Sadler.

During this morning’s hearing, the 911 tapes from that night were played in court. Baker’s attorney is also questioning Huntington Police Detective Chris Sperry about those calls and the about the police response time.

Magistrate Mike Woelfel found probable cause in the hearing Wednesday afternoon. The case will now be bound over to a grand jury.

Three children were in the house when the shooting happened. They were taken into police custody.

Apparently, the domestic disturbance that night wasn't the first for this family. According to police records, Grieco filed domestic battery charges against Sadler last year.

According to court records, Sadler didn't appear in court for battery charges.

Back in June, Grieco stated she was missing some money, when she confronted Sadler, he became irate and struck her in the face 4 times and said next time he would rob her blind and then fled the scene.

Three children were in the house when the shooting happened. They were taken into police custody.

Baker is being held without bond in the Western Regional Jail until she goes before a grand jury.

Family members of Baker and Sadler were in court Wednesday morning, declined comment.

The shooting happened around 9pm at 156 Cedar Street. Police say this is thet home of the victim. He is 29-year old Jeffery D. Sadler. Baker lived next door at 158 Cedar Street.
