BECKLEY, W.Va. (AP) -- A federal judge has declined a request to dismiss Massey Energy's lawsuit targeting anti-mining activists.
U.S. District Judge Irene Berger ruled Monday that Massey can show at least $75,000 in potential damages, meaning the case qualifies for federal court. The defense had argued that the January protest at the heart of the lawsuit didn't cause sufficient monetary damages to Virginia-based Massey.
Massey says the multi-day protest cost it more than $100,000, mostly to build a road to bring in a lift capable of helping activists climb down after several days camped out in trees at a Raleigh County mine.
The dismissal comes a day before Berger is scheduled to consider a request to hear other arguments in the case.

Jack...Are you sure Don bought a WV Supreme Court Judge? That is saying our Judges are for sale. I filed a grievance through the WV Grievance Board and felt I got shafted by the Kanawha County Circuit Court. Are they crooked too? They completely ignored the evidence presented by my lawyer as if we never presented any evidence at all. Do you think the court system in this state may be rigged? Do you think the entire USA knows this? Can we do anything about this? Here are your answers in order: No...Yes...you do now...you do now...no This is why WV cannot attract business to our state and we have certain politicians fighting this.
AS MY PAPPY USED TO SAY. THEY GOT THEMSELVES IN THAT MESS AND THEY COULD HAVE GOTTEN THEMSELVES OUT. MASSEY DONE THEM A FAVOR. I WOULD HAVE LEFT THEM IN THE TREES UNTIL THEY DECIDED TO GET DOWN OR UNTIL THEY ROTTED DOWN!
i agree with you jb the protesters need to go back to cali, kansas or where ever they came from.
