UPDATE: Saturday @ 11pm
MASON COUNTY, W.Va. (WSAZ) -- Two very different stories have the tempers of three men flaring.
David Maynard admits pulling the trigger Friday night, shooting John Cain and Michael Ward, and says he did it out of self-defense.
It happened Friday night in the Cain Ridge/ Tribble Road area of Leon.
Maynard says he and his son-in-law were out scouting hunting locations. He says when they were heading back to the truck he heard and saw the two men near his truck.
Maynard says one of the men had a pistol, and shot out two windows. Mayard believes they were trying to steal a wallet and shotgun out of his truck.
Meanwhile words were exchanged, and guns were flashed. Maynard says his gun was in his truck the entire time. The parties seperated, and about 20 minutes later the two parties were back together in the woods, according to Maynard, things escalated from there.
"He's got a 12 gauge pointed right at my head and said 'I ain't playing,' so I scampered to the back of my truck, and he's trying to shoot me between my passenger door and my cab. I leaned to the outside and I shoot him, and he's sitting on his four-wheeler aiming at me with his shotgun when he falls off his four-wheeler he has two shot guns then he scampers around, and he's coming around the drivers side going to shoot me with a pistol! He's trying to cock the pistol, I aim for his hand, and I shoot his hand with my shotgun."
Mayard says he is the one who called 911 to explain what happened.
Meantime, the family of Michael Ward is furious that Maynard wasn't arrested after this happened. Ward was shot in the hand, face and chest.
Kelli Hess is Ward's mother, she says, "He had Carhart clothes on they are thick and I noticed the buck shots went through the clothes but stopped at the cigarette pack in Michael's pocket, that could have hit his heart," Hess said.
John Cain says that Maynard shot at his ATV while he and Ward were out riding Friday night. He says it's a shame you can't go anywhere without "fear of being killed."
Cain says he was hit with some buck shots in the back.
Deputies in Mason County are investigating, and haven't filed any charges in the case.
