Piano Teacher Charged in Sex Abuse Case Sentenced to Home Confinement
A piano teacher from St. Albans will spend almost a year on home confinement after he pleaded no contest to charges of sexual abuse.

CHARLESTON, W.Va. (WSAZ) -- A piano teacher from St. Albans will spend almost a year on home confinement after he pleaded no contest to charges of sexual abuse.
During a hearing Wednesday, a judge sentenced Jack Pierce to 270 days on home confinement. Pierce will also have to register as a sex offender.
The judge also told Pierce he is prohibited to have any contact with with anyone under the age of 18. Pierce's sentence also requires him to attend counseling.
Pierce pleaded no contest to the misdemeanor charges back in March. A no contest plea means Pierce didn't admit guilt, but he won't fight the charges.
"While I have a lot of power in this black robe, in this position, I don't always have the power to find the absolute truth," Kanawha County Circuit Court Judge Jennifer Bailey said. "There is a higher power that I believe in that will make decisions and past judgment that I don't have the ability to do."
The charges are from as far back as the mid 80s. According to court records, Pierce was accused of molesting a student during a sleepover at his house.
The victim's father spoke during the sentencing hearing on Wednesday.
Monty McIntyre told the judge Pierce was a trusted family friend.
"We traveled together and we dined together, we loaned him money to pay his taxes one time," Monty McIntyre said. "All of us either took piano lessons or sang in his chorus. At the same time, we were being used, this man manipulated the family to gain access to our children."
McIntyre told the judge his family was disappointed when Pierce wasn't convicted when the allegations first surfaced 19 years ago.
"Home confinement is little justice for a child, now a grown man who warned the community about Pierce 19 years ago," McIntyre said.
"Persons often believe misdemeanor charges aren't serious crimes because they're put in that category," Judge Bailey said. "These misdemeanors are perhaps the most serious in nature that one can face and be convicted of."

Jack Pierce pleaded no contest to misdemeanors back in March.
The charges are from as far back as the mid 80s.
According to court records, Pierce was accused of molesting a student during a sleepover at his house.
Pierce is scheduled for sentencing at 9:00 a.m. Wednesday in a Kanawha County Courtroom.

CHARLESTON, W.Va. (WSAZ) -- A private music teacher from Kanawha County accused of sexual abuse pleaded no contest to the charges Friday.
Jack Pierce was charged with five counts of sexual abuse by a parent or guardian and first-degree sexual abuse.
However, during a hearing Friday, Pierce pleaded no contest to three counts of third-degree sexual abuse. All three counts are misdemeanors.
According to court records, Pierce was accused of molesting a student during a sleepover at his house.
One of the alleged victims with whom he allegedly had an inappropriate relationship was in the courtroom on Friday. Houston McIntyre says he was glad to see this day come.
"There is not too much emotion anymore, because it's been so long ago," he said. "After 20 years, it's kind of nice to see some recognition taken care of here."
McIntyre also said, "It's embarrassing to come out and say this stuff is going on 20 years ago and having to deal with this again but, you know, I got to do what I got to do. I have a niece and nephew and I don't want stuff ... for them to have to deal with stuff that I did ... it's just not right."
McIntyre's parents say their friendship with Pierce grew because the family all took piano lessons. They say in addition to day trips, they had dinner together and, at one time, they even loaned him some money to pay his taxes.
Charlotte McIntyre said, "Surely a friend like that wouldn't abuse our child."
When her son spent the night at Pierce's house both parents say at the time it seemed OK because another child was also there.
Monty McIntyre says he and his wife are proud of their son, who was taken to counseling shortly after he told his mom what happened to him.
"He knows he's guilty, we know he's guilty," Monty McIntyre said, "I would encourage other parents to follow your gut."
As part of the plea agreement, Pierce will have to register as a sex offender for the rest of his life.
Jesse Forbes represents Jack Pierce.
"He's pleaded no contest to misdemeanor offenses due to the fact that he is 64 years old, has health concerns and was facing potential life in prison," Forbes said.
Forbes went on to say the case was dismissed by the grand jury 20 years ago, and that one of the accusers now has a rap sheet of his own.
Pierce is scheduled to be sentenced on May 12.

According to people in Saint Albans,West Virginia who came forward and gave their name or remained annonymous to tell what this man done over a period of years some had reported this to the schools, police and others,way back when. The sad thing is all of the adults that knew this are also to blame for not comming foward. One can assume that a lot of people in the town of Saint Albans knew this was going on. What does the people with children and teens think about crime in their town of Saint Albans WV?
I have known Jack Pierce for a very long time and have spent a lot of time with him. I don't know if he did this, but then neither do the posters here who are ready to tar and feather the man. All I can say is that I'm glad our justice system does not electrocute (one poster) someone in the absence of real evidence of wrongdoing. Pleading "no contest" is not an admission of guilt; I know that Jack has very limited resources and cannot afford to hire a lawyer to take this matter to trial. On the flip side, if the prosecution had real evidence, they would never have offered a plea. Consider this: would an elected prosecutor turn down a golden opportunity to very publicly bring a child molester to justice if there was real evidence? Those of you seeking retribution should be happy to know that these charges have forever ruined Pierce's ability to make a living teaching (even privately).
THE JUDGE MUST HAVE BEEN DRUNKEN AND STUPID, ITS PEOPLE LIKE THIS OF WHY THEIR ARE SOO MANY PROBLEMS, SHAME ON YOU COURT SYSTEM HOW WOULD YOU FEEL IF IT WERE YOUR KIDS? WOULD IT BE A STIFFER PENALTY OR NOT? SINCE YOUR TOO STUPID TO GIVE HIM PROPER PUNISHMENT Atleast we can trust that god will!
