Kentucky Man Challenges Murder Conviction
A Kentucky man is challenging his conviction in the 2006 shooting death of a woman in eastern Kentucky saying his attorney did a poor job at trial.

ASHLAND, Ky. (AP) - A Kentucky man is challenging his conviction in the 2006 shooting death of a woman in eastern Kentucky saying his attorney did a poor job at trial.

Timothy Scott Simpson of Ashland is scheduled to return to court Monday in Boyd Circuit Court. The Ashland Daily Independent reports that Simpson claims his attorney, Michael Curtis, failed to adequately represent him.

Clay and 28-year-old Faith Clay of Flatwoods had been living together for about three weeks when she was found dead on the couch with a gunshot wound to her right eye. Simpson was sentenced to life in prison for murder, plus five years for tampering with physical evidence.

The Kentucky Supreme Court in June ordered a new sentencing for Simpson because Kentucky law does not allow a defendant to be sentenced to a term of years to run consecutive with a life sentence.

Well i will just say this.....I do know the man personally who was convicted. The only thing I have to say is this : if you followed the trial then you would know that his attorney did not offer any defense whatsoever! I am not judging whether the man shot the girl or not simply because he had no defense to rebutt or explain any of the prosecutor's case. One would assume, since the family paid Mr. Curtis $25,000 to defend him, then surely to goodness he should have at least given the defendant's side of the story and tried to "defend" him! Wouldn't we all vote to convict someone with no defense whatsoever? As I said I have no knowledge of the facts other than what the news covered and it was all about what the prosecution said. I actually tried to be impartial wait to hear both sides before I cast judgement. However, I was left wondering where his defense was!

Actually, I was a juror in one of Mr. Curtis's trials and he's a really good lawyer. If you think this man is innocent, go review the evidence and the trial transcripts and make you own opinion. I just stated a fact, that is, the man is not claiming to be innocent. He is claiming he was poorly represented. Big difference. Besides, unless little green men from Mars came into his home and shot his wife in the eye and he tried to keep those little green men out of jail by tampering with evidence, then I do not see how he could be innocent. But, what do I know?

and MrObvious do you know all the details of what went on in court and out of the court room? do you know for sure that Mr Curtis did a good job? You seem to think you know it all. Do You know either person in this case?
