Kanawha County Murder Suspect Sentenced

CHARLESTON, W.Va. (WSAZ) -- A man is now heading to prison for stabbing and killing his cousin while her 3-year-old was in the same house.

Timothy Sutherland was sentenced to life in prison Friday afternoon.

He says an argument led him to kill Stacie Smith in her St. Albans home in 2009.

She was found by her father a few days later.

CHARLESTON, W.Va. (WSAZ) -- After just a few hours of deliberation, a jury has found a Kanawha County man guilty on murder charges.

The jury found Timothy Sutherland guilty in the death of Stacie Smith. The murder happened in her home along Carson Street in St. Albans back in December 2009.

The jury also recommended no mercy Thursday.

Sutherland is set for sentencing April 15.

CHARLESTON, W.Va. (WSAZ) -- A man accused of murdering his own cousin unveils the gruesome details of that night -- Dec. 30, 2009.

It was the second and final day of testimony in the trial of Timothy Sutherland, and Wednesday the jury was shown Sutherland's videotaped confession.

"I know I'm a junkie," Sutherland said in the confession to investigators. "My family knows I am a junkie. That's why my family has nothing to do with me hardly, and then she calls me a junkie."

Sutherland admits an argument with his cousin, Stacie Smith, led to her murder.

"It hurt, I stomped out of the room," Sutherland said. "I got a butcher knife."

Sutherland was staying with Stacie and her fiance, Brent Michels, when he stabbed her in her own bed.

"I freaked out after I stabbed her," Sutherland said. Investigators then asked where he stabbed her. He pointed and said, "The top of her chest."

"I just can't believe anyone could do that to anyone, much less their cousin, someone who took care of them, tried to help him guide him, financially helped him as much as we could, both of us did," Michels says.

Michels says he and Stacie were trying to help Sutherland get back on his feet after just getting out of prison for sexual assault.

"The family was trying to give him a chance and asked us to take him under our wing," Michels says.

Prosecutors showed the jury the knife along with Sutherland's blood-stained clothes. He says after the stabbing, he tried to kill himself and then he took off.

"I wish it was me instead of her," Sutherland said in the confession. "I didn't mean for it to happen like that."

Stacie Smith's father found her dead in her kitchen with her 3-year-old son inside.

Sutherland is charged with first-degree murder.

Closing arguments will be begin Thursday.

CHARLESTON, W.Va. (WSAZ) -- Opening arguments began Tuesday in the case of a man accused of murdering a young mother.

Timothy Sutherland is accused of killing Stacie Smith in her home along Carson Street in St. Albans back in December 2009.

Smith's father found her stabbed to death in the kitchen while her three year old son was still inside.

Jury selection wrapped up on Monday.

KANAWHA COUNTY, W.Va. (WSAZ) -- The trial of a man accused of murdering a young mother has hit a snag.

Timothy Sutherland is accused of killing Stacie Smith in her home along Carson Street in St. Albans in December 2009.

Smith's father found her stabbed to death in the kitchen, while her 3-year-old son was still inside.

Sutherland's trial was suppose to start Monday, but his defense asked for a delay because they are waiting on test results.

The trial has been rescheduled for March 14, 2011.

CHARLESTON, W.Va. (WSAZ) -- A man who is accused of robbing and murdering a young mother now knows when his trial will begin.

Timothy Sutherland was back in Kanawha County Court Friday for his arraignment, where he pleaded not guilty.

His trial is set to begin on September 7th.

Sutherland is accused of killing Stacie Smith in St. Albans at the end of last year.

Smith's three-year-old son was actually found inside the home with her dead body.
