UPDATE 5/24/10 @ 6:15 p.m.
SCIOTO COUNTY, Ohio (WSAZ) -- Rodney Frye was there when a Scioto County Sheriff's deputy shot 84-year-old Orville Brown on his property Sunday afternoon.
"He begged and begged for the old man to put the gun down," Frye said. "The officer went above and beyond the call of duty."
The whole standoff was over in a matter of minutes.
"The officer pleaded with him to put his gun down, Frye said. "'Please put it down.' He begged the older gentleman to do so."
Frye owns the sealing company that was working on the parking lot of a neighborhood hardware store, located directly across the street from Brown's residence along Old Scioto Trail in Rosemont.
Frye said he and five workers noticed Brown standing on his front porch for hours while the men were working. One of the workers saw
Brown had a gun and suggested calling 911. Within minutes, a sheriff's deputy arrived on scene. Frye says it appeared Brown "just felt threatened maybe with the noise and everything going on there."
Eyewitnesses say Brown fired his gun first. Scioto County Sheriff Marty Donini says Sergeant Fike, a 15-year veteran with the department, returned fire -- hitting Brown with one shot.
Donini says he has requested the assistance of the Bureau of Criminal Investigation to conduct an independent investigation. Donini says investigators speaking with family members say Brown appears to have suffered from symptoms of dementia.
Brown was taken to Southern Ohio Medical Center and then transferred to a hospital in the Columbus area. He is listed in critical but stable condition.

For Anonymous. Are you insane yourself. So I guess we should just let someone stand there with a gun and keep shooting it until he runs out of ammo? Is that right. Whether you relize he's "Out of his mind" or not. This officer was protecting life. Those around that were being shot at. People like you make me sick. Always wanting to blame someone. This is why America is in the state it's in. People want to be so politically correct all the time it is ruining our country. Let's see, if you were out there in that parking lot, being shot at, even if it was only one shot, and you were ducking behind a car or whatever, and you saw this cop waiting to do something because he thought maybe the guy with the gun has a mental disease, you would be the first one on here complaining, "these cops are worthless, this guy was shooting at us, and that cop just set there and watched." You know it's true.
Have you ever heard the expression "Only fire when fired upon" Leo. One thing is for sure by your comments are your not military. that KILL OR BE KILLED ATTITUDE comes from a coward.
I thought police are trained to recognize mental disease or dementia. Where did the gun come from? was he known to display this behavior in the past. from what i read this is just another case of excessive force being used. dont u cops have any common sense or fortitude to do everything possible to avoid killing any man? that's why you become a cop, to protect and to serve. where's the courage today. you younger cops today have more interest in using your gun when back in my day it was frowned upon when ever you had to use your gun.
