Driver with Revoked License Arrested, Charged With Possession
A St. Albans Police Officer stopped a car on Pfaff Street for a faulty break light; a check of the driver's ID showed he was wanted for failing to show up in court after he was charged with domestic battery.

ST. ALBANS, W.Va. (WSAZ) -- A simple traffic stop led to a much larger arrest Sunday in St. Albans.

A St. Albans Police Officer stopped a car on Pfaff Street for a faulty brake light; a check of the driver's ID showed he was wanted for failing to show up in court after he was charged with domestic battery.

Officers say Donald McGhee Jr., 33, of Hurricane, was driving on a revoked license because of a previous DUI offense. Officers also say he was carrying illegal drugs.

McGhee was charged with simple possession and driving on a revoked license.

Fugitive from justice WV code 5-1-10 (a) Whenever the governor of this state shall demand a person charged with crime or with escaping from confinement, or breaking the terms of his bail, probation, or parole in this state, from the executive authority of any other state, or from the chief justice or an associate justice of the supreme court of the District of Columbia authorized to receive such demand under the laws of the United States, he shall issue a warrant under the great seal of this state affixed thereon by the secretary of state, to some agent, commanding him to receive the person so charged if delivered to him and to convey him to the proper officer of the county in this state in which the offense was committed.

Jimmy, Jimmy, Jimmy. Both men were listed in NCIC as fugitives from justice. I'm not sure from which law school you obtained your law degree or which police academy you trained at but you apparently slept through it all. And both were charged as being fugitives from justice. So Jimmy, are you claiming that the police and Kanawha Magistrate Court are wrong in charging these two crooks? And what code have you been reading and referring to?
