CHARLESTON, W.Va. (AP) -- A Boone County doctor who pleaded guilty to participating in illegal distribution of diet pills will spend a year and a day in prison.
Brian J. McDevitt was sentenced Tuesday in federal court in Charleston. The 46-year-old Turtle Creek resident also must pay a $60,000 fine.
McDevitt had pleaded guilty in January to conspiring to allow others to use his federal registration number to distribute Phentermine.
The U.S. Attorney's Office says McDevitt practiced in Varney, Huntington and Chapmanville.
A stipulation of facts entered with McDevitt's plea says three employees at the Varney clinic used McDevitt's federal registration number on more than 800 occasions to illegally distribute the pills.

he may live in boone co. but doctored in chapmanville but, get him for diet pills they need to get the drs. in boone that push harder drugs but that is the law for you but i heard he was a good family dr. but he did wrong so now he must face what he has done
How many people have been injured or have even died from the abuse/overuse of these diet pills? Phentermine was designed or the morbidly obese who were on the brink of dying from complications of weight and the toll it has taken on the body. You have these size 6's paying whatever it takes to keep their supply of diet pills coming. He deserved MUCH longer in the klink and should be made an example of. Next in line are the oxycontin pushers all over our area - when do they take a dose of their own medicine and spend time in an all-expenses paid vacation resort known as prison??? Everyone suffers - individuals, families, employers and co-workers with drug abuse.
NOT ENOUGH TIME for the CRIMES!
