CHARLESTON, W.Va. (WSAZ) -- A man is behind bars after allegedly trying to grab a 2-year-old girl from her mother.

Charleston Police responded Sunday night to an attempted kidnapping at the Exxon One Stop along Washington Street East.

Tara Canterbury says that she and her boyfriend, Scott Smith, took their 2-year-old daughter to the park and then decided to walk to the One Stop. That's when they noticed that Samuel Spain, 30, had followed them into the store.

"Every aisle I would go down there he was," Canterbury said. "Gut instinct just told me to pick her up. When I did, there he was in my face. I asked him, 'Do you have a problem buddy?' "

According to the criminal complaint, that's when Spain tried to grab the girl from her mother's arms. The girl's father stepped in and pushed Spain out of the store.

Police caught up with Spain a short time later.

According to the criminal complaint, when officers arrived on scene Spain told them, "I was going to get my daughter and take her to my wife's house."

However, when the officer asked his child's name Spain said he didn't know it, according to the complaint.

"She's not my child, but she called me dad, so I was going to take her home and my wife and I could raise her," Spain told the officer, according to the complaint.

"To actually see in paper that he wanted to take her home and raise her, it just makes my skin crawl, it makes me sick," Scott Smith said.

During Spain's arrest, police say he struck the officer with his fist in the shoulder area. Police say the officer had to pin him to the ground to handcuff him.

"I always thought, if they're with their mom or in plain sight, they're safe and they're not, and that's what scares me to death," Canterbury said.

Spain is charged with attempted kidnapping, battery on an officer and obstructing an officer.

MrObvious, Apparently things are not as obvious to you as you think they are. You need to learn to read. I AGREED that he needed to be in a mental institution, however, the state did away with them! Maybe you should do your reasearch into the WV mental health and prison systems before offering an ignorant opinion.

I agree with ThisBabysFamMember, you really need to get facts straight before you start defening the sicko. He's not even married!!! The father did the right thing by just pushing the sicko out of the store because he could've ended up in jail and then the mother and little girl would've been left alone... then what would happen??? The sicko needs locked up for good- they all do. Thank all you for your support and understanding this has been hard on the entire family especially when the little girl saw the sickos picture on TV and said 'Mommy that's the man that tried to grab me'... No child should ever have to go through that.

Concerned, I'm ignorant? Because I think that this man needs to be in JAIL or a Mental Institution? The whole system is broken and you are making excuses for not only the psychopath but also the system. We do not need apologists. We need these nutjobs off the street. If you do not understand that or think that it is perfectly OK for this man to roam the streets, perhaps you are nuts too!
