Caffeine-Induced Insanity Played Role in Homicide, Closing Arguments Expected

NEWPORT, Ky. (AP) -- A northern Kentucky murder suspect maintains he remembers nothing about the day his wife was strangled with an extension cord in their bed.
Woody Will Smith testified in his own defense on Thursday and the Associated Press reports the defendant said he was so sleep deprived from drinking caffeinated beverages that he has no recall of the day.
Amanda Hornsby-Smith was killed in September 2009.
The defense claims statements Smith made to police that day are a false confession.
Closing arguments are expected on Friday.

NEWPORT, Ky. (AP) -- Jury selection begins this morning in the trial of a Kentucky man accused of strangling his wife who will claim excessive caffeine use in his defense.
33-year-old Woody Will Smith is poised to claim in court in Newport that the caffeine from sodas, energy drinks and diet pills left him so mentally unstable he couldn't have knowingly killed Amanda Hornsby-Smith in May 2009.
Opening statements are expected to begin around 1:30 p.m. EDT today.
A legal strategy invoking caffeine intoxication is unusual but has succeeded at least once before, in a case involving a man cleared in 2009 of charges of running down and injuring two people with a car in Washington state.
Prosecutors say their expert may testify there's no evidence Smith consumed the caffeine the defense claims left him without memory of crucial events.

NEWPORT, Ky. (AP) -- The murder trial of a northern Kentucky man has been postponed after his lawyer's claim that caffeine figured into the strangulation death of the defendant's wife.
The Kentucky Enquirer reported prosecutors want time to run tests on pills and drinks they were given only last week.
The trial of Woody Smith was to have begun Monday, but has been set over to begin Aug. 30 in Newport.
The defense claims Smith was in state of caffeine-induced insanity because he took diet pills that contain caffeine and consumed an energy drink.
Smith is accused of killing 28-year-old Amanda Hornsby-Smith in May 2009 in the couple's Dayton home by strangling her with an extension cord.

The next thing you know he will be suing the energy drink manufacturer for not labeling a warning that "this drink - when consumed in excess - may cause you to murder your wife with an extension cord". I just read in the Charleston newspaper that an attorney is suing Nike because she tripeed while wearing flip flops that they manufactured and broke her ankle. It's no wonder I want to go home after work and just close my drapes!!
this is so stupid. years ago I took diet pills and drank alcohol ( I don't recommend this) on top on them and I haven't killed anyone or had the desire too. my husband is even still in this world after 41 years and he has been a pain in the neck for most of those years. this lawyer should excuse himself from the case because of his own stupidity. this guy just happens to trip over the extension cord and says "hey I think I need to kill my wife to day because I have had too much caffeine. get real.
If that's the best excuse he can come up with it's a good thing i'm not on the jury.
