Tentative Settlement Reached in MU Grade Change Controversy
Marshall University and the daughter of state Treasurer John Perdue have reached a tentative settlement over her lawsuit claiming the school and a professor violated her privacy by releasing information about her grades.

HUNTINGTON, W.Va. (AP) -- Marshall University and the daughter of state Treasurer John Perdue have reached a tentative settlement over her lawsuit claiming the school and a professor violated her privacy by releasing information about her grades.
State Board of Risk and Insurance Management Director Chuck Jones told a reporter Wednesday that Emily Perdue's attorneys have agreed to dismiss the lawsuit in exchange for an $81,250 settlement.
Emily Perdue filed the lawsuit in July, claiming she suffered emotional distress and harm by the leaked information.
Jones said the parties agreed to the settlement Tuesday but it would take several days before it would be finalized.
John Perdue's spokesman had no comment. A Marshall spokesman was not available Wednesday.

HUNTINGTON, W.Va. (WSAZ) -- After intense scrutiny and a federal investigation into her father's role in her grade change at Marshall University, Emily Perdue is suing the university and the professor she says violated her rights.
This all comes just months after a grand jury hearing failed to lead to charges against West Virginia's State Treasurer John Perdue.
The investigation seemingly focused on whether the treasurer used his influence and power to get his daughter's grades changed.
The current lawsuit is a civil suit that was filed in Cabell County Circuit Court. It's four pages long and details violations of privacy, university policy and personal pain and suffering.
In the suit, Emily Perdue seeks legal action against the Marshall University Board of Governors and her professor Dr. Laura Wyant. Emily says both improperly released her grades and violated her privacy.
Emily also complained Marshall University failed to take any corrective action once her privacy was violated.
In the end, Emily says she suffered emotional distress and harm, had to quit her job because of continuing harassment, had to move at great expense, lost her financial aid in completing her education at another school and suffered overall great embarrassment.
A little background -- last fall, Wyant made a public complaint to the university after two grades of incomplete she gave Emily were changed to A's by former Dean Rosalyn Templeton. Templeton has since left the university and is now the provost and vice chancellor at Montana State-Northern.
Wyant alleged Templeton inappropriately assumed supervision for Emily's coursework after a private meeting with Emily's parents, including her mother Robin Perdue.
That's when the federal investigation was launched into whether John Perdue abused his power. Wyant testified at a federal grand jury hearing, but no charges were ever filed. In a news conference after that, John Perdue said the only thing he was guilty of was being a good parent and trying to help his daughter through the educational process.
In the end, Emily is asking for damages for pain and suffering, as well as attorney fees.
We spoke to Wyant Wednesday afternoon about the suit. She says she is not surprised by it, but feels confident she's innocent of all charges made.
The university says they are aware of the suit and have directed it to their attorneys.

HUNTINGTON, W.Va. (AP) -- Marshall University's Board of Governors and a professor are being sued by the daughter of West Virginia Treasurer John Perdue.
Emily Perdue's lawsuit claims her right to privacy was violated by the unauthorized release of personal information and a transcript of her grades to third parties.
The lawsuit filed Friday in Cabell County Circuit Court names the Marshall board and Perdue's former professor, Laura Wyant, as defendants.
Marshall spokesman Matt Turner said the university doesn't comment on pending litigation.
A controversy erupted last year over a decision by a Marshall dean to work with Emily Perdue, after she received incomplete grades from Wyant. Wyant alleged that school administrators mishandled the matter.
