4th Lawsuit Filed Over Fatal Explosion

BECKLEY, W.Va. (AP) - A part-time firefighter injured in a convenience store explosion that killed four people has filed a 20 million dollar lawsuit.
Donnie Ray Caldwell's lawsuit was filed last week in Raleigh County. It's the fourth lawsuit stemming from the January explosion of a propane tank that leveled the Little General Store in Ghent. Four other people were injured.
Caldwell's lawsuit contains similar allegations to those in the earlier cases. Those alleged that the store and Godfather's Pizza, which had a restaurant in the store, were negligent for not providing a safe workplace.
The lawsuits also accuse several propane suppliers of being careless when transferring propane from one tank to another and failing to adequately train employees.
The defendants in all four lawsuits are Little General, Godfather's Pizza, BP America, Appalachian Heating, Thompson Gas Propane Partners, Ferrell Gas, unnamed landowners and unnamed distributors and manufacturers of propane and propane equipment.
A BP spokeswoman declined comment. None of the others immediately returned phone calls.
