UPDATE 3/8/11 @ 5:30 p.m.
CHARLESTON, W.Va. (WSAZ) -- A former Charleston police captain accused of stalking and harassing two women will stand trial before two separate juries.
Myron White originally faced four different charges, but now he's only facing three.
White appeared Tuesday in court with his attorney to argue some of the charges.
One of the women filed two complaints that White was stalking her. She claims he even threatened to kill himself if she didn't go out with him.
Another woman claims White also stalked her and took pictures of her sitting in her car. The judge on Tuesday dismissed that charge.
The same woman accused him of battery for grabbing her shoulders. The defense says there's nothing unlawful about it, but prosecutors disagree.
“The complaint clearly says that he grabbed the victim by the shoulders from behind,” Dan Holstein, Kanawha County assistant prosecutor, said. “She turned around, saw him there with a big grin on his face and what does she do? She immediately steps back and steps to the side so that somebody else's body is between her and the defendant."
The judge sided with the state, saying there is enough probable cause for the battery charge.
It was also decided Tuesday that, since this involves two different women, there will be two separate trials. The first trial is set for May 11.
ORIGINAL STORY
CHARLESTON, W.Va. (WSAZ) -- An internal investigation involving a Charleston Police Captain has now turned into a criminal probe.
In May, a conduct complaint was filed against Captain Myron White.
Charleston Police Chief Brent Webster says an internal investigation was launched and Capt. White was put on paid administrative leave. He was an investigator in the professional standards unit.
Chief Webster says that new information has lead the department to begin a criminal investigation into the complaint.
Webster says the department can not comment on the details surrounding the complaint.
Charleston Police Sgt. Eric Hodges is in charge of the criminal investigation. The internal investigation is still ongoing.
In Capt. White's absence, Sgt. Autumn Davis will now serve in the professional standards division.

Lock it up and throw the key away.
This is laughable. Glad to see this going to a jury trial! Lets get these two "ladies" on the stand and see what they have to say for themselves... and let the public hear more of the story. The tru story behind the scenes is a corrupt Charleston PD clinging to some measly complaint that would have been swept under the rug if it had been on any other officer. Instead, they take it, add more to it, and use it to force a 30 yr veteran on the Dept into retirement for the betterment of the Chief and his "good ol boys" club. Since when is tapping someone on the shoulder and saying "excuse me", insulting and provoking?? What a crock!!
Sounds like the trial is a waste of time and tax payer money to me. Really, this is the biggest problem that the Charleston police department has?
