Accused Bank Robber Proves He's Not Guilty

LOGAN, W.Va. (WSAZ) -- Paying the time without committing the crime -- a young man's life was turned upside down when he was arrested for something he didn't do.

“My parents didn't have enough room for everything I had, so I had to sell a lot of it,” Billy Fox said.

What Fox was able to keep, he has crammed inside his parents' house. He, his wife and their 18-month-old little girl live there now. It was all they could do after Fox lost his job, because he was arrested.

“I opened my door and had a bunch of guns in my face,” Fox said. “They put me on the ground -- handcuffed me.”

Accused of robbing a bank the day before, Fox spent an entire week in jail.

“They completely go the wrong guy. He's totally innocent,” Tim DiPiero, Fox’s attorney, said.

Here’s the proof: the bank in Flatwoods, Ky., was robbed June 18. Fox was in Flatwoods that day and was also in a bank -- about 30 minutes away from the one that was robbed.

It takes at least two and a half hours to get from Flatwoods to his home in Amherstdale, W.Va. Half a dozen witnesses saw him back in Amherstdale an hour after the robbery.

As for hard evidence, records show his debit card was used back in Amherstdale less than two hours after the robbery.

“We were able to go to the bank and establish that there was only one credit card (one debit card), and it was used in Kentucky and West Virginia, so no one else could have used it,” DiPiero said.

Charges against Fox were dismissed, but his life hasn’t been easy.

“I lost everything I had,” Fox said. “Coming from someone who ain't never had a parking ticket, I never thought I’d get blamed for something like this.”

Fox was able to get his job back and is saving up to try to get another home. His attorney is also seeking help with the victim's crime fund to see if he can be compensated for his losses.

In the meantime, Fox and his family say they just want his name cleared and for everyone to know he is not a bank robber.
