UPDATE: Three Indicted in Connection With Election Day Double Murder in Huntington

HUNTINGTON, W.Va. (WSAZ) –Three people have been indicted in connection with that double murder in Huntington on Election Day.

The November 6 shootings happened at a house in the 1900 block of Foster Avenue.

Darrell Fuqua, 22, of Detroit, died at the scene. Devonte Penn, 17, of Detroit, died about 10 days later at a Huntington Hospital.

Police arrested Rocky Williams, 19, of Huntington, and Thomas White, 21, of Huntington for the murders.

Wednesday, a Cabell County Grand Jury indicted Williams and White for the murders. Williams was also charged with 7 counts of possession with intent to deliver a controlled substance and 1 count of carrying a concealed deadly weapon.

Also indicted, Charity Cornel, 35, who lived in the house where the shooting happened. She was charged with maintaining a known drug house.

HUNTINGTON, W.Va. (WSAZ) – One of the two men charged in a double murder in Huntington on Election Day was back in court Tuesday to ask that his bond be reduced.

Rocky Williams, 19, of Huntington, is charged with the murders of Darrell Fuqua, 22, and Devonte Penn, 17, both of Detroit. The shooting happened at a house on Foster Avenue.

During a hearing in Cabell County Circuit Court, Williams’ attorney asked that his bond be reduced, saying the charges should be malicious wounding not murder.

His attorney, Jason Goad, told the court that Mr. Williams was sitting down stairs with another individual when his co-defendant, Thomas White came down the stairs bleeding from a gunshot wound. He said Williams panicked and ran out while firing backwards.

The judge denied the request

Thomas White, 21, of Huntington, is also charged with two counts of murder during commission of a felony in the same shootings.

Both Williams and White are being held without bond in the Western Regional Jail while the case goes to a grand jury.

HUNTINGTON, W.Va. (WSAZ) -- The case against a second man charged with a double murder in Huntington on Election Day is now headed to the grand jury.

Thomas White, 21, of Huntington, had his preliminary hearing Tuesday morning in Cabell County Magistrate Court in Huntington.

White is charged with two counts of murder during commission of a felony. Following testimony, a magistrate found probable cause to send the case to a grand jury.

Rocky Williams, 19, of Huntington, was arrested shortly after the shootings and is also charged with two counts of murder.

On November 6, Huntington Police responded to a shooting at a house on Foster Avenue.

Darrell Fuqua, 22, of Detroit, died at the scene. Devonte Penn, 17, of Detroit, died about 10 days later at a Huntington Hospital.

Shortly after the shooting, White showed up at Cabell Huntington Hospital with a gunshot wound. On November 13, White was released from the hospital and immediately arrested and charged with the two murders.

Williams had his preliminary hearing last week and his case was also bound over to the grand jury.

Police say the murders began as an attempted robbery.

HUNTINGTON, W.Va. (WSAZ) -- Saying that Tuesday was a tough day for Debra Williams would be an understatement.

“That's my only son,” Williams said. “It hurts. It really does.”

Her son, Rocky Williams, is charged with two counts of murder.

Rocky Williams and fellow suspect Thomas White are accused of shooting and killing two men inside a Huntington drug house last week.

At Rocky Williams’ preliminary hearing Tuesday afternoon, Huntington Police Detective Chris Sperry said he believes it started out as a robbery.

“They had made a plan together, the two individuals, before they arrived at the residence to get the dope,” Sperry said.

But that robbery went drastically wrong. Sperry says the problems began while White was upstairs. A teenage girl who lived in the house witnessed the whole thing.

“She said she heard some arguing,” Sperry said. “Heard some gunshots. And she ran into the bedroom, to her mother, called 911. Which her mother was asleep.”

Police say Darrell Fuqua died from those gunshots. But that wasn't the end of the bloodshed.

“He already had his gun out ... Had it right here ... Sitting on the couch,” Sperry said. “He said when he heard Mr. White coming down the stairs, he got up and as he ran out the door: Pow, pow, pow, pow”

Devonte Penn was hit by those shots. He was losing blood quickly when he told police what happened.

“He said Rocky is the one that shot me and he's got a big mole on his face,” Sperry said. “Soon after that, he coded.”

Penn was kept on a ventilator until this weekend when he also died. Rocky Williams and Thomas White were arraigned Tuesday on murder charges in connection with the deaths of Penn and Fuqua.

“I want everyone to know out there, I'm sorry for what happened,” Debra Williams said. “There's nothing I can do to take it back.”

Bond was denied for both suspects. Williams’ attorney says the shots he fired were in self defense.



UPDATE 11/13/12 @ 1 p.m.
HUNTINGTON, W.Va. (WSAZ) -- Huntington Police have made a second arrest in a double murder that happened last week.

Tuesday, Huntington Police arrested Thomas M. White, 21, of Huntington, and charged him with two counts of felony murder.

White was arraigned on Tuesday afternoon. He is being held without bond and is scheduled to be back in court next week for a preliminary hearing.

The shooting happened last Tuesday on Foster Avenue. White had been in the hospital since the shooting.

During Williams' preliminary hearing Tuesday morning, Detective Chris Sperry testified that police believe, after speaking with doctors, that Thomas White shot himself. He showed up to the arraignment Tuesday in a wheelchair and hospital gown, barely able to move.

Darrell Fuqua, 22, of Detroit, died at the scene. Devonte Penn, 17, of Detroit, died Sunday at a Huntington Hospital.

Rocky Williams, 19, of Huntington was arrested shortly after the shooting and charged with Fuqua's murder.

During his preliminary hearing Tuesday morning, Williams was also charged with Penn's death.

Charity Cornell, 35, lived at the house where the shooting happened. Police charged Cornell with maintaining a dwelling for the purpose of allowing the use or sale of drugs.

According to the criminal complaints, Williams told police that he and White conspired to commit a robbery at the residence and during the incident Fuqua was shot and killed.

More charges could be filed in the case once it is presented to the grand jury.

HUNTINGTON, W.Va. (WSAZ) -- A second person has died in connection with a shooting in Huntington on Election Day.

Huntington Police say Devonte Penn, 17, of Detroit, died Sunday at St. Mary’s Medical Center the result of a single gunshot wound.

The shooting happened at 1939 Foster Avenue about 10:30 a.m. last Tuesday.

Darrell Fuqua, 22, of Detroit, died at the scene. Thomas White, 21, of Huntington, was also injured in the shooting. He showed up at Cabell Huntington Hospital with a gunshot wound. At last word, White remained in the hospital. His condition is not available.

Rocky Hudson Williams, 19, of Huntington was arrested last week and charged with one count of murder in the commission of a felony.

His preliminary hearing is set for Tuesday.

Charity Cornell, 35, lived at the house where the shooting happened. Police charged Cornell with maintaining a dwelling for the purpose of allowing the use or sale of drugs.

According to the criminal complaints, Williams told police that he and White conspired to commit a robbery at the residence and during the incident Fuqua was shot and killed.

There is no word on how Penn or White were shot.

Police also said that evidence obtained inside the house indicates extensive drug use and possession of narcotic medications. They also said that multiple people were staying at the house.

Williams is being held without bond.

HUNTINGTON, WVa. (WSAZ) -- The family of one of the two people arrested following a murder on Tuesday has issued a statement about the shooting that left one man dead and two other wounded.

Rocky Hudson Williams, 19, of Huntington, is charged with murder in the commission of a felony.

Huntington Police say Darrell Fuqua, 22, of Detroit, died in the shooting at 1939 Foster Avenue about 10:30 Tuesday morning.

Thomas White, 21, of Huntington and a 17-year-old male from Detroit were injured.

The teen was taken from the house by ambulance to St. Mary’s Medical Center where police said he was in very serious condition.

White showed up at Cabell Huntington Hospital with a gunshot wound. Police said his injuries were serious, but he was expected to survive.

Charity Cornell, 35, lived at the house in the 1900 block of Foster Avenue where the shooting happened. Police charged Cornell with maintaining a dwelling for the purpose of allowing the use or sale of drugs.

Wednesday night Cornell’s family issued the following statement.

"It is with a heavy heart that I am preparing this statement. My family is saddened by Tuesday’s events and we are praying for the families of each victim. Charity was given every opportunity to succeed in life and she has chosen a life of drugs and dishonesty. I pray that everyone responsible in this case is brought to justice quickly and that they receive the punishment they deserve. Drugs have plagued an entire generation of people from eastern Kentucky and West Virginia, and those proven guilty of such crimes deserve all that the law can deliver."

According to the criminal complaints, Williams told police that he and White conspired to commit a robbery at the residence and during the incident Fuqua was shot and killed.

There is no word on how White or the juvenile were shot.

Police also said that evidence obtained inside the house indicates extensive drug use and possession of narcotic medications. They also said that multiple people were staying at the house.

HUNTINGTON, W.Va. (WSAZ) -- A man and a woman have been arrested in connection with a shooting that killed a Detroit man and wounded two other people Tuesday morning.

Huntington Police say Darrell Fuqua, 22, of Detroit, died in the shooting at 1939 Foster Avenue about 10:30 Tuesday morning.

Thomas White, 21, of Huntington and a 17-year-old male from Detroit were injured.

The teen was taken from the house by ambulance to St. Mary’s Medical Center where police said he was in very serious condition.

Tuesday night, police charged Rocky Hudson Williams, 19, of Huntington, charged with felony murder.

Charity Dawn Cornell, 35, of Huntington, is charged with maintaining a dwelling for the purpose of allowing the use or sale of drugs.

Both people are in the Western Regional Jail awaiting arraignment on the charges.

Police have not released a motive for the shooting. They say the investigation is continuing.

HUNTINGTON, W.Va. (WSAZ) -- One person is dead and two have been injured following a shooting in Huntington.

According to a press release, one of the men that was injured during the shooting has been identified as a 17-year-old from Detroit, Michigan.

The shooting happened at 1939 Foster Avenue just after 10:30 Tuesday morning.

Police say they went to the neighborhood to investigate a shots fired call.

According to the release, one person was pronounced dead at the scene, one of the victims was transported to St. Mary's Medical Center and the Huntington Police Department was notified that the third victim showed up at Cabell Huntington Hospital with a gunshot wound.

No motive has been established at this time.

No word on the condition of the two people who were wounded.

The investigation is ongoing and investigators are conducting interviews and collecting evidence.

The shooting happened in the 1900-block of Foster Avenue just after 10:30 Tuesday morning.

Police say they went to the neighborhood to investigate a shots fired call.

Lt. John Williams tells WSAZ.com that one person was killed and two others wounded in the shooting.

Our crew at the scene saw one person being loaded into an ambulance and taken to the hospital.

Another of the victims showed up on their own at the hospital.

No word on the condition of the two people who were wounded.

At this time, police are not releasing any information on a motive, or the names of the victims.

Chief Skip Holbrook says the investigation continues. He expects to release more information later today.

We're told several people are being questioned at this hour.
