UPDATE: Suspects in Elliott County Murder Back in Court

ELLIOTT COUNTY, Ky. (WSAZ) -- A man and woman from Sandy Hook, Ky., charged with the murder of Earl Ray Adkins were back in court Tuesday.

In October 2011, an Elliott County Grand Jury indicted Bobby Gilliam, 31, and Melinda Applegate, 27, on charges of murder, first-degree robbery, first-degree burglary and tampering with physical evidence.

Adkins was found shot to death Oct. 2 outside his home in Sandy Hook. No murder weapon has been found in the case.

Tuesday, in Elliott County Circuit Court, DNA evidence, ballistic results and autopsy photos were presented to the court for further review during a pre-trial hearing.

A special prosecutor will be assigned to the case.

Right now their trials are set for September 17.

Gilliam and Applegate both remain in the Big Sandy Regional Detention Center.

ELLIOTT COUNTY, Ky. (WSAZ) -- A man and woman from Sandy Hook, Ky., were indicted Tuesday for their roles in the murder of Earl Ray Adkins.

Kentucky State Police say an Elliott County Grand Jury indicted Bobby Gilliam, 31, and Melinda Applegate, 27, on charges of murder, first-degree robbery, first-degree burglary and tampering with physical evidence.

Adkins was found shot to death Oct. 2 outside his home in Sandy Hook.

Gilliam and Applegate both remain in the Big Sandy Regional Detention Center.

They will be back in court on Monday.

SANDY HOOK, Ky. (WSAZ) -- Earl Ray Adkins was found shot to death outside his home in Sandy Hook on Sunday. The two people connected to the murder case were in court Thursday.

Bobby Gilliam is charged with capital murder. Melinda Applegate faces burglary, robbery and tampering with evidence charges. Bond was revoked for Gilliam. As it was being set for Applegate, at $1 million, Mr. Adkins family was preparing for his funeral.

On one end of town, family and friends of Earl Ray Adkins were dealing with grief. On the other end of Sandy Hook, Ky., they were hoping for some justice.

"I'd like to see justice done,” said Gary Adkins, Earl Ray’s brother. “I'd like to see them get the death penalty. They deserve to die."

Only one of the suspects would actually qualify for execution. Gilliam faces capital murder charges, punishable by death. Police say he shot Mr. Adkins in the back of the head outside his home in Elliott County. His next door neighbors, lifelong friends, found his body.

"I want to see justice served,” Bill Conley said outside the downtown courthouse. “The only thing going through my mind is, I wish I would have been there for my buddy. Then we maybe wouldn't be going through this interview."

Regret is only natural, but even as the wheels of justice turn in the courtroom, there's still the matter of a funeral and all the overwhelming emotion that goes along with it.

"He was a good man,” Amy Kidd said about her uncle. “He didn't do anything that deserved for him to be murdered."

SANDY HOOK, Ky. (WSAZ) -- The man and woman arrested following the murder of an Elliott County man were in court Thursday morning, just hours before the victim’s funeral.

Earl Ray Adkins, 48, was found shot to death outside his house in Sandy Hook Sunday morning.

Sunday night, police arrested Bobby Gilliam, 31, of Sandy Hook, in Clinton County, Ohio. He is now back in Elliott County where he is charged with capital murder

Melinda Applegate, 27, of Sandy Hook, was arrested following an interview with State Police detectives Tuesday afternoon. Applegate is charged with first-degree burglary, first-degree robbery, and tampering with physical evidence.

Both Gilliam and Applegate were arraigned in Elliott County District Court Thursday morning.

Gilliam was denied bond after prosecutors told the court that he refused to be interviewed about the murder. The judge set Applegate’s bond at $1 million.

Both will be back in court next week.

The victim’s brother tells WSAZ.com that Earl was shot in the back of the head. Neighbors say they found Earl’s body behind the house near a wood pile.

They also say that Gilliam and Applegate lived over the hill from Adkins, and that they had only been living there for about six months. The Elliott County Prosecutor's Office tells WSAZ.com that Gilliam moved to the area from Ohio and has family ties to eastern Kentucky. They say Applegate does not have any family ties to the area.

Adkins' funeral is set for late Thursday morning.

SANDY HOOK, Ky. (WSAZ) -- A second person has been arrested in connection with the murder of an Elliott County man.

Kentucky State Police arrested Melinda Applegate, 27, of Sandy Hook, following an interview with detectives Tuesday afternoon.

Troopers say Applegate made statements in that interview that implicated her in the murder of Earl Ray Adkins.

Adkins, 48, was found shot to death outside his house in Sandy Hook Sunday morning.

Bobby Gilliam, 31, was arrested Sunday afternoon in Clinton County, Ohio on a fugitive from justice warrant.

Gilliam waived extradition, and was returned to Elliott County Tuesday. He is now in the Big Sandy Regional Detention Center. Gilliam is charged with Capital Murder.

State Police charged Applegate with first-degree burglary, first-degree robbery, and tampering with physical evidence. She is being held at the Big Sandy Regional Detention Center.

SANDY HOOK, Ky. (WSAZ) -- A man charged with the murder of a Sandy Hook man has waived extradition during a hearing in Clinton County, Ohio, according to jail officials.

Kentucky State Police say 31-year-old Bobby Gilliam, of Sandy Hook, was arrested Sunday afternoon in Clinton County on a fugitive from justice warrant.

Troopers plan to charge Gilliam with the shooting death of 48-year-old Earl Ray Adkins.

Adkins’ body was found outside of his house along State Route 650, in Sandy Hook, just after 10:15 Sunday morning.

Besides the murder charge, Gilliam is expected to face additional charges of robbery, burglary and tampering with evidence.

KSP has not released a motive for the shooting. They don’t believe the two men knew each other.

Jail officials in Clinton County tell WSAZ.com that troopers have until Thursday to return Gilliam to Elliott County.

Troopers plan to go to Ohio on Tuesday to pick him up.

SANDY HOOK, Kentucky (WSAZ) -- Kentucky State Police are investigating the murder of a man from Elliott County.

The body of 48-year-old Earl Ray Adkins was found outside of his house along State Route 650 in Sandy Hook just after 10:15 Sunday morning.

Troopers say Adkins died of a gunshot wound.

A warrant was issued for 31-year-old Bobby Gilliam of Sandy Hook.

Gilliam was arrested in Clinton County, Ohio Sunday afternoon.
He's being held as a fugitive from justice.

Gilliam is expected to face charges of murder, robbery, burglary and tampering with physical evidence when he is returned to Kentucky.

Kentucky State Police tell WSAZ.com investigators are in the process of making contact with the suspect to get more information about a possible motive.

Investigators are not releasing any details about who discovered the body or what may have been stolen that led to the robbery and burglary charges.
