UPDATE: Jury Finds Father Guilty in Baby Murder Case

PORTSMOUTH, Ohio (WSAZ) – A jury has found a Portsmouth man guilty in the death of his 10-month-old son.

Neylan Wilson died at a Columbus Hospital back in November.

After deliberating about three hours, the Scioto County Common Pleas Court jury found Brandon Wilson, 23, guilty of murder and endangering children. Wilson was found not guilty of aggravated murder.

Investigators say on November 19 they got a call from Nationwide Children’s Hospital in Columbus, Ohio, about an infant they were treating for life-threatening injuries, including a skull fracture. Neylan died the next day at the hospital.

Wilson testified during the trial that he shook the baby in an attempt to revive him. He said the infant began having trouble breathing hours after falling off a couch, Wilson said, and he thought the baby was going into seizures.

Wilson was sentenced to 15 years to life on the murder conviction, and three years on the endangering children conviction. He will be eligible for parole in 18 years.

PORTSMOUTH, Ohio (WSAZ) -- The jury is now deliberating in the case of a man accused of killing his 10-month-old son.

Brandon Wilson, 23, is charged with aggravated murder, murder and endangering children in connection with the death of Neylan Wilson. The 10-month-old died at a Columbus Hospital back in November.

After closing arguments Tuesday morning, the jury got the case around 12:45 p.m.

Wilson's trial began last week. Neylan's mother testified, and Brandon Wilson also took the stand in his own defense.

Wilson told the jury he shook the baby in an attempt to revive him. The infant began having trouble breathing hours after falling off a couch, Wilson said, and he thought the baby was going into seizures.

He said he stepped out on the porch to smoke a cigarette, leaving Neylan asleep on the couch and his 3-year-old sister watching television. The baby, he said, had been sick that day. When Wilson came back inside, he found the baby on the floor. After checking him over for injuries, he said he paced back and forth, holding the child to console his cries.

Later, Wilson testified that the baby threw up after drinking part of a Pedialyte bottle. That night, after the baby was in bed, Wilson said he heard Neylan struggling to breathe. He said the baby's body was limp and lifeless, and that was when he shook the baby to try to help him breathe.

PORTSMOUTH, Ohio (WSAZ) -- The trial for a man charged with murder in the death of his 10-month-old son is coming to an end after he took the witness stand Monday to explain what happened that November night.

Investigators say on November 19 they got a call from Nationwide Children’s Hospital in Columbus, Ohio, about an infant they were treating for life-threatening injuries, including a skull fracture. The baby, Neylan Wilson, died the next day at the hospital.

Brandon Wilson, 23, testified Monday in Scioto County Common Pleas Court, saying he shook the baby in an attempt to revive him. The infant began having trouble breathing hours after falling off a couch, Wilson said, and he thought the baby was going into seizures.

The defense questioned Wilson on specific details about the night of November 18 to clarify what he meant when he told a detective he shook baby Neylan. Wilson described the entire night in detail.

He said he stepped out on the porch to smoke a cigarette, leaving Neylan asleep on the couch and his 3-year-old sister watching television. The baby, he said, had been sick that day. When Wilson came back inside, he found the baby on the floor. After checking him over for injuries, he said he paced back and forth, holding the child to console his cries.

"I was in our kids' room, I was trying to arouse Neylan, [and] that was when I was shaking Neylan," Wilson said Monday in court. "I was trying to get him to just stop doing what he was doing. I was trying to get him to respond to me. I wasn't trying to hurt him in any way, shaking him the way I was shaking him. I was freaking out."

The prosecution questioned Wilson about his record and past rather than the night in question. That record includes a number of arrests -- mostly misdemeanors like disorderly conduct, but also domestic violence charges and skipping out on probation in Las Vegas.

Wilson also testified that he had abused pills and other drugs in the past. He said he no longer uses any of them, with the exception of marijuana. He said that on the morning of November 18, he had smoked a small amount of marijuana.

Both sides are expected to give closing arguments Tuesday morning. The jury will decide whether to convict Wilson on the charges of aggravated murder, murder and endangering children.

The defense has said there was "no intentional injury" leading up to the baby's death.

"Did my client injure this baby? The answer is no -- he loved the baby," defense attorney Franklin Gerlach said.

PORTSMOUTH, Ohio (WSAZ) -- Testimony got underway Monday afternoon in the murder trial of a Portsmouth man charged with the death of his 10-month-old son.

23-year-old Brandon Wilson is charged with aggravated murder, murder and endangering children in connection with the death of Neylan Wilson back in November.

Investigators say on November 19 they received a call from Nationwide Children’s Hospital in Columbus, Ohio, concerning an infant they were treating for several life-threatening injuries including a skull fracture. Neylan died the next day at the hospital.

Monday afternoon jurors visited the apartment in Wheelersburg where the alleged incident happened. They then returned to court for opening statements and testimony from the prosecution’s first witnesses.

The defense says the baby's death was simply an accident.

"Our defense is this was an accidental fall off of a couch," Franklin Gerlach, Wilson's attorney, said. "Eventually the child went into seizures, was rushed to Southern Ohio Medical Center, then on to Children's Hospital. There was no intentional injury of this child."

During Wilson's preliminary hearing, a detective testified that Wilson kept changing his story when questioned about the baby's injuries. Eventually, the detective said, Wilson admitted to shaking the baby.

During jury selection, both sides questioned potential jurors whether they had ever seen anyone have a seizure or whether they had ever been falsely accused of anything.

A Scioto County Grand Jury met last Friday and indicted Brandon Wilson, 23, of Portsmouth.

Wilson is charged with aggravated murder, murder and endangering children in connection with the death of Neylan Wilson.

Investigators say on November 19 they received a call from Nationwide Children’s Hospital in Columbus, Ohio, concerning an infant they were treating for several life-threatening injuries including a skull fracture. Neylan died the next day at the hospital.

During a recent preliminary hearing, Detective Jody Conkel testified that Wilson changed his story several times during questioning about how the infant was hurt, but she said he finally admitted to shaking his son.

No word when Wilson will be arraigned on the charges.

PORTSMOUTH, Ohio (WSAZ) -- A judge has found probable cause to send the case of a Scioto County, Ohio man charged with killing his 10-month-old son to a grand jury.

On Monday, the Scioto County Sheriff’s Office arrested 23-year-old Brandon J. Wilson of Portsmouth for the death of Neylan Wilson.

Investigators say on November 19 they received a call from Nationwide Children’s Hospital in Columbus, Ohio concerning an infant they were treating for several life-threatening injuries including a skull fracture. Neylan had been flown to their facility from the Southern Ohio Medical Center.

The next day, the hospital called to say the boy had died.

Wilson was in Portsmouth Muncipal Court Thursday morning for his preliminary hearing

Detective Jody Conkel testified that Wilson changed his story several times during questioning about how the infant was hurt, but she said he finally admitted to shaking him.

Following that testimony, the case was sent to a grand jury.

Wilson remains in the Scioto Count Jail in lieu of $500,000 bail.

SCIOTO COUNTY, Ohio (WSAZ) -- Brandon Wilson, 23, of Portsmouth was sitting in jail Tuesday night -- charged with murder. His alleged victim is just 10 months old.

"I can't get into details what he told us," Scioto County Sheriff's Capt. Dave Hall said. "He did give an explanation of shaking a child."

Scioto County Sheriff Marty Donini says this capped an ongoing investigation.

Detectives were first notified by Nationwide Children's Hospital on Nov. 19 that they were treating a 10-month-old boy for several life-threatening injuries, including a skull fracture.

The next day, 10-month-old Neylan Wilson died from his injuries.

Wilson is listed as the child's father. He and the victim's mother, Tierra Simeona, also have a 3-year-old child. But investigators are still unclear about the biological relationship between the suspect and victim.

"He's listed as the father on the child's birth certificate," Hall said. "But there's a chance someone else may be the biological father. The time frame doesn't add up. Wilson was incarcerated for some time."

Investigators say Wilson was released in early September after spending more than 120 days in jail on a probation violation.

Wilson is scheduled to be back in court at 10 a.m. Dec. 6.

PORTSMOUTH, Ohio (WSAZ) -- A Scioto County, Ohio man has been charged with murder in connection with the death of his 10-month-old son.

Detectives with Scioto County Sheriff’s Office arrested 23-year-old Brandon J. Wilson of Portsmouth on Monday for the death of Neylan Wilson.

Investigators say on November 19 they received a call from Nationwide Children’s Hospital in Columbus, Ohio concerning an infant they were treating for several life-threatening injuries including a skull fracture. Neylan had been flown to their facility from the Southern Ohio Medical Center.

The next day, the hospital called to say the boy had died.

During the investigation detectives learned that the baby had been living with his mother and Wilson at an apartment building in Wheelersburg.

On Monday, after autopsy results were completed, Wilson was brought in for questioning. After consulting with the Scioto County Prosecutor's Office he was charged with murder.

Captain Dave Hall would not go into the specifics, but said Neylan Wilson's injuries were consistent with him being shaken.

Wilson is being held in the Scioto County Jail without bond. His arraignment is set for Thursday in Portsmouth Municipal Court.

The Sheriff says more charges could be presented to the Scioto County Grand Jury on a later date.
