UPDATE: West Side Shooting Case Sent to Grand Jury

UPDATE 5/9/14 @ 5:25 p.m.
CHARLESTON, W.Va. (WSAZ) -- The case against two people connected to a shooting on Charleston's west side is moving forward.

Kenneth Gooden and Carlos Gray were in court Friday for a preliminary hearing.

They are charged with wanton endangerment connected to a shooting incident that happened last last month on Glenwood Avenue.

An innocent bystander was hit in the arm. The victim has been released from the hospital, but is still recovering.

A witness, who didn't want his face shown, testified that he saw Gooden and Gray participate in the shooting. The witness said, "I was looking straight down the street and after they fired a couple of shots, they ran straight at me."

A judge found probably cause in the case against both men and sent it to the grand jury.

This is the second time the men were charged in the case. Charges were dismissed last week after a magistrate said there was no probable cause. Police immediately refiled the charges.

CHARLESTON, W.Va. (WSAZ) -- It didn't take long for charges to be re-filed against two men accused in a shootout on Charleston's West Side.

During a hearing Thursday afternoon, Magistrate Tim Halloran said there was no probable cause in the case against Kenneth Gooden and Carlos Gray. He dismissed the charges of malicious wounding that the men were facing.

Charleston Police have re-filed the charges in the case and are going to the jail to re-arrest the men.

They will be taken to magistrate court to be re-arraigned on the charges. Both were arrested last week after a shootout on Glenwood Street in Charleston.

Craig Tolley, an innocent bystander, was hit by one of the bullets.

Larry Alderman was also arrested in connection with the case. He is charged with obstructing justice.

CHARLESTON, W.Va. (WSAZ) -- Charges have been dismissed against two men believed to be connected to a shoot out on Charleston's West Side.

Kanawha County Prosecuting Attorney Mark Plants tells WSAZ.com that Magistrate Tim Halloran cut a preliminary hearing short Thursday for Kenneth Gooden and Carlos Gray.

Maigstrate Halloran found no probable cause in the case and dismissed wanton endangerment charges against both men.

Both were arrested last week after a shootout on Glenwood Street in Charleston.

Craig Tolley, an innocent bystander, was hit by one of the bullets.

Plants says his officer strongly disagrees with the decision and they are working to re-file the charges.

Larry Alderman was also arrested in connection with the case. He is charged with obstructing justice.

All three men are from Detroit.

CHARLESTON, W.Va. (WSAZ) -- Three men from Detroit have been arrested after a shooting late Wednesday morning on Charleston's West Side.

Kenneth Gooden and Carlos Gray both are charged with wanton endangerment, and Larry Alderman has been charged with obstructing justice.

Police say all three men were involved in a shootout that took place just before noon on Glenwood Street in Charleston.

A group of people in a car and a group on the sidewalk opened fire on each other. Craig Tolley, an innocent bystander, was hit by one of the bullets.

"I was just scared," said neighbor Rose Simon. "I just thought someone was dead."

Simon heard the gunfire.

While the three men from Detroit claim they are strangers, police aren't buying it.

"It is odd that several males from Detroit, Michigan, who claim not to know one another, are all together at the scene of a shooting firing pistols," Charleston Police Lt. S.A. Cooper said.

Police are still looking for a charcoal-gray vehicle involved in the shooting. It sped away from Glenwood Avenue and Second Street. If you have any information, please contact Charleston Police.

CHARLESTON, W.Va. (WSAZ) -- A lockdown has been lifted at a Charleston elementary school after a shooting Wednesday.

The shooting happened just before noon on Glenwood Avenue, near the intersection of 2nd Street.

Police tell WSAZ.com a group of people in a car and a group of people on the street were shooting at each other. A man was caught in the crossfire and hit in the arm.

The victim was taken to the hospital.

Several people were detained at the scene, but no word at this time if any arrests have been made.

West Side Elementary School, which is nearby, was placed on lock down as a precaution, but that lockdown was lifted Wednesday afternoon.

CHARLESTON, W.Va. (WSAZ) -- Charleston Police are on the scene of a shooting on the city's west side.

The shooting was reported at 11:49 a.m. along Glenwood Avenue.

Charleston Police say a man was shot in the arm. Several people are in handcuffs at the scene of the shooting.

Police say there are several shell casings on the street near the corner of Glenwood Avenue and Simms Street.
