He did get 1-10 but was put on probation for 2 years instead. His next trial is in November, but his lawyer is trying to get an earlier one.

Posted by: Anonymous on Jun 25, 2009 at 01:20 PM
I suppose I am the last to know. I heard he got 1-10 years so is back in jail. I still heard there is a November trial.

Posted by: Anonymous on Jun 25, 2009 at 09:16 AM
Just didn't pay the weekly home confinement fee of $50. He tried getting a job but with his record no one would hire him (even fast food). Same judge. Just put him back in because of not paying the fees.

Posted by: Anonymous on Jun 24, 2009 at 09:02 AM
Did he break home confinement rules or did a new judge not approve of the home confinment?

Posted by: Anonymous on Jun 11, 2009 at 08:55 AM
Thanks, I really feel sorry for everyone involved but maybe this is the best for his kids. I know he really loves them.

Posted by: Anonymous on Jun 10, 2009 at 02:31 PM
The father had gall bladder surgery. James will be in jail until November until his next hearing. Its crazy how are court system works. Home Confinement is $50 a week. It costs $70 a day to house an inmate.

Posted by: Anonymous on Jun 9, 2009 at 02:52 PM
Does anyone know what his sentence is?

Posted by: Anonymous on Jun 9, 2009 at 09:05 AM
It must have been a false alarm. His dad is at home. Sorry to have worried you.

Posted by: Anonymous on Jun 4, 2009 at 03:04 PM
I heard he might have to have gall bladder surgery, but the last I heard was a few days ago.

Posted by: Anonymous on Jun 2, 2009 at 09:37 AM
What is wrong? I just spoke to his wife on Saturday and she didn't mention it he was in the hospital?

Posted by: Anonymous on May 31, 2009 at 02:27 PM
Father is in the hospital now. It is really a shame that his son cannot be at home to help out.

Posted by: Anonymous on May 28, 2009 at 09:48 AM
Home confinement is $50 a week. It isn't his parents job to take care of it. He got himself into it and he will have to get himself out. And again they do not have alot of money. The father is very sick.

Posted by: Anonymous on May 27, 2009 at 12:03 PM
Mom still works doesnt she?

Posted by: Obvious on May 22, 2009 at 09:38 AM
That you don't know his parents. They are on SS. They barely make ends meet.

Posted by: Anonymous on May 21, 2009 at 02:59 PM
He lives at home, why doen't mon and dad pay the fees.

Posted by: Not True on May 20, 2009 at 09:32 AM
He couldn't pay his home confinement fees so they put him back in jail. No one will give you a job when you are a felon. His fault, he done it to himself.

Posted by: Very Surprised on May 18, 2009 at 02:11 PM
It is a shame! Apparently he still had old charges against him. Might be the Chesapeake scam. He had such potential, its just terrible.

Posted by: Lil Suprised on May 14, 2009 at 02:15 PM
That this person is currently in jail for another pre-trial felony. Now what? I thought home confinement had him back on track. What a shame!

Posted by: Anonymous on Apr 9, 2009 at 09:27 AM
Toni, who cares if you can tell who we are. We are just stating what we feel. I notice you didn't state he was innocent.

Posted by: toni on Apr 8, 2009 at 02:27 AM
I am James sister. Other sister Toni I am with him 100% to back him if he needs me. Guess what, I have been reading this for months now and i can tell you who everyone of u guys are.

Posted by: Anonymous on Mar 24, 2009 at 11:23 AM
When you are on home confinement you have to get permission to leave. Like going to look for a job or to the doctor.

Posted by: Anonymous on Mar 16, 2009 at 01:20 PM
I called the Kanawha County circuit court and was told that this man is on home confinement, however, I have also been told that he was out with his mother the other day.

Posted by: Hopeful on Mar 9, 2009 at 10:01 AM
I hope that he is on home confinement if he is not in jail. You are drug tested while on home confinement. This is what he needs to get back on the right track.

Posted by: Anonymous on Mar 4, 2009 at 02:14 PM
Home confinement seems like such a small penalty after stealing from someone. Do you still have to stand trial for the Cheasepeak thief or did you get out of that one too.

Posted by: Anonymous on Feb 22, 2009 at 02:30 PM
Hi, Jimmy! Saw you recently guess your out of trouble

Posted by: Anonymous on Feb 13, 2009 at 03:57 PM
Well James. You've said you were innocent. Why haven't you visited this cite land let everyone know how your trial turned out?

Posted by: Anonymous on Feb 11, 2009 at 08:44 AM
Correction: I notice that you asked if Jesus would be proud. This isn't harrassment it is just trying to find out if there is a dangerous person in our life.

Posted by: Anonymous on Feb 9, 2009 at 09:14 AM

What was the outcome of the January 29 hearing? SOmeone must know. As he called his kids?

Posted by: Anonymous on Feb 3, 2009 at 09:50 AM
Don't know what happened, sure wish I did. Can anyone give us any information?

Posted by: Curious on Feb 1, 2009 at 09:24 PM
Does anyone know what happened at his court hearing on the 29th? Let's hope justice was served.

Posted by: Anonymous on Jan 29, 2009 at 10:55 AM
to "Laughing": Notice you didn't use your name either. Definitely "women", you must be a man. "Truly West Virginians": Spoken like a true "New Yorker". "Law suits?". don't think so, check the Kanawha County courthouse records, and Charleston's Most Wanted shows your picture.

Posted by: Anonymous on Jan 29, 2009 at 10:49 AM
Trial date today? It's the 29th. No one has come to get him? Why is he on home confinement? He's suffered so much? What about the victims he is accused of taking avantage of? Don't they deserve some kind of justice. They should at least be paid back the money they lost. How can you call on Jesus when the guilty person in this case sold from innocent people. Remember, three separate charges, 2 in Kanawha, 1 in Harrison. And, don't forget the charges in New Jersey.

Posted by: So Sorry on Jan 28, 2009 at 02:08 PM
He has suffered so much! We should really leave him alone. HA HA HA!

Posted by: PLEASE on Jan 28, 2009 at 10:40 AM
Why didn't you post your own name, JAMES!

Posted by: LAUGHING on Jan 27, 2009 at 05:46 PM
Hey folks, you people are truly west virginians and most diffently women. you all act like this guy killed someone the way you all love to gossip and provoke lies. Not one of you, have the backbone to even put your names behind your comments. But the last laugh will be on you all. You say he was hiding yet he lives with his mother for the last year ya'lls being saying who he was and where he lives but yet till this day no one has come to get him and u want to know why because this story is so incorrect, that a serious law suit is in the making, oh remember this, ya'll that are making these slanderous remarks are also going to have to answer for them. Defamation of character is a terrible thing and the law will persacute for it. And believe me we know who you all are. Leave the man alone hasn't he been through enough, or do you all think he should suffer the rest of his life, Do you all think Jesus is proud of your actions, if so then, I feel so sorry for ya'll on judgement day!

Posted by: Anonymous on Jan 20, 2009 at 11:24 AM
If he's really guilty, lets hope he doesn't get away with this.

Posted by: Anonymous on Jan 14, 2009 at 03:52 PM
Fifteen days until trail date.

Posted by: Anonymous on Jan 9, 2009 at 11:57 AM
If so its not the sister accusing him of theft, its the other one.

Posted by: Anonymous on Jan 8, 2009 at 11:32 AM
I wonder if Mrs. Burgess is his sister?

Posted by: Anonymous on Jan 8, 2009 at 10:17 AM
Do you know which case will be tried on January 29?

Posted by: Anonymous on Jan 5, 2009 at 11:38 AM
Hes out of jail but on home confinment. Trail day is Jan. 29

Posted by: Interesting on Jan 5, 2009 at 09:22 AM
Sounds like Mrs. Burgess is a friend of James. Sorry but he is guilty. His own sister pressed charges against him. He stole from her and she wasn't going to take it!

Posted by: Anonymous on Dec 29, 2008 at 04:25 PM
How can you know, "off the record" unless you were there?

Posted by: Anonymous on Dec 29, 2008 at 11:14 AM
MRs, Burgess. Guilty in the eyes of the court. Odd that there are charges in two states and two counties in WV. Everywhere he goes charges are pressed. That seems odd. You can only be proven guilty if there are witnesses. He's too smart to get caught. Hope he likes home confinement. If he were innocent why didnt he show up at his court hearings? He has two capious'. Funny, huh?

Posted by: Mrs. Burgess on Dec 26, 2008 at 12:09 PM
What ever happened to Innocent to proven guilty in the eyes of the court. And I also know for a fact that most of this off the record noncence is incorrect. So be very careful for what you may say, for one may feel a fool one day!!!!!

Posted by: Anonymous on Dec 23, 2008 at 02:38 PM
Oh No! He's out of jail. Look out more trouble to come.

Posted by: Anonymous on Dec 9, 2008 at 09:58 AM
Thanks for the info. Sure he would run if he got out of jail. Its just so sad.

Posted by: Anonymous on Dec 8, 2008 at 10:29 AM
According to him he will be in jail till his court hearing on Jan. 29th. No bond hearing has beens set for him. Probably due to the capious charges.

Posted by: Anonymous on Dec 8, 2008 at 09:15 AM
Understand this man was suppose to be in court in New Jersey two weeks ago. WIll he be expedited to there?

Posted by: Anonymous on Nov 21, 2008 at 10:43 AM
Apparently charges are for credit card fraud with capious charges. Harrison County charges are pettit larceny.

Posted by: Anonymous on Nov 19, 2008 at 11:50 AM
We tried to convince his mother to stop bailing him out. Such a shame. Now he's just in deeper trouble.

Posted by: Anonymous on Nov 18, 2008 at 01:59 PM
Apparently he was wanted in both Kanawha and Harrison County.

Posted by: Hopeful on Nov 13, 2008 at 01:59 PM
I hope he does get help while in jail. His children miss him so bad. Until he is clean he can not see them.

Posted by: Anonymous on Nov 12, 2008 at 03:10 PM
About being sick. Believe its made up, he should get help while in jail.

Posted by: Anonymous on Nov 12, 2008 at 08:57 AM
See that he has charges in both Kanawha and Harrison County. Does anyone know what he's in for?

Posted by: Week Later on Nov 11, 2008 at 11:28 AM
Yeah! He's still in Jail!

Posted by: Happy to Report on Nov 5, 2008 at 10:00 AM
That this person is currently in jail at South Regional. I hope he stays there for awhile and his mother doesn't bail him out. This is the best place for him right now.

When you seen him mowing the grass you should have called the cops! That would have been their chance to catch him.

Posted by: Anonymous on Jun 12, 2008 at 09:09 AM
Must not be hiding anymore. Mowed the grass last week. Looks like that 93 year old lady is not going to get her money back. What a shame!

Posted by: Anonymous on May 28, 2008 at 03:45 PM
Still looking for this guy? Doesn't the Charleston Police look at this site?

Posted by: Anonymous on May 22, 2008 at 11:46 AM
You saw him on Hanna Drive because he lives on York Avenue right off of Hanna Drive.

Posted by: Anonymous on May 21, 2008 at 10:27 AM
saw this guy on hanna drive

Posted by: Anonymous on May 12, 2008 at 10:46 AM
I found out of Friday that Charleston PD are still looking for him. I don't think they are looking hard enough though.

Posted by: Anonymous on Apr 15, 2008 at 01:36 PM
Eventually he will get caught. Don't give up. I am not. I feel that by him going to jail is the only way to get him the help he needs. His children miss him.

Posted by: Anonymous on Apr 11, 2008 at 09:45 AM
Wake up Charleston Police. The user fee is $2 a week. Thought this was for street repair and morepolice protection not traffic violation. Fight crime not, park along the street all day catching people going to work. You have the location, why don't you arrest him?

Posted by: Anonymous on Apr 4, 2008 at 01:52 PM
Saw response to idenity of Duff. Why haven't police responded to Smith? You've been told were he is.

Posted by: Anonymous on Apr 4, 2008 at 11:27 AM
Chesapeake PD is now looking for him; will just have to wait and see what happens. Eventually he will get caught. Once a theif always a thief!

Posted by: Anonymous on Apr 3, 2008 at 03:38 PM
I think that he must have either turned over evidence on someone else for a even serious crime such as drugs or something. Charleston PD surely would kave found him by know if they really cared and was really looking. There is more to this story than what is being told to us viewers here on WSAZ. It just shows how West Virginia's Justice system is corrupt and only worried about themselves.

Posted by: Anonymous on Apr 3, 2008 at 02:28 PM
If you read the article in the Sunday paper on the Chesapeake Elder Scam you will notice that this person is listed as an alleged suspect. What a shame!

Posted by: Anonymous on Apr 2, 2008 at 03:25 PM
We've told you were he is. Why can't you pick him up? Don't believe the parents.

Posted by: Anonymous on Mar 25, 2008 at 09:09 AM
Just because the car isn't in front of the house anymore doesn't mean he's not there. He's probably just hiding again.

Posted by: Anonymous on Mar 24, 2008 at 03:57 PM
Thanks for the info.

Posted by: Anonymous on Mar 24, 2008 at 09:50 AM
From what I have been told from his sister, that lives in New Jersey; he does have charges against him there. He allegedly stole from his own sister and allegedly received credit cards in here name. I say allegedly so that this can be posted.

Posted by: Anonymous on Mar 21, 2008 at 02:22 PM
Does this man have charges against him in New Jersey?

Posted by: Anonymous on Mar 19, 2008 at 12:53 PM
They just need to get a search warrant for his parent's home and go in and get him! His parents are obstructing the law.

Posted by: Anonymous on Mar 18, 2008 at 04:19 PM
There have been several thiefs in the neightborhood of this guy. How long is he going to be running around? Surely the police know he's hiding upstairs by now. He was home the other day when you came looking.

Posted by: Anonymous on Mar 17, 2008 at 09:28 AM
I know this person and I am sure he is hiding also. His parents are very willing to protect him; especially his mother. They are in denial that he has problems.

Posted by: Anonymous on Mar 16, 2008 at 04:03 PM
Can't anyone get the police to pick up this guy? He's still running around free as a bird! He stayed hidden for weeks but not is being brave and coming outside during the day. The police apparently just leave when the parent tell them he's not there. He is there. Just hiding/

Posted by: Anonymous on Mar 12, 2008 at 09:39 AM
To concerned: When I spoke to the Charleston PD they told me they were still looking for him. So your info is incorrect.

Posted by: Anonymous on Mar 10, 2008 at 11:48 AM
Why haven't the police arrested this suspect. Are they checking this site for updates?

Posted by: Concerned on Mar 3, 2008 at 10:36 PM
You know If there gonna place a subject on this most wanted site, they should have there story straight with charleston PD. Slander is not a good thing and can affect a person for years. Oh another thing this person has been in contact with law enforcement back in sept. This is old news and very much incorrect news. People shouldn't believe everything they read.

Posted by: KLP on Mar 2, 2008 at 04:22 PM
Yes! I know exactly that it is James Smith. I contacted the police and told them who he was and then some!

Posted by: Anonymous on Feb 29, 2008 at 01:53 PM
To the person who identified this subject. Are you sure and if so do the police know?

Posted by: Anonymous on Feb 27, 2008 at 09:33 PM
This man lives on York Ave off of Hanna Drive in North Charleston James Smith is the bums name

Posted by: Anonymous on Feb 6, 2008 at 12:30 PM
I think that there should be a reward in the arrest and conviction of anyone that would take a chance of allowing thereselves to be in harms way by telling who these individuals are. I mean there are informants out there everyday getting paid good money to get people busted. I think it would just be more of an incentive to allow people to tell on these criminals.

Posted by: Bill on Feb 3, 2008 at 05:15 PM
Getting this guy off the streets should be reward enough.

Posted by: Anonymous on Jan 11, 2008 at 09:50 PM
he has on scrubs, check nursing homes in the area or housekeeping hopsitals

Posted by: Anonymous on Dec 22, 2007 at 01:15 PM
I think this guy shops at the kroger in dunbar ill be keeping my eyes open

Posted by: Heather on Dec 17, 2007 at 12:09 PM
Who cares if there is a reward...if anyone knows where or who he is...turn him in...

Posted by: Anonymous on Dec 11, 2007 at 03:48 PM
Is there a reward leading to the arrest and location of this credit card fraud suspect?
