HURRICANE, W.Va. (WSAZ) -- The battle to remove the chemical MCHM from a landfill in Putnam County may end up back in court.

According to the Putnam County Commission, Waste Management says the Department of Environmental Protection told them the MCHM dumped at the Disposal Services Landfill in Hurricane cannot be removed.

Managers of the landfill say removing the MCHM would be a difficult task because trash and debris have already been put on top of it.

The County Commission says there has been limited communication with the DEP and that is why if they can't get the chemical out of the landfill, they will consider filing a lawsuit.

Last month, city leaders in Hurricane found wastewater with MCHM was being brought to the landfill from Freedom Industries, following the chemical spill in January.

The case went to court, but it was dismissed by a judge. Click the link to the right for more on that dismissal.
