UPDATE @ 1:40 p.m.
KANAWHA COUNTY, W.Va. (WSAZ) -- A man from Dunbar is charged with stealing money from his elderly mother who suffers from dementia.

Tommy Gibson Burger, 55, of Dunbar, was arrested Tuesday and charged with Financial Exploitation of an Elderly Person.

According to the criminal complaint, Burger intentionally misused and squandered money that was allotted for the care of his 88 year old mother.

Police say the victim's account was worth $166,085.67 in December 2007.

Burger is accused of taking large cash withdrawals from the account since 2007, according to the criminal complaint. The account is now depleted.

Police say the majority of the cash withdrawals were used to support Burger's drug addiction.

From 2007 to July 8, 2011 Burger is accused of misusing approximately $81,175.00 of his mother's name, according to the complaint. Police say Burger coerced his mother into giving him Power of Attorney and then depleting the remaining funds in his mother's Ameriprise Financial account.

Burger was arraigned on the charge late Tuesday afternoon in Kanawha County.
