Man Fights with Troopers after Domestic Violence Call

ELKVIEW, W.Va. (WSAZ) -- A man faces several criminal charges following a confrontation with law enforcement officers who were responding to a domestic violence call.

Troopers responded to a fight and domestic violence call at a home along Empress Road in Elkview late Saturday night. Dispatchers say that a daughter reported her father was abusing her mother and that the level of violence was escalating.

When troopers arrived at the home, the daughter was waiting outside and led them down to the basement, where they say yelling and screaming could be heard.

Troopers say Gary Paybins, 48, of Elkview, was visibly upset and his wife was crying. According to the criminal complaint, Paybins yelled at troopers to leave his home and his wife said the argument was over.

Police made the family talk outside about what happened. Paybin's wife explained her husband had been drinking and began screaming at his daughter. She later told police he grabbed her neck and shoved her down, according to the criminal complaint.

Troopers spoke with Paybins, who denied abusing his wife. Troopers say they noticed a bulge under his sweatpants and that he threatened them.

According to the criminal complaint, Paybins tried to reach under his pants and grab a pistol that was strapped to his leg, but troopers were able to restrain him before he could pull out the gun.

Troopers arrested Paybins, who they say resisted them with violence until they subdued him with pepper spray.

After being checked out in an emergency room, Paybins was charged with domestic assault, domestic battery, two counts of assault on a police officer, two counts of battery and obstructing. He is being held in the South Central Regional Jail.

WSAZ contacted Paybins' wife and daughter at their home on Sunday, but they declined to comment other than to say they are doing okay.
