UPDATE 1/1/14 @ 6:15 p.m.
CHARLESTON, W.Va. (WSAZ) -- Part of downtown Charleston brought in the new year with gunshots ringing out early Wednesday morning.

Police say a fight broke out between two groups of people about 2:30 a.m. Wednesday in the 600 block of Virginia Street.

Michael Underwood, 30, of Beckley, is accused of pulling the trigger. Police say he shot the victim, John Scott, in the shoulder.

"They never saw each other, never knew each other," Sgt. Tony Hazelett said. "It all happened in a matter of 15-20 seconds."

Police say Scott and his friends were eating pizza and waiting for a taxi outside when Underwood and several others came up to them.

They say a misunderstanding involving the pizza led to the fight that ended in gunshots.

"We had a very heavy police presence out last night, but crimes like these are unpredictable," Lt. Steve Cooper said. "Especially when tempers flare and you have alcohol and firearms combined."

That mixture is what Andrew Sivaprakamas says keeps him away from large crowds on New Year's Eve.

"I stayed in and watched a movie and watched the ball drop with my family," he said. "I think that's the safest way to go about it."

Underwood turned himself in to police Wednesday afternoon.

Police say Scott is still recovering in the hospital in serious but stable condition.

They're still investigating whether any of the others involved in the fight will be charged.
