UPDATE 3/14/12 @ 6:45 p.m.
CHARLESTON, W.Va. (WSAZ) -- A man sentenced on child porn and sexual abuse charges is headed back behind bars.

Last February, Gabriel Hargus pleaded guilty to charges of child porn and sexual abuse. He was later sentenced to two years in prison.

However, Hargus was back in court Wednesday for violating his sentencing.

Prosecutors say he violated his sentencing by not correctly registering as a sex offender.

"I’m not a danger to society,” Hargus told a Kanawha County judge Wednesday.

"Mr. Hargus is a threat to the community. I said he was a threat to the community way back when he was sentenced," Senior Assistant Kanawha County Prosecutor Fred Giggenbach said.

Hargus met a 13-year-old girl on Facebook in September.

They talked and texted before meeting at an apartment in Dunbar, and that is where the girl says the abuse happened.

At that time, Hargus pretended to be 23; he was actually 33. He’s now 35. When he went to register as a sex offender with the West Virginia State Police, he still used the birthday of his alias, Ethan Stone.

Hargus told Bloom the situation was a misunderstanding.

"I think the mistake started either through some entry in my Facebook page or through documents that were found in my house, or other documents that were filed," Hargus said.

Bloom found his testimony was not credible.

During Wednesday's hearing, Bloom sentenced Hargus to five more years in prison for not giving police his correct birthday, Social Security number and name.

When Hargus gets out of prison, he will serve 25 years on supervised home supervision as a sex offender, according to Bloom's sentencing.
