HUNTINGTON, W.Va. (WSAZ) --Court officials say Nathaniel Johnson has waived his right to a preliminary hearing.
His case will now go to a grand jury.
Johnson did not appear in Cabell County Magistrate Court on Friday.
Officials say he is in an out-of-state treatment center.
According to the criminal complaint filed in Cabell County Magistrate Court, West Virginia State Police arrested Nathaniel Johnson, 22, of Salt Rock on Tuesday.
Johnson is charged with conspiracy, and bringing a weapon on jail grounds.
The complaint says investigators had received information on Tuesday that Johnson was bringing the contraband into the jail.
Undercover investigators then set up a meeting with Mr. Johnson, where they said he took $300 and agreed to buy tobacco and Oxycontin pills, and then deliver the pills to an inmate.
Troopers later arrested Johnson at the jail as he was getting out of his vehicle. Troopers say they found .22 rifle inside his vehicle.
Following his arraignment, Johnson was taken to the South Central Regional Jail. Thursday morning he posted bond and was released.
His next court hearing is scheduled for August 13.
W.Va. State Correction Officials say Johnson has since resigned his position as a corrections officer.
If convicted, Johnson could face up to five years in jail and a $10,000 fine.
