WAYNE, W.Va. (WSAZ) -- A man from Wayne has been charged with driving under the influence causing death following a July traffic accident.
The crash happened July 9 on Route 152 near Midvale Heights in Wayne County and involved three vehicles.
According to criminal complaint filed in Wayne County Magistrate Court, Jarrett Hawks, 20, of Wayne was driving the car that 21-year-old Followay was a passenger in. Followay died at a Huntington hospital several hours after the crash.
Another passenger in Hawks vehicle, along with the drivers of the other two vehicles and one of their passengers was also hurt.
Besides the driving under the influence-felony death charge, Hawks faces four misdemeanor charges of driving under the influence of causing bodily injury, failure to drive right of center, and driving without a license. Hawks was arraigned on the charges on September 1.
The criminal complaint says toxicology reports revealed the presence of alcohol and marijuana in Hawk’s system at the time of the wreck
The complaint also says Hawks was driving using learners permit and that his passengers did not have a driver’s license.
Hawks told Sheriff Department investigators that the crash happened when a shoe lace got tied around the brake pedal and the vehicle began hydroplaning.
A preliminary hearing on the charges has not been set according to the Wayne County Magistrate Court Clerk.
