VERDICT / DAY 8 INFO
Amanda Barren reports from Putnam County Circuit Court that Michael Merrifield has been found guilty of murdering Logan Goodall, his ex-girlfriend's son. Merrifield was also found guilty of death of child by guardian or custodian and guilty of sexual abuse by a guardian. He was found not guilty of sexual assault. The jury recommends no mercy on the murder charge, which means Merrifield will spend the rest of his life behind bars. Goodall was two years old when he died at his home in Hurricane in 2005.

The jury deliberated through most of the day with a break for lunch. The jury asked three questions to the judge. They returned their verdict shortly after 5pm. They took a little more than one day to deliberate the case.

Amanda reports that Merrifield stayed calm with his head down while the verdict was read. There was no emotion from anyone in the courtroom, although Amanda says it was very tense. Dr. John Merrifield, Michael's father, put his head down during the verdict reading. Dr. Merrifield also faces charges related to this situation. That trial is expected to go to court in March.

Amanda spoke with Donna Goodall, Logan's paternal grandmother. Ms. Goodall said she finally feels justice is served in this situation. She felt some closure after this verdict.

Putnam County Prosecuting Attorney Mark Sorsaia spoke with Amanda Barren Thursday night on 530 Edition. Sorsaia said, "it's been difficult."

"We worked hard for two years. It's been a lot of work and a lot of stress because the nature of the case and certainly the evidence we had," Sorsaia said.

Sorsaia said he's satisfied with the recommendation for a life sentence without the possiblity of parole for Merrifield.

"It's a relief. Obviously the outcome is something that we had hoped for and worked for," said Detective Lisa Arthur, who testified in the case. "We're all relieved we can move on from this now."



DAY 7 INFO:
The jury started deliberating the case around 3pm Wednesday afternoon -- and has gone home for the night without a verdict. We tried to update Patrick Merrifield's condition at CAMC General, but a hospital spokesperson says the family has asked that no information be released to the media.

A spokesperson with CAMC says Michael Merrifield's brother, Patrick Merrifield was under evaluation earlier Wednesday at CAMC General. A check to the hospital at 9:00pm Wednesday says they no longer have him listed. A source close to the Merrifield family tells WSAZ Patrick Merrifield was on a ventilator. The young men's parents were not in the courtroom Wednesday afternoon.

The defense rested its case at around 9:00am. That means Michael Merrifield will not take the stand.



DAY 6 INFO:
Four defense witnesses took the stand. A forensic pathologist, two of Merrifield's friends and a complete stranger to Merrifield. The stranger told jurors that out of the blue Pepper Eren came up and started talking to him one night at a bar. According to his testimony she told the witness she "didn't have time" to take Logan to the doctor. He also testified it seemed like she was bragging that Michael was in jail and she wasn't. The witness says that he saw Pepper doing drugs that night.

Patrick Merrifield, Michael's brother, was supposed to take the stand Tuesday, but he didn't. He invoked his 5th Amendment Right. It's law that allows a person the opportunity to not testify for fear of self-incrimination.

The defense expert Forensic Pathologist today told jurors he couldn't say 100% that Logan Goodall was sexually assaulted. He says that it's a possibility, but he can't say for certain that is what caused some of Logan's injuries. The WV Chief Medical Examiner last week told jurors, without other evidence to say what caused Logan's injuries, he believes Logan was sexually assaulted.



DAY 5 INFO
WV Chief Medical Examiner James Kaplan explained the injuries to Goodall and showed the autopsy photos to jurors. Also on the stand, Mark Zeigler. He explained that in the summer of 2005 he spent an afternoon with Logan & Michael at a pool in Dunbar. He told jurors Michael was roughhousing with Logan to the point he became concerned. He said Logan was pale and gasping for breath, yet Michael kept throwing him in the water. Zeigler testified that he jumped in the pool got Logan out and told Michael it was enough. "It shook me up for days afterwards," Zeigler testified.



DAY 4 INFO
Day four of testimony came to a close with two people on the stand. Detective Lisa Arthur with the Putnam County Sheriff’s Department and a third paramedic. Detective Arthur talked about her investigation at the home where Logan died. On the stand she said there was no DNA or physical evidence to link Michael to a possible sexual assault in the case. She also said it didn’t mean there are other things that support a theory of sexual assault. Investigators say that sexual assault is a possibility because of the nature of Logan’s internal injuries. Those injuries are what caused the toddler to die.



INTRODUCTION
Michael Merrifield is on trial in the death of Logan Goodall in Putnam County Circuit Court. Goodall died at his home in Hurricane and was the victim of abuse, according to prior testimony. His mother, Pepper Eren, is already in prison in relation to his death.

    I agree with the verdict but I also think Pepper should serve life. I am so SICK of women letting men move in and abuse their children. My son is an adult now, but I told him from a very early age to tell me if ANYONE touched him inappropriately, even if it was his father or grandparents. and I would make it stop. Women need to stand up for their children and stop allowing this kind of abuse to continue. No "boyfriend" on earth is worth your child's well-being. I'm a Registered Nurse and I once had the mother of an abused child say to me, "You can always have more kids but a good man is hard to find." UNREAL! There is no excuse for the doctor's actions either. He should be banned from the practice of medicine. RIP Logan.

    I just LOVE how MM is now speaking out and when he doesn't want to answer a direct question he claims "that's a part of the appeal". I also LOVE how he is saving his testimony for a "new, fair" trial "up north". OMG!!! I can't do anything but LAUGH at the idiocy. He claims he was "railroaded". LOL Oh goodness. I'd like to see him railroaded -- like on Rocky and Bulwinkle!!!

    to REMINDER....the "FACTS" have slapped you in the face and you are still in denial. the "FACTS" were presented to a Jury of his peers. There was NO hung jury. What does that mean? That means that all Jurors agreed and found MM **GUILTY**. You dont think they were given FACTS to base their decision? You think that 12 Jurors were wrong with their verdict? You think that not one of the Jurors were given any FACTS to make their decision? Why do you continue to embarass yourself? For attention? Well, as for myself and others should follow suit, I will no longer give you the satisfaction of any reply, comment or acknowledgement of the words coming from such a sick and sadistic mind. Keeping in mind the abuse that was inflicted over a period of time..and "COMMON SENSE" you have never had? I truly hope you will get psychological help and not risk CPS removing your children..Lacking the thought process of knowing right from wrong they should not be in your custody. I fear for them..

    It is over!!! Thank God for the people who were there that day (Sep. 2005). They recognized that there was a problem and what it was. ie. nurses, paramedics, police. Also God Bless the prosecution, they did an outstanding job. May God Bless and Keep these people that they may be able to continue to protect the citizens of Putnam County.

    I can't see how anyone can lay down at night and sleep doing something as horrible as this. It is a shame! This breaks my heart to think of how this little angel suffered. Just by looking at his picture makes me cry I can say that Logan is in a better place. He can't be hurt anymore Jesus took him away from all the pain and torture he had endured. Little one you may not have been protected down here, but you are proctected by The Almighty God now and no one will ever hurt you again. As for Michael Merrifield and all who were involved, you know who you are. You will reap what you sowed, you will answer to God on Judgement Day. Romans- 12:19 VENGENCE IS MINE I WILL REPAY SAITH THE LORD..

    So what the hell is Reminder's problem? If all of these people who know him say he was violent, crazy, required suspension in 8th grade, and they can see that he was capable of doing this, why does reminder have such a hard time seeing it? Reminder even left her kids w/ MM & PM. And nothing happened! What a nut! Not only the comments of tons of people who knew him, what about the pit bulls & let's not forget the string of arrests from the age of 18 all the way up to TWO months before Logan was killed! Good grief!

    Anna, I so totally agree! Mark Sorsaia did do an absolutely excellent job! I, too, loved his response to that stupid rock analogy! So true that every rock did have MM right smack underneath it! I made a comment earlier, but don't think I made mention of the jury. They definitely do deserve credit! I'd like to thank everyone of those jurors for their efforts. I'm sure it was very mentally exhausting & greuling. I know the content that they were dealing w/ could not have been easy & I'm certainly glad I didn't have to know all the gory details. I'd rather not know. I just know it couldn't have been easy! Thank you sooooo much for bringing justice to little Logan! It can't bring him back, but it sure can make things a little more right for him. I only hope that Kanawha County is able to get an equally intelligent group of 12 & alternates to sit on Dr. & Mrs. Merrifield's.

    Mark Sorsaia did an outstanding job. Putnam County should be proud, not only of Mr. Sorsaia, but their citizens that sat on the jury. The way Mr. Sorsaia turned around the "rocks analogy" presented by Mr. Rebrook during closing arguments was awesome. Reminded me of Perry Mason. Congrats!!!

    Mike Clifford stated in a TV interview that no one will ever know what happened on 9-6-05. Based on evidence presented at trial and statements by all three parties there that day, Pepper was in Dunbar and going to work that afternoon. Patrick M spent the night with Michael M and Logan. Sometime between 11-12pm Patrick said goodbye to Logan and Logan said goodbye to him. Patrick left. Later on about 1:30 or 2pm Pepper got a frantic call from Michael stating that Logan was in bad shape and she should come home. Between the time that Patrick left and Pepper came home, something bad happened to that baby and that "something bad" was Michael M. Pepper finds Logan unresponsive, teeth clenched and eyes rolled back. There was no one else with Logan between 12pm and 2pm except MM. The "bad thing" that happened to Logan is called "1st Degree Murder."

    to NIKKI, i have known MM for a number of years, as a matter of fact we went to the same catholic school together, and yes he was violent as a child, very violent, he actually was kicked out finally in the 8th grade, the good dr. and the mrs were well aware of this behavior but have always covered for their boys. this is very tragic and i am sorry for all involved, but the merrifields knew this day would come mike has always been mean

    All I can say is the cold hearted (want to call him a bad name) had better be glad that this poor innocent child was not one of mine. I have 3 children and five grandchildren and I really don't think I could stand the thoughts of that monster living in a jail cellwhile a helpless child in dead by his hands and the people who tried to cover it up. They know who they are. I think that they would be better off in the ground also, they should not get any deals. why not reinstate the death penilty. Better yet go by the way of the Samari take their own lives save the taxpayers some money. I don't like having my taxes paying for their food and lodging. The Gov. needs to step up and bring the death penilty back for these cases and maybe some of this garbage will stop if the people knew that they would be put out of our misery for it. This is my oppinion and my oppinion only not any one elses but I am sure there are more that feel this way.

    I'm glad my comment was finally posted atleast one comment. DR and mother of mm would have let mm do time for the other 100 crimes he would have already been in jail.     The only thing I can say is the ones involved in this had better be glad that Logan was not one of mine I think there was 5 or more involved in this childs death and they all should be held accountable.THe Govenor should reinstate the death penelty for cases involving children that have been killed in this manner. However this is my oppinion and I may be alone in this and I my not be I have three children and five grandchilren I just dont think I could live with myself knowing the people responsible for the death of one of mine was being supported for the rest of their miserable lives by my tax dollers put them out of the worlds misery and put in the ground.     Thought: I would too! I'd be trying to figure out who did do it! I'd be naming someone! Especially if I was with the child the majority of the time. I'd have an idea who I left the child with the remainder of the time. So I'd be naming the real abuser. Plus, in spending that much time with a child, I'd love and be attached to the child & I'd probably want to kill whomever I thought was responsible for it! I'd get up there and make myself heard.     #1 to those who keep saying that Pepper should be in jail --- SHE IS. Not enough, but we'll take it. Pay attention. #2 To those who are calling for all the grandparents to be charged. Testimony said that Logan was not around the paternal or maternal grandparents much the month or so prior to Logan's death. Logan was mostly with MM and his family members. I agree that they should have realized Pepper was a druggie, but I don't believe they had ANY idea of the extent of what was happening. Their guilty for that is enough for me. #3 to those who want us to ignore Dr. Merrifield's bad act. ONE SINGLE bad act in an otherwise good life can define any of us. That's the nature of bad acts. Unlike his son, I don't think that Dr. Merrifield is a bad person entirely. IMO the Dr. & Mrs. failed as parents and failed Logan miserably. Depite a majority of good things, the two bad things they've done are pretty DARNED weighty. That's life.

    I've often thought people should be able to attain a reasonable score on an IQ test in order to be able to sit on a jury or vote to filter out people with low mentality like that. I, too, am glad all of the jurors on this panel were intelligent. Otherwise, we'd have ended up with a hung jury! Think how hard it would be on everyone to have to go through all that again!

    As someone who followed the trial very closely, I'd like to thank everyone for their hard work & dedication to getting justice for little Logan! Everyone stepped forth & gave their best efforts toward getting justice for him & making his short life count for something in this cruel world! Esp Mark Sorsaia! Awesome! He countered every single move the defense made to incite doubt in the minds of the jury! He played the statement of Michael telling Pepper that Patrick didn't do it because he never left him alone w/ Patrick. Also letting them know he wasn't accusing Pepper. He even brought the forensic path from SC, Clay Nichols, in to put some intelligent last thoughts out to the jury! That med ex from KY must only have 20 minutes of experience instead of 20 years! Either that or they paid him WAY more than he was worth! Kudos to you Mark Sorsaia--you anticipated & countered every single one of the issues I was afraid the jury might get hung up on! You couldn't have done a better job!

    I guess the point I am trying to make here is this: In order to convict MM in this case and anyone in general the court and the Jury needs more CORRABORATIVE evidence based on PURE FACTS and not a mixture of facts and interetations!!!! The defense has some plausible evidence based on pure facts, but the prosecutor didn't. All he stressed on was pure personal interpretations. such as this: MM said something about latex in condom so he has the awareness of how sexual assault works. I think 12 year-old teen knows that some condoms have latex. So What? I hope you see what my point is.

    To Just a reminder: The state probably did not 'want' to give Pepper Eren a deal, but they had no choice in the matter. Being that all the evidence was circumstantial (no DNA pointing specifically to MM), there was no way for them to get the necessary information to the jury. It would've been hearsay & couldn't have been introduced in court. It probably wouldn't have even gotten past the grand jury. He probably wouldn't even have been indicted. But w/ Pepper, that allowed them to introduce a lot of evidence that was supported by other evidence--corroborative evidence.

    To Just a reminder: We know that Pepper didn't do it because of the way MM reacted in the police station when she was wired without his knowledge. He never once accused her of doing anything to the child. Because he knew he was the guilty one. If you & I are talking and I know I didn't do something, then I'm automatically thinking you must have . . . If he knew he wasn't guilty, he would have been going in the direction of figuring out who did. Don't you think? Not to mention the fact that he told her that Patrick did not do it because he never left the child alone w/ Patrick! Thank God the jury got to hear him make that statement! That's the only reason the defense's manipulative little maneuver didn't work when they tried to shift the jury's focus over to Patrick & instill 'reasonable' doubt. Those attorneys were clowns! Complete clowns! They couldn't even round up any remotely intelligent witnesses to take the stand in his defense!

Don't blame Logan's family except his Mother.....she deserves 10 years, and the Prosecutor was not happy to give her a Plea, but he wanted to put the real psycho killer behind bars for life, and he did just that. Justice was served last night, It may night bring back Little Logan, but it will keep someone other child from being abused by Mike Merrifield. I feel bad for the Merrifield family because all they tried to do was cover up for their son - and now he has ruined their name. How do we make sure she doesn't get out before the ten years? Do we write to someone, do we have to show up at the parole hearings...     Dr. Merrifield has served for more than 30 years in a small community in Dunbar, WV. He has helped numerous patients, physicians, students and people of any strata of the community who needed help. He has not hesitated to help anyone and not considered his benefits or loss when helping others. He has helped people because of the intense love of people and the love of God. Please don’t be sarcastic of him being the WV Doctor of the Year. He certainly deserves this title and may be more. Please don’t listen to the media who wants to put fuel in the fire.     While I believe in the verdict, it is a tradegy for all concerned - a beautiful child died a terrible death; a young man ruined his life, and a set of parents have lost their son for the rest of their lives. In all of this, it appears to me that Pepper Eren got off the lightest - she will get out of jail eventually and probably go back to drugs, men, and partying. This does not seem fair. She was, after all, the person on whom the most responsibility for Logan rested, and she will be free simply because she turned State's evidence to save herself. My opinion - she should be in jail for the rest of her life, just as Michael Merrifield will be. In this aspect, justice WAS NOT SERVED.

    There were some points that I thought to remind to individuals who have taken the stand against MM, including the Jury. 1. Why do you think that the possility of child abuse by Pepper is doubtful? Keep that in mind that evidence indicates that there was a child abuse but does not indicate by who!!! and since MM was the last person who was with Logan, everyone points their fingers to MM. Don't you think it is possible that Pepper harmed the child throughout and left to work and left the child with MM to strengthen the hypothesis of abuse by MM? What is the reason for Pepper to celebrate the New Year and appear as a "Hollywood star" very shortly after the death of her child and "brag about it?"     I might be wrong, but I think the charges against Dr. Merrifield and his wife will not bring much punishment even if they are found guilty. I think they are only charged with not reporting this to CPS. I think if he is found guilty he will not see any jail time.

    Well its taken 2 years. And the jury looked in different ways to make the right choice that they thought this fit the crime. I'm sure that the attorneys for Micheal was in for a ride and they knew it. I can imagine what would make a person do what they do to children at any age like this. They try to say that there insane and put them into a hospital, this and others should be any case like that.

    On the Merrifield verdict - I fail to understand how they could say NOT guilty on charge 3 but guilty on charge 4! First degree sexual assault is done after your have thought about it and NO child molestor does that to a child without fore thought. They should have found him guilty on ALL charges.     Well thank you for your coverage of this case. Thank you to these brave jurors that had to set and look upon the evidence and may the Lord help you threw the next days coming. Justice was served as well as it could of been in WVA. It has given me hope now for when we go to trial in June 08 for the death of my nephew in Kenton Co. Ky. He, also was beaten to death by a temporary live in boyfriend. Oh, there are still honest people out there that give our justice system a good name.     Justice did prevail - somewhat. I think that everyone that knew about the abuse and did nothing ie the grandparents,the mother,the brother, are as guilty as the jury said mm is. In a few years, when the mother is unfairly allowed to start her life over, Logan will be still gone. I hope that now the spirit of this small child can rest in peace.

I think the plan of the brother in hospital was a setup to throw the case off. In the hospital on a ventulator and then he was released that night. Come On, Get Real!     i think merrifield should have had the death penalty and then that wouldn't be enough for him!! there are already to many men that abuses kids and the law doesn't do anything about it. the whole government needs a change, even the federal. most of them are in it for themselves and what they can get and not care for us that are not so high classed. he really needs the death penalty but as long as someone doesn't get involved and try to get him out, then he deserves to stay in prison and maybe be punished that way or some of the other prisoners take care of him!!! i can't express how angry this makes me!

    There is more than just one guilty person n this case. The abuser, the mother, and certainly the grandparents. Dr. Merrifield is a board certified physician who has a legal and ethical obligation to report any and all signs of abuse. What makes this pathetic situation even worse is that it was not some random patient that he turned a blind eye to. His inattention and lack of integrity resulted in the horrific and painfully traumatic death of his OWN grandchild!!! He needs to be the next on trial.

I beleive that the judge should show NO mercy with his sentencing and teach a lesson to other offenders that this will NOT be tolerated.     Justice prevailed...somewhat. MM still gets to take air into his evil lungs... I hope that the people who feel justified in obtaining monetary gain over the death of this sweet child have a tough time sleeping for a long long time. It is a sad day when people don't take care of their children, yet get to reap financial benefits from their own neglect. This should never have happened!!! And although the relatives may be heartbroken, I can almost bet they bear some of the guilt as well!!! Just a word of advice, if you think a child is in harm, no matter who it is...get involved. If you KNOW your own daughter or son is a drug addict, get their children away from them. If your friends or family have trouble staying in a loving stable relationship, keep an eye on their kids!!! They do not deserve to live the problems adults bring into their innocent little lives. No one took care of that baby...or he would still be here.

    This is a sad case.The jury should find MM not guilty due to the lack of evidence.I blame Eren's parents just as much as Eren & MM. If they kept Logan as often as they did and had him the weekend before, they should have reported the abuse. I think law enforcement was forced to make a quick arrest by the public and did not fully investigate. There are too many lose ends.

    Isn't there one count charged to mm whereby if a child is left with a guardian/custodian and medical attention is needed, but neglected results in the child's death?     Let Us all pray for little Logan Goodall. I feel there should have been a much larger play for the parents, grandparents, and any other adult who did seen or could have seen something was wrong with this child. Same on all of them for not reporting any and all evidence of something wrong with this child. Being a grandparent of three, I would not hesitate to take my grandchild to hospital, police or DHHR for help. Let everyone who knew Logan take blame for what has happened to this baby. The mother from the beginning should not have been able to keep this child. Who would leave her child with anyone she did not know, other than sleeping with.     Does it not look fishy to everyone that Patrick is now in the hospital on a ventilator the day after he plead the 5th. He was at the house with MM and Logan the day before he died. MM's atty. says they never talked to Patrick. Come on does it take a rocket scientist to figure out something is really fishy here? Maybe MM and Patrick both abused the boy. But whether MM committed the abuse or watched it - he was there - in my mind he is guilty and should be punished. Maybe Patrick punished himself and that's why he's in the hospital. Couldn't live with himself. Who knows? Maybe at some point we will hear more about this. Thanks WSAZ for letting me get things off my chest and for doing a wonderful job of keeping up informed.     The latest does change my opinion of who may be involved in committing the murder. If Patrick tried or did take his own life I don't think it would be because his brother did it. On the other hand I don't think Mike would go to jail the rest of his life to protect his brother.Only explanation I can come up with is they were both involved so I stick with my verdict of guilty.

    I feel that MM is guilty after watching all of the court videos. I do not know any of the people involved in this case but am very distressed in our community's failure to protect it's children. As a member of this community, I want to think that each of us is looking out for the other, especially the young, the weak and the old. In this case I fear we've failed Logan and not spoken up soon enough and given him the protection he deserved. Hopefully this will serve as a constant reminder to us all to get involved when someone is in need.

    As someone who has watched every minute of the trial live, the evidence points does not prove MM has done anything. You also have to look at why Pepper Eren so quickly took a plea deal and why is Patrick Merrifield in the hospital the day after he was supposed to testify. Think about it. The police didnt even know to where gloves when collecting evidence so what makes a person think they could tell who is the correct person to charge. Too many things just dont add up. MM should be found not guilty on what the prosecution has presented which has been nothing besides the boy died and no evidence linking any one person to the crime. Everyone learn your constitution and know that this countries laws state MM should be a free man because nothing has been proven.

    This is another example of why it is not always best for the children that the mother gets custody. the women can move in man after man after man into the lives of their children and keep their children away from their real fathers and grandparents. The courts need to wake uo and see that sometimes it is best to give custody to the fathers.

    This is so sad. How could any human abuse a child like that? MM, his parents, his family, her family, everyone who witnessed or saw this abuse needs help -- a lot of help. You can not tell me that someone other than MM and his father, did not see the signs of abuse and to think that his father was voted Family Practice Physician of the Year and saw the abuse on this child and fixed or tried to correct the infliction of this abuse without telling the authorities. That is someone I would want to be Physician of the Year. I am glad he is no longer practicing medicine. Just think maybe he saw other things and never reported them. I hope in their minds they can all answer for what they saw, did or did not do. I know Logan is in Heaven just wondering why he had to suffer this abuse. There is no excuse for a child to be treated this way. I hope whoever caused him to suffer (whoever it may be) suffers the same someday. What goes around comes around.

    The issue at hand today is justice for Logan. The good Dr. and his wife will have their day in court and I am sure we will all know a lot more facts about the bad decisions they made. But for now, I am hoping Mike Merrifield gets a guilty verdict on all counts. He took a child's life and he needs to pay. I am thankful a deal was not made for him to plead down to. The prosecution was confidant of his guilt or they wouldn't have proceeded as they have. WV Against Abuse also deserves a hand for their persistance in justice for Logan. If someone is keeping you from seeing them (red flag).Your childern need you .Be there for them there is nothing more important than that.     To "a loving mother" -- this is West Virginia -- not some T.V. show. Defense witnesses are NOT paid to testify at trial. Expert witnesses are paid (which would be a medical examiner, a doctor, etc.) and there is a process the Court goes through to approve someone to be an expert witness. Character and fact witnesses ARE NOT PAID. Have you ever heard of perjury? Lying on the stand for someone is not worth any amount of money so you can rest assured that those under oath likely spoke they truth as they saw it. Additionally, Patrick Merrifield would not have invoked his 5th amendment right in order not to implicate his brother -- it was done in order to not implicate himself! This board is bordering on hysteria -- everyone should use their energies to do something other than run down an already destroyed family.

    If ever there were a case meeting the criteria for the death penalty, this one is it. But of course the death of Merrifield would be considered cruel and unusual punishment for the short length of time it takes to inject the drugs, and from all the evidence, poor baby Logan went through MONTHS of torture. I am so proud of our law makers who decide these matters.

    To CP. I have no doubt that Dr. & Mrs. Merrifield have done good things the majority of their lives. I believe that when it came to their child(ren), they lost sight of right and wrong because they have covered for and protected MM for the majority of his life. It's a cold hard fact that one act or inaction in a person's life can be what defines them despite all the other good.

    There are convictions every day based on circumstancial evidence. How many crimes are actually "SEEN"? Anybody, I say ANYBODY that listens or reads the testimony given by the ME and would still give MM the "DOUBT" of not inflicting injuries to this baby have to be callous, black hearted and hopefully does not have a child themselves !!! Even if there was not sexual abuse (which is stupid not to think!)any ONE of the injuries that happened during the period of time that he was in the care of Mike Merrifield would indicate he participated or approved of the abuse. Therefore, let him be guilty of just ONE ! just ONE I say is all that is needed to put MM, Pepper, Dr. Merrifield, Mrs Merrifield,Merrifields family, Jeremy Goodall(and family)and the Eren's (family also included) and any other individual to be sent to jail for the remainder of their lives.     I think this case is a perfect example of what can and does happen when your life revolves around drugs. Only Pepper, Logan and Michael truly know what happened to that precious little baby, but the sad fact is that there is no possibility of caring appropriately for a little one when your life revolves around drugs. We all know that Pepper was on drugs, and although Michael had prescriptions for his pills he sure wasn't taking them as prescribed, just ask all the friends his dad wrote scripts for so he could feed his habit. Pepper is doing her time and no matter how many days she serves in prison she will have to live with a life sentence of knowing what that baby endured, I just hope Michael and his parents get the same. My fear is that the sentence will have to come from the courts because I can't imagine that they would have a conscious when they were so willing to cover up the abuse that sweet little baby was suffering.

    Mandy, many are guilty in this case but Mike is the one on trial right now; there has been nothing to show his innocence, much to show his guilt....there are ramifications to his guilt that are far reaching, including causing pain to you, his family, Logan's family, etc. I feel bad that you are hurting, perhaps you are close to Mike or a member of his family, but listen to the testimony - the fatal injuries occurred 8 to 24 hours before his death; Pepper wasn't there until 1/2 hour before his death, they didn't occur during that time - Mike was there Mandy, Mike and Patrick!

    Too often, we hear about people who have been imprisoned for crimes they did not commit. These indictments arose from circumstantial evidence. In my opinion, the evidence presented thus far in this case is purely circumstantial. Admittedly, I have not heard today's testimony. Today, the prosecution's premise that Logan was sexually assaulted was refuted by a peer of the ME. At this juncture, you have accused, tried, and sentenced a person who may only be guilty of loving the child's mother and honoring her wishes prior to the child's death. Guilty until proven innocent?

    I agree with both Debbie and "D". First the Eren's testify to seeing injuries and on the next breath they say they haven't seen Logan in quite some time. It was the Eren's responsbility as well as the Merrifield's to say something to the proper authorities. The money that was obtained by the settlement on Dr. Merrifield's civil case should be given to charity. I am curious to know if part of the settlement agreement indicates the good doctor admitted to negligence by not reporting suspicious injuries. May this child rest in peace while the rest of his dysfunctional family point blame to everyone else.

    Debbie, its so easy for you to say what you would do but you are not in this situation so until you are then you should not judge anyone. I believe the reason why the grandparents did not report was because there was always an excuse for logans injuries and he was being seen by a medical physician. This Dr has been a family physician for many of the eren's relatives over the years. They had no reason not to trust him or his judgement. I believe these are loving grandparents who helped raise logan and i think your remarks are uncalled for and very judgmental. To my knowledge, cps was called but before they could investigte, logan had died. Remember pepper had only been with mike for 4 months. The bottom line is if this child was not abused, he would still be alive today. Lets put the blame where blame is deserved and not on the loving grandparents who i feel so sorry for. My thoughts and prayers go out to his family because i know they are suffering greatly.

    As a grandmother of 4, if one of my grandchildren came to my home with the bruises and injuries that the Eren's said Logan had I myself would call CPS. I blame all of them, the abusers, Dr. M for hiding it and the Grandparents who saw these injuries and done nothing. Too many people saw the injuries but not one person done anything about it. Had Peppers parents done something when they saw these bruises they may have their grandson with them today.

    hey guys try this one on-I think the final abuse that killed poor, beautiful Logan was done by dear sweet mom. However, MM doesn't have clean hands-I think he is the one that put this sweet angel in scalding hot water. I also think Pepper is not getting all that she deserves.     mandy, of course pepper is guilty i think everyone knows that including pepper. She is right where she should be. But you must not be listening to the testimony closely. Everytime logan was hurt guess who was with him. Lets see, logan fell down the bleachers at the power game, who was with him, Yes that would be mm. Logan was burned by chemicals, who was with him mm again. Logan was bitten by a dog (doubtful) who was with him. That is not judging, that is known facts. Did you not hear the testimony involving the swimming pool? or did you choose to just ignore that? Do you consider that normal behavior to treat a baby that way? oh and the cps investigation you are referring to happened about two weeks before logan died. So yes, pepper and mike were together then. So the folks that know some folks have sadly obtained the wrong information. Working in the medical profession, it is unlikey that it would take DAYS for symptons to show up especially when a child is bleeding.

I am not part of the inner circle, but I am an objective person. I know that if someone were to hit you in the stomach hard enough to cause internal bleeding that your symptoms may not show up for days. If you died while standing next to your mother, would she then be guilty? The only conjecture on my part is wondering as to what Pepper was afraid of. Why would anyone plead out to a crime that would put them in jail for two years if they were not guilty of something more egregious? If she was not guilty of something more heinous, why did she not plead to something on a smaller scale with less time involved?

Pepper has already pleaded out to lesser charges, making me wonder what she was trying to avoid. How can you be certain that MM perpetrated the abuse? From what I've heard so far, anyone close to the child COULD be guilty of the atrocities...mother...boyfriend...grandfather...grandmother (wields a wicked cane). I wish they would not share the graphic details, as it only paints a more vivid picture of the torture inflicted upon little little baby boy. I, did not know him or anyone related to him but feel very affected by this situation as would anyone with human emotion. I feel the person accused is guilty. I feel for the family of Logan Goodall, but I can tell you that there is no REAL excuse for not knowing what was going on. NONE! Especially by the so called father of this little boy. The Mother, well she will live hell for what she allowd to happen to the child she gave birth to, or so we hope. But, for the so called father. I have a question to you?     The judge in this case is a kind, caring person who is genuinely interested in children. I truly believe that the truth will come out in this trial. MM may or may not be guilty of physically abusing Logan, but I personally believe that Pepper & her family abused the child (see Kanawha CPS records) long before MM came into the picture. As I heard it, Doc M wanted to report abuse when she and Michael took Logan to him, but Pepper talked him out of reporting abuse due to her history with CPS. Doc M obliged to protect her, not MM. I surmise that comments on here by Pepper's family are purely diversionary to hide their own guilt.

    I think there's 3 people who know what happened, that's baby Logan, Michael, and God.I don't think Pepper abused Logan, but after time was in denial about Michael abusing him. I think Michael's parents were protecting him, because dr's have reported alot less suspicious situations to protective services. I also think since Pepper admitted to drug use, that possibly meth was being made in the home and that's why baby Logan felt so sick the day he died, considering they found high levels of a certain acid in his little body. Maybe Pepper left for work and Michael became pissed off because he had to care for the boy and went into a rage and began a physically abusing him which led to his unfortunate death. I do believe he was sexually abused also, maybe it wasn't by Michael and maybe it was. My personal opinion is that he was the person doing it, considering he was the person with baby Logan all the time. Sometimes things are right in front of us. Just read between the lines.

My questions are just trying to understand the psyche of MM....He was 30 years old, same age as my son; in fact, he was born days before my own son was in Thomas Memorial. I knew his father...now, parents generally love their children (Pepper and Michael are excepted here); however, do you love your child so much that you excuse their behavior all of their lives until they harm an innocent child? For you Asia, yes I would leave my child with Michael, as a matter of fact I have left my children with Michael and Patrick and nothing happened to them, and as for Patrick working that has nothing to do with this but for you information-yes. As for Terry, I believe Micheal is innocent and I have had my head checked several times, there is nothing wrong with it. Brenda, you need to get your facts straight about the sexual abuse, there was no DNA evidence of any sexual abuses. It is speculation as is this whole case. Everybody has speculated what happened, nothing concrete has been proved.

    Niki, no one has said if MM was on drugs; he stated in testimony he worked in Alaska (seasonal)....he has a long history of arrests but nothing this violent; Patrick was working...MM said in interview with investigator he had a good relationship with his parents. It doesn't matter that he couldn't drive, he had a phone to call for help. For the full truth, you probably have to ask him and/or family...regardless, nothing accounts for the way this child had to suffer

    Some help here, please. I only see what the videos show and the newspapers write. Has it come out in the trial that Michael Merrifield was perhaps on drugs, too? Why wasn't he working like Pepper was? Why did he not have a vehicle? Has any testimony come out about his physological evaluation? What about his past? Arrests, DUI's, trouble with the law? His childhood? Any knowledge about that? All of these would indicate someone who had problems and would severely harm a child. I read that he was violent.....Is that true? Any help here would be appreciated in helping me understand this situation. Also, does anyone know anything about his relationship with his parents? And Patrick - does he work? What does he do? Was one parent the enabler and let him do whatever he wanted, while one sat back and closed their eyes? Did he ever suffer consequences for any trouble he may have gotten it? Anyone who knows the truth about these questions out there and who could respond?

    Charlie, John is incorrect; the child molestor he is referring to was not around Logan for several months before his death; it hasn't been brought out because it's not true...people need to get their facts straight. The injuries were multiple and inflicted over a long period of time; he was sexually and physically abused in the last hours of his life....that man was not around.

    I have known michael for years, i was friends with an ex girlfriend who he abused physically and mentally. I believe he is guilty he is the only one who had acess to this child everyday all day. His mother shows remorse and admits she is a bad mom. He is a monster and his parents would have turned anyone else in that would have shown injuries caused from child abuse. Money talks but not in this case. I hate to think of what this baby went through. Im sure he looked for comfort from his mother but she wasnt there. They will all meet there maker one day and its not gonna be pretty.

    This case is sooo upsetting. Just looking at that baby's picture and hearing what happened to him makes me want to cry. As a mother, I know that children have accidents and get bumps and bruises. They get injured. I do not know what Dr. Merrifield saw on this baby, or what he treated him for, but you would think a physician would know abusive type injuries. As far as the burns on his bottom, one would think it would have to be scalding hot water to burn so bad he couldn't sit. As a medical professional, you are required by law to report suspected abuse. I feel sorry for this innocent child, that had no one to protect him. If your child was lethargic, why would you keep him home and feed him soup by a syringe? Why would you not take him to the ER? If you had nothing to hide, why would you be affraid. Also, if your child had a seizure, why would you squeeze him or put him up against a wall? That seems extreme. God can now protect this baby, its a shame no one could here!!!!

    Everyone is entitled to ones own opinion no matter how ridiculas. This is the bottom line it is not an opinion but fact-Mike & Pepper have both admitted to having knowledge of Logan's injuries prior to his death. NO WAY the child could have done this to himself either by falling or otherwise & he sure did not sexually assault himself. Mike is lying when he told Pepper & everyone else that he fell causing his injuries. Mike knows how Logan got the injuries but he is lying either to protect himself or someone else.     Well, it is a tragic day, another little one suffering from abuse and neglect. I currently have custody of a 5 yr.old little nephew,whose little brother, 1 yr. old was beaten to death in Kenton CO. Ky. Oct. 06. We are waiting for justice, which will never be served in jail, because our little one suffered from blunt force trauma, back of the head, trauma to forhead,which unattached his retina, bruising from head to toe, broken femur bone. The mother,also was on drugs but worked a nightshift job. She left her three children, 7,4,1,yrs. of age with a 20 yr. old drug addict, temporary boyfriend of 3 mo. So the abuse was ongoing with these kids, I lived 2 hours away and was not aware of the abuse/neglect. But when you get a call at 3:00 a.m. calling the family in, the death of a 1 yr. old with injuries like this, to the point of a death of a child, somewhere the system is failing, they are murdering our babies every day and getting by with it. Blaming drugs. Pray to God for the little ones.

    God saw Logan's abuse and scooped him up in His arms and took him home. I sincerely pray that everyone involved begs forgiveness and comes to know God's mercy.     I agree with, a mother who protects her children. CPS does nothing. I called for a case to be reviewed and nothing happened. Guess what? That child ended up with burns on his legs because supposedly the bath water was too hot! Not the first time I had seen incidents of this. But CPS failed this child. So blaming CPS does nothing for Logan. It sure won't change how they operate for other children either.

The camera man knows Michael and he was the one who made the first gesture the on the first day of the trial. It was the second day when Michael sent him a note and it was during a recess not during the trial. I know this because I was there and saw the whole incident. So what, he was saying hi to a friend.

I am praying that Michael does come out innocent. Putting an innocment man in jail is not justice for Logan. Everybody, especially the media had Michael convicted before he even had a trial. What kind of justice is that? If you all would think-Pepper only changed her story and opinion after the plea bargin to save her own behind. As for Michael's parents-thety did not covery anything up.     From what I understand from family is that Pepper kept Logan from anyone that she thought would report abuse. Inculding Logan's father,grandparents,and all other friends and family. That tells me that she new what was going on. I also belive that CPS was trying investigate Pepper and Mike. So someone did reprot the abuse.They weren't able to find them to investigate. I belive that is how Diane Merrifield became involved. She was hiding her son from CPS. I know that Logan has lots of family and friends that would have protected him, if they had only known what was going on.It also pains me hear them say that Jeremey was not a good father to Logan.Pepper made it impossible for anyone in the Goodall family to be apart of Logans life after she met Mike. I think the laws for fathers who are not married to the childs mother should be changed.It is my understanding that Pepper had total custody of Logan because she was not married to Jeremey.     Pepper should have the same jail term as Michael .. she knew exactly what was going on .. drugs or not .. and if she were driving while under the influence of drugs, and killed a child or anyone, she would be in jail. This was her baby, and she let the torture continue until that beautiful baby died. She admitted to lying before taking the plea .. why cant prosecutors tell her they lied about giving her the deal and since her story changed, theirs has also changed.     I think they all need to rot.. I don't think the child would have got any more attention if it would have been turned into CPS unless the CPS there is better and more careing then in Mingo Co. I reported abuse of my daughter in Dec.of 06 and so did her doctor and my child had an injury to her bottom which indicated sexual assult to me, my wife and the childs doctor once cps was called by the doctor they took my child from me for 5 days and placed her with one of my family members and went out to the mothers home and did a home inspection and sent my daughter right back in the same situation. I was not concerned about her home I wanted to know and to this day want to know what happined to my daughter. When I finally go in touch with the investigating CPS worker he was unaware of my daughter having any injury or that is what he told me but yet the childs doctor was the one who called cps when my wife and I told her how the child was acting so my heart goes out to Logan and His bio-father.

    Why is the focus on Pepper? She is on the one on trial here. She has openly admitted that she had a drug problem and that she should have paid more attention, and she has taken accountability and is serving her time. Isn't it bad enough that she has to live with that everyday? You all need to focus on the monster on trial here - that would be michael merryfield, and his parents as well for covering up the horrendous things that he did to that poor child. Dr. Merryfield was a licensed professional who definitley knew what was going on, so in my eyes he is just as sick as his son is and should get the same punishment that he does, which should be LIFE WITHOUT PAROLE.     I have seen this story several times & I saw it on the news when it happened but I have avoided reading it because I cant think about this little child without bringing me to tears.This is the saddest thing this cruel world has to offer.I did not know him but I did not have to meet him to know what a sweet little innocent child is like.Then after reading this my thoughts turn to anger.I can't think of a good enough punishment for the person or persons responsible so just bring back the days of public hangings so we can all watch justice being served.And if we catch anyone else doing this they will meet the same fate...............God bless his little heart I know you have him now.

    I find it very hard to believe that a mother who is bathing her child, changing his clothes etc would not notice or be concerned with numerous bruises, cuts and burns. I think most parents know how their child has gotten their injury. Pepper knew what was going on and just did not care. The drugs were the most important thing to her. She is equally responsible and I can not believe she only received 1 to 10 yrs. That really makes me sick. I don't understand women who seem to think they need to let their boyfriend or new husband abuse their child in order to keep him. Are women that desparate to have a man in their life? I hope Merrifield will receive life in prison. I also hope his father will lose his medical license and that he and his wife receive some jail time for not reporting the abuse and for not helping that helpless child. This whole case make me sick to my stomach.

    I think everybody needs to see the outcome of the trial before anybody makes any comments. In my eyes merrifield will come out not guilty.

    Again do not think th inmates will do the system's dirty work. It is not happening like in the past. The system have cracked down on inmate assaults regardless of the reason.Look at them do they look as if they have been bangled in jailed? Neither she nor he deserve to ever see this side of a penal fence- not even for medical care. Put a bandaid on the site and life goes on...and that might be too much for either of them.

    Ashley. I think you may have an UNinformed opinion. If you read the testimony of Pepper Eren herself you'll see that even she now realizes that she failed her child. She was a drug addict who put everything before her child.

    I live in another part of the country and I have been following this story for over a year now. I appreciate WSAZ making this coverage available online as I have no other way of reviewing the case. I find it interesting that in testimony Robert Eren said after his daughter became involved with Michael Merrifield, the child seemed to have more injuries than a typical toddler. He was quoted saying "I felt that he had accidents more than he ever did when he was with us," Eren said. "More than you'd think a child should have." Eren told the jury he specifically noted two bruises on the child's cheeks, bruises up and down his spinal cord, burns on his back, buttocks and heels and stitches on his scrotum. In a post below by: someone who knows (hmmm could this be Melissa Eren) indicates Logan wasn't around them much after Pepper met Merrifield. If so, how can Robert Eren's testimony be true and to top it off the Eren's never reported it. Both families should be considered responsible.

    I just can't believe all of these people knew he had injuries and burns and did nothing about it. I don't know of any way that a toddler could "accidentally" have burns and blister on his bottom. This is just tragic and ridiculous. I hope he gets the punishment he deserves. I can't imagine the pain and suffering of that Little baby suffered. I know Logan is an angel in heaven now and will suffer no more. I hope everyone involved suffers a lifetime in prison for this

    As I look at the sweet innocent face of Logan I wonder to myself...How could a human being be so very vicious. I cannot imagine what this child was going through. As for his mother...(being a mother of 2 small children) how could Pepper not know that something was going on!?! Neither Mike nor Pepper should EVER be allowed to have children. I think that they should live the rest of their lives with the memory of Logan fresh in their memory....they should be reminded daily what they put a CHILD through. Shame! Shame!

    Yes Sick. Bravo to the prosecutors, law enforcement, medical personnel and everyone else who has worked to bring justice for Logan. However, I don't mind Merrifield's photo being up here. Photos of him and his type should be put up everywhere to SHAME them and so that we can protect our children from them. I agree though that looking at him makes me want to puke.

    I think its wrong to make the mother sit behind bars while the one that did the crime is out free. I dont see how its her fault when she was not aware of what was going on behind her back. The laws today and the people that enforce them are wack and something needs to be down. My prayers out with this young lady. I cant imangine what she is going threw.

    Cases like this are why WVians should have the right to vote for the death penalty to be reinstated. Most of the people I know not only believe in the death penalty, but would also volunteer to administer it!!!

    I have been following this for quite some time now. I really feel for poor little Logan. He is now in a better place. Not only is Michael responsible for this, but his mother should be punished just the same way. And her family should of said something to authorities if they felt he was being abused. How could a mother take a lesser plea to get herself off from a crime? She had to of known what was going on and should of stopped it. But she said herself she did drugs, which in most all cases drugs come before family. To know my son died because I made the decision to live with a man who abused him would kill me. I would not want to live in society. But she gets the lesser plea and will be out walking the streets for another set of drugs soon. Her son is paying for her freedom. She should of stepped up to the plate and been a mother. No decent mother would allow her child to live in that situation. Don't worry WV she will have more when she gets out.

    How could anyone treat an innocent child this way? I would not even treat an animal in such a horrid manner. I pray that these people will be imprisoned for life. If they do not pay for this gruesome crime in this life, God will definitley be swift and furious with his punishment. Is this what we call human beings? In my opinion, they are not worthy of that name, they are barbarians. I only wish this would have never happened. That poor child. He is resting in God's arms now.

    Let's clear something up - Amy Anderson is NOT a member of West Virginians Against Abuse. She worked with us to get Logan's Law passed, but has not worked in any other capacity with us. Families often participate when we are calling for justice for victims. As far as the Eren family not reporting the abuse, - their only fault is that they BELIEVED their family doctor (Dr. Merrifield) when he treated Logan and assured them that Logan was going to be okay. Furthermore, regarding the incident where Mike Merrfield winked and sent note to Channel 3 camera man - several people in the court saw this happen.

    I'm the paternal Grandfather of Logan Shane Goodall. I agree with what most have said here. Just for the record Logan was hid from the Goodall side of his family the last 2 months of his life. My guess is to protect Pepper and Mike from being arrested. Had I seen Logan with bruises much less burns I would've called the State Police immediately!! Logan's favorite song was Jesus Loves Me.     Okay all of you people that are blaming Logans extended family and saying they are responsible have no clue. How dare you blame a loving family who loved him so much. You werent around the family and have no clue about what happened so you you should just keep your mouth shut. When Pepper met michael, she started keeping Logan away from her family..They were not around Logan like they used to be. All kids have bruises. Anyone that has kids knows that. If his extended family thought for one moment at the time that logan was being abused they would have reported it in a heartbeat. So unless you know this family or what really happened, I think you should mind your own business and pray that you never find yourself in this position.

    I have been following this case with interest since Dr. Merrifield was my physician 30 years ago when I lived in WV.I am appalled at what I am reading-a child so badly abused that he died. Where were the adults in his life other than Michael and Pepper? Where were his grandparents, cousins, aunts, uncles, etc? Say what she will, Pepper's mother is just to blame as the rest-let me see horrible burns and bruises on one of my grandchildren, and no matter how much I love my children, I would immediately take the child away and call in the authorities. That poor baby was defenseless, and NO ONE IN THAT FAMILY or circle came to his aid, and he died all alone. I don't know if Michael Merrifield is guilty or not, but Dr. Merrifield certainly is - if he did not suspect that his own son was abusing the child, why in God's name didn't he report the abuse and get the child out of that environment? What kind of parent suspects that their child is doing such and remains silent? Not the doctor I knew.

    Abuse happens more than we will ever know. I think it is a very sad situation, and what I find astonishing is how Dr. Merrifield was Dr. of the year, only in WV. If this happened to my child you would never have to worry about me filing the first charge, I would take the law into my own hands. If anyone is going to lay up in jail and be a mennace to society, eat free, have free clothing, a free education, etc. its sure isnt going to be someone who did this to my child, they would be 6 foot under and I would be the one getting all the free stuff. Its awful what America has come to. People need to wake up and bring the death penalty back, Im tired of the law breakers getting my hard earned money. May Logan Goodall rest in piece and the rest of his family rot in hell, you should have spoken up and did something for this baby.

    Well I must give my thoughts on this matter, I think whom ever saw this child was abused and DID not report it well then in my eyes they are guilty and played a part in this childs death, and if it was reported and the CPS did not help then they also should be held accountable, In time each person involved will get paid back, if you know of abuse and do not report it then you are GUILTY if that child dies!!!! Think people open your eyes!

    I blame both Pepper and Michael Merrifield equally for what happened to little Logan. The abuse that sweet little boy suffered is almost beyond belief and both of them are responsible. Hopefully, justice will prevail.

Someone should have noticed and turned them in. Now look what happened because no one did their duty. I'm so glad God has you in His hands where you are happy and safe.     That beautiful little boy is in Heaven now. It is a true shame the way he was done what little bit of time he had here. I pray the mother, father, grandmother and grandfather pay their life for what they ALL did to that little guy. I don't understand the grandmother, I'm a grandma and i would be the first to see something wrong,better still, i would be the first to take a board to my children if i even thought they were abusing my grandbaby!! She had more responsibility to the well being of that baby than anyone! However, her sentence is less than his will ever be. they should both be tried for Murder.
