ASHLAND, Ky. (WSAZ) -- A mother says the straws she bought for her three-year-old daughter were shaped like a male sex organ.

Andrea Bailey says she went shopping at the Ashland Wal-Mart on Thursday, February 28th, and bought a package of fun straws for her three 3-year-old daughter, Ashlynn.

Bailey says Ashlynn came in and used one shaped like a heart. A couple others in the package, though, were shaped like something different.

“There are two of them that are shaped like the male private area,” said Bailey. “I called Wal-Mart and they very rude with me about it. They acted like I was lying, like I was making it all up. You know, I would never make something up like that, especially about my little girl. But, that's just how they treated me and it’s just not right.”

A communications representative at Wal-Mart corporate headquarters e-mailed us a response.

"At Wal-Mart we take customer questions and concerns seriously,” said the spokesperson in a statement. “After being contacted on this matter, Wal-Mart pulled the product in question from our shelves and is investigating the claim. Of course, our customer is welcome to return the item for a refund, if they would like."

Wal-Mart informed us the straws came from a manufacturer called Eagle Marks Corporation. We could not obtain contact information for the company from our own search or Wal-Mart officials.

Andrea Bailey says her concern is not the $1.69 she paid for the straws, but what might happen to other families with kids a little older than Ashlynn.

We searched at three other Wal-Mart stories in three different states last week, and found no fun straws on any shelves.

A Wal-Mart corporate communications spokesperson told us the regional stores were aware of the flap, and Wal-Mart was reviewing the product.

First of all. I have to say that I am disgusted at all the harsh comments I have read on here. You all should be ashamed of how your treating this mother. I totaly understand where she's coming from. And I'm gonna take this opportunity to thank her for standing up for what she believes in and looking out for other children. For the rest of you, maybe you should consider doing the same thing.

You will find that most West Virginians do not raise cattle. Unfortunately, it is close-minded individuals like YOU who propel stories like these. They just explained it on the news. Someone posted a link to the story on Iambored.com and it directed thousands of new people to the website and made this story number one again. WSAZ had nothing to do with it. Why are you people always so eager to blame the TV station when you don't even know what you are talking about. WSAZ didn't bring the story back up.

Actually "DUH" was right. We did not re-post the story or bring it back up. Someone recently posted a fresh link to this story on a another website and now it's getting attention from all over the country. We would never just randomly decide to bring attention to this kind of story again. Someone else brought it back by creating a link to it on their site. As long as viewers continue to comment on this story, the comment count will climb and it will remain the most popular web story on our site. That's just the way the computer tracking system works.

Poor women, upset over a 1.50 bag of straws. Why doesnt she complain about the Washington Monument? I mean it looks like a male organ, and kids see it every day that they research historical places. That Portsmouth rock, it looks like one half of the testes. She doesnt complain about it?

Thank goodness this story is back. I had nightmares about this poor woman's plight with these questionable straws. Maybe this time around something more can be done besides just taking the straws off the shelf. (sarcasm)

Hey Duh, did you even look at that amount of comments by dates, before you decided to be rude and think you know it all. People was not commenting on this story as much as you think. Since April there was only four comments, then they bring it back on August 12th, and the comments start again.If that was the case I think the girl{Marshall student} who was murdered in Huntington would still be number one. It blew the "Questionable straw" story out of the water.

Since YOU people made more than 600 comments about it, the computer automatically lists it at number one, not WSAZ. FLeeBaily, the McDonald's lady got 2nd and 3rd degree burns from the coffee. She had no idea it was heated to the unreasonable temperature of 160 degrees. No one would have guessed that. These companies have liability insurance for that very purpose. In dealing with such vast amounts of people you can guess that some will be injured in some way. Just like Ford chose to continue producing the Pinto when they calculated that more money would be spent making the corrections than they would spend in paying lawsuit settlements to those they killed and injured. Corporate America is all about the big bucks, not the other way around. People only bring up the McDonald's coffee story because they heard about it vaguely and didn't look into the details. You can win in a lawsuit unless you have some sort of evidence of wrongdoing. Duty, breach, causation, damages are the formula for a personal injury claim. You must meet them all. The straw meets none of these.

As James pointed out, this has made some national news. Still anyone who reads the Huffington Post is suspect for reading intellectual dribble. Right up there with the New York Times and NewsMax. But I digress... Alot of the hits are not coming from people in this region but from all across the country which is why this story has not died a well deserved and timely death. Other news sources didn't pick it up until well after everyone around here got sick of it. Let's hope it dies soon.

To Andrea: No, Wal Mart didn't agree with you at all! The reason they decided to pull the straws from the shelves was simply because they are already littered with frivileous law suits from people just like you trying to score a few easy bucks. People can collect on the most rediculous grounds. Just ask the lady from the MacDonals law suit that became a millionaire because she spilled a hot cup of their coffe on her lap! That's why you see the "caution" logo on so many products today. My blow dryer has a caution tag that says "do not use in shower"!!! These companies figure that some moron out there may try and use it in the shower or else someone already has. Andrea, you may not be looking to score a few bucks, but Wal Mart is being cautious because they know it's a possibility. My wife is a Wal Mart employee, and says that it's unbelievable what some people come up with when they see $ signs along with opportunity.

You know, I find this no longer amusing. Even if the straws are inappropriate. from the bits and pieces I've read, this lady is the one who made her daughter aware that there was a problem with them. She should have just taken the bad straws out of the package and gotten rid of them. Bring them back to the Walmart she bought them at, show them the straws and complain, demand that they pull the rest from the shelves, contact the company who makes them,----ANYTHING but don't bring the actual details to the attention of your three or four year-old!

I think Ms. Bailey is making something out of nothing. I didn't see anything perverted with the straws until I looked for it, and I still think it is a reach. There are more important things to worry about with our children, than the shape of a silly straw.

looking at the two straws, I would never have thought they looked like male sex organs. The purple one looks like a bell to me but since it's been brought to our attention, the green one IS questionable. That one surely does NOT look like a rocket! I'm reading a lot of comments on how "stupid" this story is and I have to disagree. This is just a story suggested by a concerned parent and her argument is extremely valid. The straws do look like male sex organs very much and could easily be construed that way by slightly older children. They shouldn't have included that shape if it was borderline offensive. It's not even appealing enough to be worth it. They could have picked any other shape instead.

I just want to say I havent even been back on this website for at least 4 or 5 days. I cannot believe people are still talking about it. I havent talked to Wal-Mart or Randy Yohe anymore. I have to agree with those of you who support Ms. Bailey. If more people were concerned with what their children were being exposed to, maybe we wouldn't be wondering why the newest generation is so wrought with problems. We assume that "if it's on TV, it's ok", "if they learn it in school, it's ok" and i guess "if it's labeled fun straws at Wal-Mart, it's ok". If this was an innocent design "look-a-like", then maybe we are over-reacting. However, as parents, it is our right and our obligation to at least be concerned. It is a real shame that so many hateful things are said over something like this; another sign of the degradation of the times.

Teens see and think different than most young children, they would crack jokes and laugh about this! So teach your teen not to talk about it in front of people,if they think the same as she does! It does look like something vulgar. Though, Very young children wouldn't know what shape it is. I did what another person on here suggested and went to http://www.bachelorette.com/ and they ARE selling straws there called Penis straws, and they are the exact same shape. SO someone out there does manufacture these things and intended them to look like a penis. How they ended up in a child's crazy straw package is anyone's guess. But yes, these things are being manufactured as penis straws and were intended to look like like one.

Lisa, many complain about the lady who sued McDonald's over coffee. If you look into the case a little you would realize she received 2nd and 3rd degree burns. The coffee was heated to 160 degrees to keep it hot for longer. They didn't have a warning about such a high temp. No reasonable person would assume that the coffee was THAT hot. I mean, 160 degrees...come on folks. Mickey D's has the money to spare.

Here is my take on it. I do not see male private parts. I see a rocket ship, but if I did see male private parts, I would not call the store. I would get in my care and return the items for a full refund. Wal-Mart pulled the straws. Story over. I believe this woman only wanted her name in the news.

It isn't offensive, but it is inappropriate. If this is to be included the packaging should have indicated it was an "adult item" in some plain manner. As for customer service's reaction, I would want to know how the customer presented herself before passing judgment. If she were polite and just pointing out a problem they responded poorly. But if she were yelling and screaming, while not a good response, their reaction is understandable. Bottom line is this. If Wal-Mart did pull all this product from their shelves you can be very sure the manufacturer won't do THAT again

I can understand the concern the mother may have. I personally don't see what she saw. However, I do think the Walmart customer service department should have been rude to her. But,then again they probably get prank calls all the time.. Again, I don't see the resemblance.. To all you posters basher her for standing up for what she believes in... I guess you have no problem with Bill Clinton, or Spitzer having extramarital affairs either. What is wrong, is wrong. I admire someone who actually stands up for what they believe in. Too many people get offended by someone exercising their free speech. Why bash her? Because it is not what you would do? So what. It matters to her what her kids are exposed to. I am glad she did it. I don't want my kids exposed to the same straws that you can buy from a sex site either. I don't let my kids dress a certain way, either because I believe in modesty. Maybe if more parents were concerned about these issues, some of the other issues wouldn't be an issue. WE need not let our kids grow to be immune to this stuff. We need to teach them certain things are wrong. WE need to be the parents. Grow up, bashers. Maybe the same company that makes the bachelorette party straws make these and goofed.Probably not Walmart's fault, they may have not known.Although a point I think she was trying to make was poor customer service, which seems to be the norm. I have been treated rudely by Wal-Mart employees.I would be written up for acting that way at my job.I think its kind of silly this made the news, but sometimes these big superchains need a kick in the ego.They seem to think that since they are the dominant business we have no place else to go and can have poor service.

I agree with several people that say that it is like art everyone sees something different. When my kids get these kinds of straws they don't look at them and see what shape they see. They watch the liquid going up the straw. I have kids aging from 6 to 11 and they don't think like that mother did. My point is yes alot of us adults see it but she was being paranoid if she thought any child would see that. Most parents out there would know that their children's minds doesn't automatically see the nasty side of everything. If we use our adult minds to view things for our children (which we do on a daily basis) we need to always remember that. BTW I just brought up the pic for my 11 yr old and asked what it looked like and they responded that it looked like a nose, the cartoon drawing of a nose. As an after note this story reminds me of the one who sued McDonalds for getting burnt by coffee. Can we say use that brain for something useful.

Remember before bottles had twist off caps? We used a tool called a bottle opener that closely resembles the shape of this straw. We used them daily and never did we think we were being gross by holding this tool in our hand to pry off a cap of soda pop. Its shape had no psychological effects on our childhood development. Parents then had values and did not feel the need to air smut throught the community. Once again lets reinforce a negative..

This story is silly. It is a straw. I seriously doubt any gradeschool, preschool, or young child out there will see this as anything other than a fun straw. Blaming Wal-mart makes no sense. I feel this lady needs to get a life. There are people who to easily get offended over things that can easily be shrugged off. Like I have said over and over I am not expecting Wal-Mart to give me ANYTHING! All I wanted was the straws off the shelves. I found them to be inapropriate shapes for children. If they were meant to be rockets,hats,or whatever else other people have said, that's your opinions and I respect that. To me I just think they could have used a better judgement of shape to put in a bag of kids straws. I seen the same shape straw at bachelorette.com, so to me my judgement was right. And I just want to say thank you to all the people who understand my concern and knew I was just looking out for my little girl. I think the bigger issue that needs to be addressed is the fact that children are recognizing this straw as an arbys hat. this tells me that children are either watching way to much tv or they are eating out way to much which in turn is leading too the increase in childhood obesity.

This is definitely not newsworthy. If I had gotten this packet of straws home and realized that they looked like a male sex organ, I would have simply laughed about it with my husband in private and thrown them away. It's not worth getting worked up. The manufacturer probably meant it to look like something totally different thank what this lady was thinking.

If 67.2% of the people say a red light is green, does it make the red light green? Or is the red light still a red light? It is still a red light, even thought the majority say it is green. Same thing with the straw. It is what it is. This lady had a problem with Wal-Mart selling this product to her kids. She has the parental responsibility to bring it to their attention. It is awful that the customer service reps treated her with disrespect. Whether they agree with her stance or not, they are CSRs and are the front line to the business. They reflect the company. I guarantee you that if you had a beef with Sears over how the CSR spoke to you when you had a problem with your power saw, you would want that person to lose their job. Give this lady a break. Anytime any parent has any other type of a problem with a toy over safety issues, it seems ok to gripe about it. What about sexual safety? I applaud her efforts. More parents need to take a stand for what is right.

while I am not a big supporter of walmart, this lady needs to get her priorities straight. And I have long been a believer that if you see a shape, hear a saying, etc that can have more then one meaning and your mind comes to the more perverted meaning first then your mind was headed that way without you seeing or hearing what made that come to your mind. Wake up lady Walmart is not going to pay you off for your perverted mind. Wake up US, we are worried about shapes of straws and not what is going on around us, Gas prices out the roof, possibilities of a resession, the presidential election. There are plenty more things to worry about then a shape that can be seen as anything from a Rocket, Pear, just a shape, gentials, etc. Fact is you are going to see what you see. Since you can buy these straws at any place that sells bachelorette party supplies, as "Male Organ" straws, I think she has a claim. It is obvious this mother actually cares what her kids are doing. Just seeing the male organ in the straw does not make someone a pervert. I would not let my kids drink from these straws. I, too, care about even the finer details about my kids lives. I think part of the problem in today's society is that not enough people care enough to take a stand. Kudos to her for standing up for what she believes in. Last I checked, she still had the right to do that in America, whether you agree with her or not. If more parents cared about the sexual overtones to most of everything sold, teenage pregnancy and STDs would decline. To the naysayers... how can you say that the same company that sells these straws as "male organ" straws, and then puts them into a misc.package, that they all of a sudden are not "male organ straws"?

This is obviously not a bell,(awfully tall bell) or a hat,(not even Hoss Cartright's was that tall, also it has an awfully rounded brim.) A rocket ship does not have such a rounded tip, after all it has to penetrate the Earth's atmosphere. It is obviously made by the same manufacturer as the ones sold on bachelorette.com. I think this is a major thing for this woman. If something was to happen like this to me I would feel the same way. I wouldn't want my kids to have a straw in the shape of that. Things like that happen all the time and nothing ever gets done. I don't think it was Wal-Marts fault but they could have been a little nicer and understanding about things but I think the main company over the straws should be the people punished but that is my opinion. The fact of the matter here is that a young mother found an offensive product at Wal-mart and tried to make Wal-mart aware of the problem, and Wal-mart treated her in a rude manner. The concern should not be that Randy Yohe had to pay for gas to do the interview. Did the gas money come from you personally? I don't think so. The news team apparently found it controversial enough to air, so there you go. And apparently they were right. Look at all these messages left here. There are always 2 sides to the story. Maybe the authorities should get involved...this lady obviously has a lot of time on her hands and is too concerned with calling WSAZ to take care of her child. When I first saw the photo attached to this story I was shocked, I expected to see something WAY more graphic than that. Those straws are nothing. Why is this considered news? But on the other hand, yes I see the male organ I saw it before the story even got to WSAZ at a birthday party for a 4yr old. No the children probably dont see what we see out of it but its the fact that the children are being exposed to it and if your kids rocket ship or whatever looks like the straws do then I think you need to get your kid a new toy!I mean honestly what kind of toys are your kids playing with? The straws clearly look like male genitalia to me. Even without the suggestion of it, that's what they look like. I asked both of my sons who are 10 and 14 what they thought the straws looked like, and they both said, um.. boy parts. I agree with Andrea. Wal-mart should have not been rude about it. And for those of you saying Andrea can't protect her daughter from everything, you are right. But, she can protect her for a while from lots of things and that's what's important. Protect your kids when you can as long as you can, for the time will come when you can't. I protect my kids too. Keep up the good work Andrea. 1st of all, these products should have been pulled from the shelf. Wal-Mart is a family oriented store not your trashy corner store. As for the Ashland Walmart treating the customer rudely, I understand that whole heartedly. I have lived in the Ashland-Russell community for nearly 2 years, and the people are so rude. Especially at Walmart. For a place that is suppose to offer so much friendly service with smiles, I think this store trains their associates to be nasty and rude. And it isn't the principal of the child's age, but my Lord, good honest decent people just dont have things like that in their home. This mom was right in her choices!

As a Wal-Mart employee I have to say we receive our fair share of prank phone calls and if anyone was rude to her it was probably because they thought it was a prank call. This shouldn't be made into a big deal. The child is too young to realize what the straw looks like. Throw it in the trash and move on with your life!

Some of you apparently didn't read the story. As far as I can tell the straws were assorted and she didn't choose the rocket ship shaped straws. Also, she obviously first contacted Wal-Mart as some of you have suggested she should have done. When Wal-Mart employees became rude to her and didn't take her seriously she contacted the news. Well as a parent their are somethings that your children shouldn't see, but good lord she is 3 years old and like she knows what that is. Maybe if she was like 6 you wouldn't let her see it. My son is 7 months and if I bought those and he was 3 I would let him use it. Maybe if you wouldn't have made a big deal about it she wouldn't pay attention to what 'Mommy' is talking about. I happen to know that Wal-Mart did respond promptly and respectfully to this woman before the news even covered it. SHE LIES!! The manager she spoke with was very respectful and never once made this woman feel like she wasn't being truthful. SHE JUSTS WANTS HER 15 MINUTES OF FAME!! The story is that Walmart was rude. It is not as serious as some of the other stories in the news, but I like to know how my local shopping centers are treating my neighbors. Walmart owes this woman an apology if nothing else. I would also keep the straw to show my friends, but I can't stand rude customer service representatives or managers.

I completely agree with the mother who bought the straws, I had purchased the same straws with the same thoughts, my husband made me throw them away, my 12 year old wanted to take them to school to have "fun" with them. To me everyone has a right to an opion and Andrea has a right to hers especially when it comes to her child. All I can say is WAY TO GO! When I was a little girl, my favorite things were Barbie, Disney movies, and Punky Brewster. Today, Barbie is bashed because she "gives young girls an unrealistic standard of acceptable body image". So they alter her bust and waist (not that I can tell a difference). Never mind that size 2 is considered "a little too big" for Hollywood these days. Disney movies are reportedly full of subliminal messages (think Little Mermaid and Aladin). However, I didn't figure this out till I was 21. Don't you guys get it? It's adults that read perversion into things, not children. If I were a child and you asked me what it looked like, I'd giggle and laugh because I was clueless as too what it was that you wanted me to see. Adults pervert children. For those who think I need to "get a job" or im a "house mouse" I just want to say I am lucky enough my husband has a good job and works almost everyday so I dont have to.He doesnt want me to work, he would rather I stay home to take care of our daughter,& not having her raised by a stranger. Being a full time mother and house wife is the most important thing to me. And since I have the chance to do it, that is what I am going to do. I want my daughter to be raised right. We grew up watching wchs, channel 3 was the only news station that my parents thought was worth watching. But the stories that are reported anymore are just plain silly. I can't believe that this was found news worthy. There has been several times that the agency that I work for has called to get wsaz to do a news story on an upcoming event or something that we have done for children and families and we just get blown off. Please quit giving Tim Irr such big words, I know there is not a newcast that goes by that he messes up several times in the same story, he either mispronounces something or stammers though a line. It has gotten to be a game at the house,who catches Tim's mistakes first.

This is the lady from the interview again, I just want to say when I purchased the straws no I didnt see them or I wouldnt have bought them. My little girl pulled them off the rack and threw them in the buggy. Why would I have taken time to examine the shapes? They came from Wal-Mart. And as far as a law suit, I dont think so, My husband has a very good job and we dont need their money. Randy Yohe told me after I talked to him he thought I had a good story, thats why I agreed to come on the news. Wal-Mart had no reason to treat me the way they did. All I wanted was the straws taken off the shelf because I did find them offensive. My daughter is everything to me as well as my son I am pregnant with now. People say I am perverted or have a sick mind? I call it being a good parent. Everyone has their own opinion, but like I said before some employees from Wal-Mart agreed with me on this. And at least they did pull the straws and that is all I wanted.

Why in the world would people waste money on something like this anyway? I don't think those straws are fun at all. They use plastic needlessly. They will eventually be full of bacteria, because they can't be cleaned. They will end up in a landfill. They are trash from start to finish. And, as a representation of a male sex organ, a rocket or whatever, they lack any artistic merit whatsoever. They also fail at being pornographic in that they could not possibly raise any prurient interest in anyone.

When my children were young, fun straws were reported to hold bacteria and could not be cleaned well. I threw all ours away so the children wouldn't get sick. Why don't we concentrate on it's safety rather than what it looks like!

Andrea you are right bout older kids I have 3, 2 live at home and they are all teens and they think the same but can see other views also. Although it's been a tough week here we needed a laugh. I think everyone here has missed the point. A paying customer contacted walmart with a legit concern and was treated rudely. If the matter had been taken seriously then this mother would not have had to go this far in getting her message across. Children are exposed to way to much of this type of material so good for her for looking out for her childs best interest. The fact that you would just overlook something like this makes me hope and pray that you dont have children to which you feel so comfortable exposing such material to. Well, my wife and I were shopping at wal-mart on rt 60. about the same time as the lady in the interview, we got the same straws. I can see how she sees that because that was the first thing that came to our minds. We didnt contact wal-mart though we should have. we through it away. so i dont think she is being perverted. I checked it out and those straws in THAT specific shape are for sale on Bachelorette.com by they look like they are from same manufacturer that Wal-Mart uses...and YES they are sold as "male private parts" straws! Looks to me like Wal-Mart needs to have better quality control!! Kudos to Andrea for making a difference, little kids shouldn't be exposed to such things. Shame on Wal-Mart!

To defend the mother,I bought the same straws for my 4 year old I threw them out when her 12 year old brother and friends had a huge laugh about them.I would bet they are from China like everything else from WalMart,along with the tainted toys. It may not be big news but again you dont have to be a pervert to see something sick in those straws. I think she was sincerely trying to protect her daughter, some of these comments are ridiculous! I really dont believe a law suit is in the future, but I do believe whoever made these knew what they were doing.

When the image came up before I read the story I thought it was the male genitals. However a 3 year old is not going to see it that way. Who cares. I'd just laugh it off and let the kid use the straws. the second thing I thought of was an Arby's hat. I don't see a bell or a rocket ship. Its too curvy for those.

How can Wal-Mart be held accountable for these straws? Were they manufactured only for Wal-Mart? This is so stupid. I of course did see the same thing, but only after the lady said so. At first, I thought it was a bell, or even a pear. Turn them the other way, & they look like heart shaped balloons.

I purchased a package of fun straws from Wal-mart route 60. I threw the straws in the trash. After my daughter saw this she said she would not drink from the pee wee straws. She's 6. I agree they need pulled from all stores.

When I see packages of shaped straws, I usually know what I'm getting in the package. The lady should have looked at the straws BEFORE buying or even letting her child have possession of them, if she thought they were offensive. So, Mrs. Bailey YOU failed protecting your child from whatever you think you are seeing. I see rockets and a big lawsuit against WalMart for some mental anguish to this child and her mother. Go WalMart, get those attorneys ready for another stupid lawsuit from someone wanting a quick buck.

I just want to say I am the lady from the interview and first of all I am not trying to get ANY money from Wal-Mart. My biggest concern was I was not the only one who agreed on how the straws looked,even people from Wal-Mart agreed, but the fact was they were very rude when I told them the straws needed pulled from the shelves. I don't want their money I just don't want something that is "questionable" to get in the hands of kids. To me they looked like something that would come from an adult novelty store.

I feel that the straws were probably meant to be something like rocket ships as Randy suggested, and it is upsetting that a parent would turn it into an inappropriate object. What if her little girl wants to be a rocket scientist one day but is too scared of the shape?
