Murder Case Headed to Grand Jury

HUNTINGTON, W.VA. (WSAZ) -- Henry Smith and his family are still shocked that their niece, Kathy Smith, who was 58, is dead.

Robert Frazier, a man they say she loved and tried to help, is accused of her murder.

According to testimony in Frazier’s preliminary hearing, it may have been Smith’s effort to finally make a permanent break from Frazier that lead to her murder.

A witness who did not want to be identified said he was in the home at the time of the murder. He was there to make a payment on a motorcycle Frazier was selling him, "I heard them arguing and then heard Frazier say, I’m going to get you and they went into the room and I heard a gunshot," the witness said.

Adding that he immediately left the house and then saw Frazier climbing out of a window covered in blood, a short time later, the man called 911.

Detective Chris Sperry talked to Frazier just prior to his arrest, "he admitted to shooting her and apologized."

After today’s hearing Henry Smith had strong words for Frazier, "I hope he goes to jail and pays for what he's done."

The judge found probable cause to send the case to the Grand Jury.

In the meantime, Kathy's family members are struggling to cope with how such a giving person gave too much.

HUNTINGTON, W.Va. (WSAZ) -- The man charged with the murder of a woman at her home in Guyandotte was back in court today for his preliminary hearing.

Police say that Robert Frazier shot and killed Kathryn Smith.

It happened in late August at the Richmond Street home where police say the two lived.

Police arrested Smith at a nearby convenience store a short time after the shooting.

Police say they went to the house after receiving a tip about a domestic assault; inside they found Smith's body.

According to court records, a cooperating witness who was at the house at the time told police that Frazier and Smith were in a verbal argument when Frazier picked up a shotgun and fired one shot.

Following this afternoon's testimony, a Cabell County Magistrate found probable cause to send the case to a grand jury.

A Huntington Police Detective testified at the hearing that Frazier confessed to crime after being taken into custody.
