GREENUP, Ky. (WSAZ) -- The border battle continues to rage over the Indian Head Rock, which remains stuck in a garage.

Last year, an Ohio dive team raised the historic artifact from the Ohio River. The problem was that they took the eight-ton ton boulder from the Kentucky side; now felony theft charges are in motion.

It was a year ago this week that David Vetter, a member of the Ohio Indian Head Rock dive team, said he was not an artifact thief, explaining that maritime laws say there's no ownership of a rock.

Commonwealth Attorney Cliff Duvall said the law indicates otherwise and that Vetter may not be the only rock diver indicted by a grand jury. The judge and prosecutor were present Thursday in Greenup County District Court, but not Vetter, the latest criminal suspect slated to be arraigned for violating Kentucky's Antiquities Act. We're told his summons was not served.

Ohio dive team leader Steve Shaffer, who pleaded not guilty to violating the Antiquities Act, is free on bond and awaiting trial on the felony charge. Duvall does not expect a plea deal.

Meanwhile, the eight-ton rock remains in the Portsmouth City Garage.

Vetter's arraignment has been moved to next week. Duvall said the next Greenup grand jury will look at more possible rock theft charges.
