CHARLESTON, W.Va. (WSAZ) -- The son of Charleston Mayor Danny Jones was charged with DUI after a crash in South Hills Sunday evening.

According to the criminal complaint, 19-year-old Zachary Jones of Charleston crashed his Chevy Cobalt in the 700-block of Bridge Road at about 9:00 p.m. Officers found the car in the middle of the roadway with heavy front end damage, and said it had to be towed from the scene.

Witnesses told police that a man wearing a black sleeveless t-shirt got out of the driver's side of the car and ran away from the scene. At about 9:15 p.m., police caught up with someone matching that description at the intersection of Louden Heights Road and Abney Circle. That man was identified as Zachary Jones.

Charleston Police stated in the complaint that Jones' clothes were "wet and dirty, his eyes were glassy and bloodshot, and the odor of alcoholic beverage was present on his person." When asked, Jones told the officer he was the person driving the crashed Cobalt.

The investigating officer stated that Jones then failed a horizontal gaze nystagmus sobriety test, and then failed a Breathalyzer test and placed under arrest. The complaint says he registered a 0.122---over the legal limit of 0.08 in West Virginia.

Jones suffered injuries to his ankle and wrist in the crash. He was taken to CAMC for treatment.

Jones is charged with 1st offense DUI and striking a highway fixture while DUI. The magistrate set his bond at $1,000 personal recognizance.

Police Chief Brent Webster tells WSAZ.com that Jones was cooperative during the arrest, admitting to being involved in the crash and voluntarily blowing into a Breathalyzer. He says his officers handled the case very well and fairly.

Some visitors to WSAZ.com Monday left comments asking why Jones was not also charged with fleeing the scene. Sergeant Shawn Williams with the Charleston Police Department Traffic Division says it is not uncommon for a person to not be charged with fleeing in a DUI case. He says the law allows a person to leave the scene to try to get help.

In this case, Williams says the investigating officer actually charged Jones with a more stringent DUI charge---using the standard charge for adults instead of a lesser charge for a person under 21 years old.

WSAZ.com contacted Mayor Jones' office, but he did not want to comment on the case.

I'M GUESSING HE ARRIVED AT THE HOSPITAL AT A LATE HOUR, WAITED FOR HOURS (YOU KNOW HOW THE E.R. IS) THEN HAD THE STANDARD PROCEDURES DONE. I KNOW FOR A FACT THAT MAJ. COURT OPENS AT 8. I think someone saying "Too bad this young man lived" Is totally ignorant!! I think you have some growing up to do yourself. I am personally Zach friend. He has learned his lesson from his car being completely destroyed, His Dad being mad, on top of his charges. If you think someone should die from this then you need to realize that people like you are the ones that make this world so bad. Give Zac a break I am only 20 and have way more to learn in life esp since I am on my way to being a Charleston Police officer. My point is he does have things to learn as well and its a good thing he has learned his lesson. He will get something out of this though its his first DUI offense since he didn't hit anyone its serious but still its going to be taken care of. So everyone has their opinions but seriously everyone should look at how they act as well instead of bashing Zac!

Way to stand up for your family uncle, maybe some on here could learn what loyalty is. He's a kid, he is only 19 years old and people make mistakes. Luckily, no one got seriously hurt and he learns from it. Maybe this is one of gods ways to make him realize where is or was headed. I'm in his corner. People please stop and think if this happened to your family, would you want all of the negativity? He has became a target because of his dad, but like one commenter said, he wasn't raised by his dad so he would be different. I'm sure danny probably did pull some strings, but who wouldn't? If this was your child and you had a position that could offer some persuasion, you would do it too. Well said Vicky.. Sounds like Zach has a few more people in his corner than he realizes. Keep your head up Zach and rise above this.

Yes laura, I know what a job is, But the luxury of having a car eluded me since my money had to goto medical bills from the cancer that I battled at 18. I am glad this kid is ok, I would never wish something bad on anybody. But you cannot convince me there has been no preferential treatment because of who his dad is. I hope this kid learned his lesson because it would show his snobby relatives that even a campbells creeker can be responsible. Ironic this happened in South Hills huh? Sue maybe that's what were doing is worrying about our own. People are tired of having to share the road w/ drunk drivers no matter who they are. Innocent lives die everyday at the hands of a drunk driver and fortunately this kid was lucky this time. But you're right, people do need to have more tact when they do comment. Karma, she's a b.... and she will bite ya.

I am not a fan of Danny Jones at all but lets be real....there are people caught everyday for DUI and they are trashed in the press like this. Leave the kid alone, let the legal process take place and worry about your own. I have always said 'Be careful what you say about somebody elses child, it could come back and bite you on the a**."

Heather, 'paying through the nose' could be construed as a civil lawsuit for defamation of character. Are you saying you wouldn't be upset if someone said they wished your family member had died because of one stupid mistake? Think before you type. I fully agree with most on here, drinking and driving is completely unacceptable. He will get what's coming to him, from me included, rest assured. But reading people's comments on here bad mouthing him, who don't even KNOW him, calling him a meth head or whatever because of the way he looks. You should be ashamed. I love every member of my family and I wont stand by idly and let a pack of morons tear him apart.

Well he and the mayor will DEFINATELY need to speak up about this and he will DEFINATELY need to be put into some type of rehab; otherwise, the mayor is a complete hypocrite and needs to step down. Plus, he looks like a meth addict, I can't even believe he is only 19! He looks early 30's in this pic at least! He needs to some help and it doesn't look like just for alcohol.

Luther - Believe it or not...this is a REAL crime. Driving under the influence of alcohol is ILLEGAL. Too many innocent lives are lost to drunk drivers. I have had to deal with too many drunks in my life. I stood beside my ex husband when he plead guilty to his first DUI and then I walked away from him after the next one. Two or three more DUI's later and I still shake my head at how he can't learn to dial the phone for a taxi instead of taking the chance of making an innocent person a statistic. People make stupid decisions in their lives. This young man found out that he is not 10 feet tall and bullet proof. And yes, I have given this a great deal of thought and I can be forgiving, but only if this young man faces his poor decisions like the man he was "trying" to be, learns from it, and does not repeat it. He should get no worse but no better punishment than anyone else in this situation because of his age or who he is. He was lucky. Hope he appreciates it.

Zach, let this be a good lesson! Be thankful you didn't hurt anyone and you weren't hurt yourself! You were close friends with my son in high school. I know that you didn't have it as easy as some on here may think but that's not the issue! You are a good person, you made a mistake, learn from it! Know that you are always going to be in the spotlight because of who your father is. Use that to your advantage and do good things for this community. You have the ability to be a great success!

He was treated as any other DUI offender. There is no scandal or controversy. He actually was charged with a harsher offense. Stop looking for the cover-up. I think people are being overly malicious about this. I am Zach's cousin and he is a wonderful young man. He made a mistake which we all do when we're young. I'm sure he has learned a valid life lesson from all this. I don't think he's getting preferential treatment b/c he's the mayor's son; only he's getting more attention b/c of it.

How is it that people seem to relish in others misfortunes? Calling Mayor Jones a deadbeat dad??? What a terrible spewing assumption. He did everything he could to help raise him, but this poor boy obviously grew up in two very culturally different worlds. He is an adult now and now will hopefully make a decision about whether he adopts the poor attitude of Cambell Creekers, or to grow up and be a responsible man. Lets hope this is a wake up call for him and any potential problems he may have....lets give him and his family peace to work things out. He will obviously be paying for this for a long time.

sikntrd- that's unfortunate you didn't have a car when you were 19... but a lot of people do/did. and a lot of them paid for it with their own money. it's called having a job, which this kid did. spoiled kids are the ones with brand new mercedes & bmws at the age of 15. not a stinkin chevy cobalt. drinking and driving is still wrong.

It is simply amazing to me that he got charged w/ a DUI and didn't even spend the night in jail @ least! 1,000 pr bond? This is a prime example of him getting off b/c of who his father is. DUI charges have a mandatory jail stay no questions asked, what is really going on? Stop showing favortism and treat him like everybody else! I doubt he was running to go get help...didn't he have a cell phone anyway? None of this makes sense, another cover up. WV is all about conspiracy, I'm glad I'm not from WV.

More on the accident... I was in the area at the time. Driving down Bridge Rd, I had to go down Grosscup Rd to avoid the emergency vehicles. Almost to Louden Heights, Zachary JONES was running down the road and he fell in the ditch. He got up and proceeded to the other side of the road. That is when he fell down the cliff from Grosscup Road all the way to Louden Heights Rd. My father got out of the car to see if he needed help. Not responding, we continued down the road when we saw him running again up Louden Heights road. We told a police officer near the Southside Bridge and he went to arrest him. That would explain the wrist and ankle injuries!

Response to No Bracelets: This young man had the accident about 9:00 pm. He may have been listed on the jail website from 9:00 pm until 12:00 midnight when the slate is wiped clean. You were probably out drinking at that time and did not check the daily incarcerations between 9:00 and 12:00 midnight.

Anyone with an IQ greater than their shoe size knows you can't control your kid 100% of the time. I'm his uncle and I can tell you he's a great kid, he just screwed up ONCE. He has so many other great things going for him, this one mistake will not be the story of his life. He is a great musician, loves his job and his family, and is truly devistated by this. He has learned his lesson. To those who say he shouldn't have lived, don't let me catch you saying that on the street, you'll pay through your nose, pal. Chicken-**** anonymity is all you have, so you type whatever dribble leaks from your pie hole. Don't crucify Zach just because you don't like his dad.

So many of you stone-casters are quick to want to get onto the subject of my past and my mistakes. This is neither the time, nor the place. What I do want to talk about is this poor young man, this unfortunate accident that he's being charged w/ (Whether guilty or not), and the fact that people are trying to make this into a real crime...if anyone would like to address these 3, I'd like to read the response. If not, simply post something like what Nikki wrote...good Nikki, that obviously took some thought...are you okay?

Yes, WV Mom you're right. People are vicious on here. I think they would take the time to think about what they are saying if they were face to face. I agree w/ the comments about preferential treatment. You should not be given special treatment because of who your dad is. No Bracelets makes an excellent point, why was he not on the web site? I wondered that myself.

I thought a first time DUI offense instills a mandatory 24 hours in jail. If Mr. Jones was arrested at 9:15 then wouldn't he still be in jail until later tonight? How come his name was never listed on the WVRJA website under daily incarcerations for Sunday or the inmate search? Guess it's not who you know, but *** *** ****! The following is from DUI.com: You are DUI in West Virginia if your blood alcohol content (BAC) is .10% or higher. However, a BAC of more than 0.05% but less than 0.10% is considered relevant evidence to presume you were driving with your ability impaired. Therefore, you may still lose your license if your BAC is under the official legal limit of .10% First Offender Penalties: JAIL-1 day to 6 months. Mandatory minimum is 1 day.FINES-$100 to $500 with a mandatory minimum of $100. LICENSE SUSPENSION-6 months to 1 year. Reinstatement Fee: $65 COMMUNITY SERVICE-May serve as alternative to imprisonment.

I am so disheartened to read these remarks. Yes, it is illegal for someone under 21 to consume alcohol, and it is illegal for anyone to drive while under the influence. No argument. But I haven't seen this kind of venom poured out on other young people in similar circumstances. I am shocked. I have a child. And it does cross my mind that my child could be at risk from any driver who is impaired. But if my child made a mistake, I would be horrified for someone to say "too bad he lived." What kind of community are we? It seems that this young man is being sacrificed in an effort to berate his father. That feels pretty cowardly to me. I am disappointed that we would treat anyone's child so callously. There is nothing in this account to indicate that this young man needs a special dose of hate, nor to suggest that his father had any role in the young man's behavior. I hope your own mothers would be ashamed of you. I am.

I just read about the magistrate's nephew pleading guilty to all those charges but did you know that Braxton Magistrate Smith's own brother was arrested several months ago for drugs but that apparently was swept under the rug too. Home cooking!

Before anyone makes any assumption that "Mayor" Daddy Jones will bail out his son first of all Zach was raised by Grandma not Deadbeat Danny Jones. Zach made a mistake pray that he has learned a lesson without disrupting too many lives.

I think it is awful that someone wrote too bad this young man lived. Have you ever heard what goes around comes around! I agree this young man needs to abide by the law and if not suffer the consequences. I notice though the news media has never paid this young man much attention when Danny Jones was in the spot light running for Mayor. Danny only spoke mostly of his children with his Now wife. I think it is a Sad thing that only now after Zachary made a mistake that his name and face is plastered all over the news! If my daughter had not went to school with Zachary I would have not know that he even existed!

Im sure this will get swept under the rug. He should be charged with fleeing the scene of an accident. Im wondering why Chas PD didnt file that charge as well. $1000 PR bond for that huh? Well Danny Jones, you should be glad that he didnt kill anyone. Thats whats next in this childs future if he doesnt suffer any consequences. He obviously wasnt hurt too bad if he could flee the scene of an accident and probably didnt require medical attention, but it was a swift move to get out of going to jail.

Hey Luther! There is a zero tolerance for alcohol level in anyone under the age of 21. So take the .08 theory and forget it. Even if he had blown a .06 he should be charged in WV, KY, or OH and most other states. You say he has paid enough because of his injuries and he damaged his car...you can't be serious. I just hope he has learned his lesson while he goes to his drunk classes, rides his bike to get around or has to have his dad drive him around. Lessons that are costly have a great chance of sticking. Thank God he walked away with only minor injuries. His dad could be having to make funeral arrangements.

To Luther: I truly hope that you're being sarcastic.."The law just isn't fair." How is it not fair? I didn't have a car at this kids age to lose. I didn't have somebody that could just hand me the keys to a car the way Danny Jones can do. The things that I have was earned through hard work and I do not want some spoiled kid taking any of it away because of who his daddy is and what he can get by w/. So, please enlighten us on how its fair when a family dies because you decide to get behind the wheel after drinking and cross the center line and hit them head on. How's that fair?

Relatives of public officials make mistakes too. In Braxton County the nephew of Magistrate Beth Smith just plead guilty to home invasion, robbery, abuse, burglarly, and conspiracy of an elderly lady, all flonies but do you think he will serve much time for this since his aunt is allegedly in cahoots with the circuit judges.

The point to me here is a 19 year old drinking and driving. The legal age limit is 21. The question that should be asked and pursued is WHERE DID HE obtain the alcohol? That person needs punished too. He needs to be charged just like anyone else and with his age, he needs to be required some type of treatment program. Yes, we were all young once, but lets learn from our mistakes...
