A special prosecutor has been requested as Commonwealth's Attorney J. Stewart Schneider seeks an investigation of the primary election in Boyd County.
The states attorney general was requested to supply the prosecutor after a Boyd grand jury found inconsistencies with the May primary.
Schneider was a candidate and says as a matter of ethics, someone else should work with the grand jury on the probe.
Schneider says subpoenas have been issued.
Schneider lost his post to challenger David Justice.
Voters complained about being given the wrong ballots in some precincts and some candidates were left off ballots in the Catlettsburg city races.
The media and candidates were barred from monitoring the vote tally election night and correct vote totals for some races were not released on the night of the election.
There were also complaints about a new voting machine and votes that weren't counted from another until a recanvass was conducted.
